EXECUTIVE SUMMARY This Ordinance, unanimously adopted on First Reading on November 2, 2010, adopts the District-Precinct Map for the 2011 regular municipal election for the purposes of(1)determining the eligibility for District Council offices for the April 2011 election; (2)determining eligibility for any interim appointments to fill any District Council vacancies which may occur after November 26, 2010; and (3) determining residency for voting in any special municipal election conducted after November 26, 2010. STAFF RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. ATTACHMENTS 1. EXECUTIVE SUMMARY �� �� ,T—� VN 1-7 This Ordinance adopts the District-Precinct Map for the 201.1=regular municipal election for the purposes of (1) determining the eligibility for District Council offices for the April 2011 election; (2)determining eligibility for any interim appointments to fill any District Council v ca ancies Which may occur afterlNovember 26, 2010; and (3) determining residency for voting in any special municipal election conducted after November 26, 2010. BACKGROUND / DISCUSSION Council District boundaries are reviewed each fall prior to the regular biennial election, pursuant to Article II, Section 1 of the City Charter, which requires that the City Clerk determine if the number of registered electors in the District containing the lowest number of registered electors is less than 85%of the number of registered electors in the District containing the highest number of registe�edlelectors-re theCity,Clerk musYrecommend to the Council changes to the District boundaries, which mustibe established byN8 din'a ce�at leasl✓l20 days before the election (December 6, 2010). As of September 28,there are 105,86\8\reg�Jisteerred\City vvdters.�District 6 has thehighest number with 20,062 registered electors,while District 2 has the lowest number with 15,835,or 78.9%of the voters in District 6. These figures indicate that an adjustment of District boundaries is needed. Proposed District-Precinct Map While reviewing the current District-Precinct Map and determining what adjustments,if any,should be made to achieve the required balance of voters, staff considered the following: (1) Alignment of City and County precinct,boundaries,as required by-the City Code and necessary ._ . cr in order to use voter regist� ration records; � �'>� \�� (2) Alignment of district boundaries to precinct boundaries; (3) Maintaining College Aven�hie no. rth/south ividing line between the west districts and the east districts; �� I U ' (4) The number of registered voters in each proposed district; and (5) The residence address of each Councilmember, so that no Councilmember is disenfranchised from his or her district. (6) How to achieve the required balance while affecting the least number of voters. In order to adjust the District boundaries to meet the formula described in the Charter,and in an effort to minimize the impact to voters in adjusting the boundaries, staff is recommending the following adjustments: • Move Precinct 78 from District 6 to District 1 (823 voters) . • Move Precinct 79 from District 6 to District 1 (1 voter.) • Move Precinct 13 fromf(Distnct�l to/Distnct�NI2 (1„48 voters) The voters in Precinct 78 and 79 chose a Disttri�t 6 repro enitative in ApnT07. Those voters will now have to wait until April 2013 to choose a District 1 representative U November 2, 2010 -2- ITEM 8 The voters in Precinct 13 chose a District 1 representative in April 2009, and will choose a District 2 representative in April 2011. Copy of the notice published in the Coloradoan ORDINANCE NO. 109, 2010 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING AND DETERMINING THE EFFECTIVE DATE OF THE DISTRICT-PRECINCT MAP FOR THE 2011 REGULAR MUNICIPAL ELECTION WHEREAS, Article II, Section 1 of the City Charter requires that the City be divided into six Council districts, each representing one contiguous, reasonably compact unit; and WHEREAS, no later than 180 days before each regular biennial election, the City Clerk is to determine if the number of registered electors in the district containing the lowest number of registered electors is less than 85%of the number of registered electors in the district containing the highest number and, if so, the City Clerk is to recommend to the City Council district boundary changes, which shall be established by ordinance at least 120 days before the election; and WHEREAS,the City Clerk,in reviewing the composition of the existing districts of the City, has determined that District 2,which has the lowest number of registered electors,has less than 85% of the number of registered electors in District 6, which has the highest number of electors; and WHEREAS, the City Clerk has recommended that Precincts 78 and 79 be moved from District 6 to District 1, and that Precinct 13 be moved from District 1 to District 2; and WHEREAS,by moving the aforementioned precincts,District 4 will have the lowest number of registered electors,and District 6 will have the highest number of registered electors,with District 4 being 89.1% of the number of voters in District 6; and WHEREAS, the City Council wishes to also clarify that the District-Precinct Map adopted for the April 5, 2011 regular municipal election shall also be used to determine eligibility for appointment to fill any vacancy in Council office which may occur following the effective date of this ordinance and prior to the adoption of a District-Precinct Map for the 2013 regular municipal election; and WHEREAS,the City Council wishes to clarify that the District-Precinct Map adopted for the April 5, 2011 regular municipal election shall also be used for determining residency for voter registration purposes for any special municipal election held following the effective date of this ordinance and prior to the adoption of a District-Precinct Map for the 2013 regular municipal election. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the 2011 District-Precinct Map dated November 26, 2010, a copy of which is attached as Exhibit"A"and incorporated herein by this reference, is hereby adopted and.shall be in effect for the following purposes: (1) determining eligibility for District Council offices for the April 5, 2011 regular municipal election; (2) determining eligibility for District Council offices for any interim appointments to fill any District Council vacancies which may occur following the effective date of this ordinance on November 26, 2010, and prior to the adoption of a District-Precinct Map for the 2013 regular municipal election; and (3) determining residency for voting purposes for any special municipal election conducted after November 26, 2010.
