Second Reading of Ordinance No. 110, 2010, Authorizing the Lease of City-Owned Property at 945 East Prospect
Road.
EXECUTIVE SUMMARY
This Ordinance, unanimously adopted on First Reading on November 2, 2010, authorizes the lease of City-owned
property located at 945 East Prospect. Road. The property consists of a 780 square foot two-bedroom house with
a large rear lot. This property has been rented since its purchase in 1991and is currently leased.
STAFF RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.

The City purchased 945 East Prospect in 1991 as part of1the ProspecULema�Choices'95 Intersection Improvement
Project. This project did not materialize and may�not become active.in the future. The property has been rented since
its purchase. It is recommended by sstta�,o continue/renting this house, having the tenant responsible for all
utility/phone/cable expenses and site clean-up. The-propertylis currently leased.
BACKGROUND / DISCUSSION
In 1991, the City purchased 945 East Prospect as part of the Prospect/Lemay Choices '95 Intersection Improvement
Project, which is currently on hold. Should this project become active in the future, this house would be affected by
the right-turn lane that is to be added, turning south on Lemay Avenue from Prospect Road.
The property consists of a two-bedroom house with a large rear-lot and has?been rented since its purchase. The

tenant pays all utilities, phone and any cable charges. The City desires tocontinue leasing the property as it results
in unanticipated revenue, as well as disc, . ourages vam�and-eliminat s ground maintenance costs to the City.

Rent collected from this lease will result in at least $8,400 in unanticipated revenue to Miscellaneous Revenue —
General Fund.

ORDINANCE NO. 110, 2010
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT
945 EAST PROSPECT ROAD
WHEREAS, the City is the owner of the property at 945 East Prospect Road, Fort Collins,
Larimer County, Colorado (the "Property"); and
WHEREAS, the City purchased the Property for road improvements as part of the
Prospect/Lemay Choices `95 Intersection Improvement Project, which is currently on hold; and
WHEREAS, City staff wishes to lease the Property for a period of up to five years at an
annual rate of at least $8,400; and
WHEREAS, the lease of the Property is beneficial to the City in that it will discourage
vandalism and reduce the City's costs to maintain the Property; and
WHEREAS,under Section 23-11 l(a)of the City Code,the City Council is authorized to sell,
convey, or otherwise dispose of any and all interests in real property owned in the name of the City,
provided that the City Council first finds, by ordinance, that such sale or other disposition is in the
best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Council hereby finds that leasing the Property at 945 East
Prospect Road as provided herein is in the best interests of the City.
Section 2. That the City Manager is hereby authorized to execute a negotiated Lease
Agreement for the Property consistent with the terms of this Ordinance, together with such
additional terms and conditions as the City Manager, in consultation with the City Attorney,deems
necessary and appropriate to protect the interests of the City or to effectuate the purposes of this
Ordinance, including, but not limited to, any necessary changes to the description of the Property,
so long as such changes do not materially increase the size or change the character of the property
to be leased.
Introduced, considered favorably on first reading, and ordered published this 2nd day of
November, A.D. 2010, and to be presented for final passage on the 16th day of November, A.D.
