EXECUTIVE SUMMARY This Resolution accepts the donation of two bronze sculptures by artist James Lynxwiler that were created during the 2010 Downtown Development Authority Art in Action Project. These sculptures will become part of the City's Art in Public Places collection. BACKGROUND/ DISCUSSION The Art in Public Places(APP)Guidelines state that all works of art with a value over$10,000 donated to the City of Fort Collins that are to be placed in a public area,must be approved by the APP Board. Once approved,the Board recommends that City Council accept the work of art on behalf of the City. The City is to accept ownership and responsibility for maintenance only of works of art that meet the objectives of the APP program. The work of art must also meet the criteria for works of art and site selection set forth in the APP guidelines. The Art in Action Project is sponsored by the Downtown Development Authority(DDA) in partnership with the City of Fort Collins Art in Public Places Program(APP). This project places a visual artist in Old Town Square to demonstrate the artistic process in a public setting for the community to enjoy. Throughout the summer, artist James Lynxwiler demonstrated the steps for sculpting a life-sized bronze sculpture using the lost wax casting process. This project allowed the public to interact with the artist and witness his working process, creating an ongoing event. The artist is currently completing the plaster model which will be cast into two life-sized bronze sculptures that will be placed in the Old Town area. The proposed location is in the City right—of-way on the northeast corner of Linden and Walnut Streets. The two sculptures will reach towards and face each other to create a gateway for this pedestrian streetscape. The artist was selected using the city's RFQ process through the City's Purchasing Department. Artist James Lynxwiler is a Fort Collins resident with over 10 years experience in creating public art. The City of Fort Collins owns multiple public art pieces created by Mr. Lynxwiler, including work at Stewart Case and Harmony Parks. FINANCIAL/ ECONOMIC IMPACTS This item does not impact the City's general fund account. The artist's onsite sculpting,fabrication and installation costs will be paid for by DDA. The bronze sculptures will be fabricated in Fort Collins. The estimated value of the project is$61,700. As part of the donation,the DDA will agree to be responsible for the maintenance and repair, if necessary and appropriate. ENVIRONMENTAL IMPACTS The artist is working with the City's Forestry Department to not adversely affect the tree roots near the proposed installation location. STAFF RECOMMENDATION Y Staff recommends adoption of the Resolution. November 16, 2010 -2- ITEM 18 BOARD/COMMISSION RECOMMENDATION At its October 20, 2010 meeting, the Art in Public Places Board approved the art and recommended that Council accept these works of art on behalf of the City. For this year' s project , local artist James Lynxwiler was selected to work on Old Town Square , creating a life-sized sculpture of a stylized dancer. ILIV ILA > r � � Art in Public Places Board ATTACHMENT 2 October 20, 2010 minutes (Draft) VII.Art in Action Donation: Ms Martin gave an overview of the Art in Action project.Derf Green of the Downtown Development Authority joined the discussion and also gave the Board an update on the DDA Alley Enhancement project. Mr.York moved to accept the 2010 Art in Action sculpture donation as presented,and move it forward to City Council. Mr.Tollison seconded the motion. Unanimously approved VIII.2011 Work Plan:- Ms Martin distributed the Work Plan for the board's perusal.Absent board members will have it emailed to them.Initial comments from the board are needed before Novernber�10 so recommended changes can be made prior to discussion at the November board meeting.' IX Staff Reports: Ms Martin distributed and read over the staff reports.The board suggested that ihe`projects currently on hold should be highlighted and listed together under a special heading in the Annual Report to City Council. X. Gty Plan: Ms Martin distributed and went over the GtyPlan page that pertains to APP (CPRE).The board discussed and gave their input on the current draft. ' XI. Other business: ; The maintenance and inventory of non-APP art in'the.citywas discussed.Ms Martin explained that APP funds are in place to maintain the APP art collection,but she,has-been consulted on maintenance issues on other city artwork. r XII. Respectfully Sub ed,` x d.4 xk s;s Anne Bossert RESOLUTION 2010-069 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE ACCEPTANCE OF THE PROPOSED DONATION OF THE 2010 DOWNTOWN DEVELOPMENT AUTHORITY ART IN ACTION SCULPTURES WHEREAS, in the summer of 2010, the Downtown Development Authority (DDA), sponsored the Art in Action project(the"Project")in partnership with the City's Art in Public Places (APP)program; and WHEREAS, as part of the Project, the DDA commissioned the artist James Lynxwiler to create two bronze sculptures depicting whimsical dancers(the"Artwork"),while demonstrating the steps for creation of the sculptures to the public in Old Town Square; and WHEREAS, the proposed location for placement of the finished sculptures is in the City right-of-way on the northeast corner of Linden and Walnut streets; and WHEREAS, to accommodate this objective, the DDA wishes to donate the Artwork to the City; and WHEREAS, the value of the Artwork is estimated at $61,700; and WHEREAS, as part of the donation, the DDA will agree to be responsible for the costs of the maintenance and repair of the Artwork if necessary and appropriate; and WHEREAS, Section 23-309 of the City Code requires that works of art with a value of$300 or more donated to the City to be placed in a public area may be accepted only with approval of the Art in Public Places Board(the "APP Board"), and all such works with a value of$10,000 or more may be accepted only with approval of the City Council,upon review of the proposed donation and the recommendation of the APP Board; and WHEREAS, at its regular meeting on October 20, 2010, the APP Board evaluated the proposed donation of the Artwork based on the City's Art in Public Places Guidelines and recommended that the City Council accept the donation. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that the City Council hereby accepts the proposed donation of the bronze sculptures created by artist James Lynxwiler as part of the 2010 Art in Action Project.
