RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: This item appropriates an additional$207,609 in the Transportation Services Fund and$23,610 in the North Front Range Transportation&Air Quality Planning Council Fund(NFRT&AQPC)representing unanticipated revenue for the 2001-2002 Fiscal year, for administration of the NFRT&AQPC. The following funding sources have been identified: 2001-2002 Federal Fiscal Year Funds administered by CDOT $ 164,975 2001-2002 State of Colorado Revenue Grant Funds 31,000 Local Matching funds from the City's Equipment Fund 18,554 Local Matching funds from MPO Member Entities 11,590 VanGo Program Revenue 5,100 Total $231,219 In addition,this item also transfers$207,625 of existing 2002 appropriations within the Transportation Services Fund to the NFRT&AQPC Fund for personnel expenditures of non-City MPO employees. The funding for these transfers are 2001-2002 Federal Fiscal Year funds administered by CDOT as well as applicable local match provided by MPO Member Entities. Because these appropriations are for federal grant projects, the appropriations will be considered to be "non-lapsing". EXECUTIVE SUMMARY: The North Front Range Transportation&Air Quality Planning Council(NFRT&AQPC),or MPO,received additional federal funding on its 2001-2002 contracts with Colorado Department of Transportation as well as some unanticipated State grant funding which wasn't originally budgeted or appropriated for the current fiscal year. These funds ($195,975), along with required local matching funds from the City's Equipment Fund($18,554),MPO member entities($11,590),and additional VanGo program revenue($5,100)will be used for the administration of the MPO's projects during its 2001-2002 contract period. Additionally, the funds to pay the personnel costs of non-City MPO employees, which were previously budgeted and appropriated in the Transportation Services Fund, now need to be transferred to the NFRT&AQPC Fund. The Council's approval of this portion of the Ordinance ($207,625) will not appropriate additional funds; rather, it will serve as a transfer of existing appropriations to the fund that incurred the expenditures. BACKGROUND: The NFRT & AQPC is the regional Metropolitan Planning Organization. As the MPO hires new employees, they are no longer considered to be employees of the City of Fort Collins. For that reason, the MPO has a separate Federal Taxpayer Identification Number and therefore has to report the MPO employee's payroll expenditures separately, thus requiring the use of the separate MPO fund on the City's accounting system. For this reason,the existing appropriations for these people (originally budgeted in the Transportation Services Fund) need to be transferred to the NFRT&AQPC Fund. t c DATE: ar ITEM NUMBER: Additionally,since the MPO's fiscal year closes September 30,2002, all additional unanticipated revenues not previously appropriated, need to be appropriated at this time so as to get the budgets/appropriations to balance to the applicable contracts received from Colorado Department of Transportation and other State funding agencies. ORDINANCE NO. 124, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSPORTATION SERVICES FUND AND THE NORTH FRONT RANGE TRANSPORTATION & AIR QUALITY PLANNING COUNCIL FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN FUNDS FOR THE OPERATION OF THE NORTH FRONT RANGE TRANSPORTATION & AIR QUALITY PLANNING COUNCIL'S 2001-2002 METROPOLITAN PLANNING ORGANIZATION PROGRAM YEAR WHEREAS, the North Front Range Transportation & Air Quality Planning Council (the "NFRT&AQPC"), consisting of representatives from thirteen front range local governments, is the Metropolitan Planning Organization ("MPO") and lead air quality planning agency for the North Front Range region; and WHEREAS, primary funding for the administration of MPO programs consists of federal transportation program funds appropriated by the federal government and administered by the Colorado Department of Transportation (CDOT), based on the federal fiscal year of October I through September 30; and WHEREAS, under the terms of an Intergovernmental Agreement dated May 17, 2001, between the City of Fort Collins and the MPO, entitled Intergovernmental Agreement for the Provision of Support Services, the City provides support services to the MPO, including accounting and financial services, purchasing services, risk management services, budgeting services, human resource services, and legal services, and accordingly, manages federal grant revenue and matching funds received on behalf of the MPO; and WHEREAS, the NFRT&AQPC has been notified that they will receive additional federal funds totaling $164,975, from the Colorado Department of Transportation and $31,000 in the form of State grants, to be applied towards the MPO's 2001-2002 contracts; and WHEREAS, local matching funds, required upon receipt of the federal and state funds, totaling $30,144, have been identified and are available in the form of existing appropriations in the City's Equipment Fund ($18,554), and funds from MPO member entities ($11,590); and WHEREAS, in addition, the VanGo program has received $5,100, representing an insurance recovery settlement for damages to property incurred in providing 2001-2002 fiscal year programming; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in conjunction with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of federal and state grant revenue, unanticipated local matching shares from MPO member entities, a transfer from the City's Equipment Fund, and miscellaneous revenue from the VanGo program will not cause total appropriations to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, in 2001, the City created a new NFRT&AQPC Fund to account for the personnel costs of the MPO director and other key staff members; and WHEREAS, the MPO will continue its search to secure adequate funding in an effort to sustain its operations independent of the assistance provided by the City; and WHEREAS, additionally, funds, totaling $207,625, needed to pay personnel costs of non-City MPO employees were originally appropriated in the Transportation Services. Fund 2002 budget, need to be transferred to the NFRT&AQPC Fund; and WHEREAS, Article V, Section 10, of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the funds are to be expended remains unchanged; and WHEREAS, it is the desire of the Council to appropriate the sum of $207,609 from unanticipated revenue in the Transportation Services Fund, $23,610 from unanticipated revenue in the NFRT&AQPC Fund, and authorize the transfer of $207,625 from the Transportation Services Fund to the NFRT&AQPC Fund, to be used to administer MPO projects for the 2001- 2002 contract period. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Transportation Services Fund, the sum of TWO HUNDRED SEVEN THOUSAND SIX HUNDRED NINE DOLLARS ($207,609), from the following sources: 2001-2002 Federal Fiscal Year Funds Administered by CDOT $ 164,975 2001-2002 State of Colorado Grant Funds 10,890 Local Matching Funds from the City's Equipment Fund 18,554 Local Matching Funds from MPO Member Entities 8,090 VanGo Program Unanticipated Revenues 5,100 Total $ 207,609 to be used to administer MPO projects for the 2001-2002 contract period. Section 2. That there is hereby appropriated for expenditure from unanticipated revenue in the North Front Range Transportation & Air Quality Planning Council Fund the sum of TWENTY-THREE THOUSAND SIX HUNDRED TEN DOLLARS ($23,610), from the following sources: 2001-2002 State of Colorado Grant Funds $ 20,110 Local Matching Funds from MPO Member Entities 3,500 Total $ 23,610 to be used to administer MPO projects for the 2001-2002 contract period. Section 3. That the unexpended appropriated amount, totaling TWO HUNDRED SEVEN THOUSAND SIX HUNDRED TWENTY-FIVE DOLLARS ($207,625) is hereby authorized for transfer from Transportation Services Fund to the North Front Range Transportation & Air Quality Planning Council Fund to be used to administer MPO projects for the 2001-2002 contract period.
