SUBJECT:
Second Reading of Ordinance No. 137, 2002, Appropriating Unanticipated Revenue in the
Capital Projects Fund - Gateway Mountain Park Capital Project and the Conservation Trust Fund
for Transfer to the Capital Projects Fund- Gateway Mountain Park Capital Project to be Used for
Improvements to Gateway Mountain Park.
RECOMMENDATION:
Staff recommends the adoption of Ordinance on Second Reading.
EXECUTIVE SUMMARY:
Gateway Mountain Park is a 377-acre site located five miles up the Cache la Poudre River
Canyon from the intersection of Highways 287 and 14 (Ted's Place). The site is owned by the
City of Fort Collins and was previously the City's Water Filtration Plant. The City Council has
provided direction to make the property accessible to the public as a park. The Park opened in
June this year.
The City received grants of$100,000 from Great Outdoors Colorado Trust Fund ("GOCO"), and
$80,000 from the Colorado Division of Wildlife ("DOW"). Project contingency funds were used
to pay for the development of internal park facilities including such features as picnic areas,
restrooms, interpretive facilities, and other site amenities, to be reimbursed through the GOCO
and DOW grant funds. The City has now received the reimbursement funds from these granting
agencies, and Ordinance No. 137, 2002, which was unanimously adopted on First Reading on
September 17, 2002, appropriates those funds for the project.

FINANCIAL IMPACT:
Adoption of this Ordinance will appropriate anticipated revenue from Great Outdoors Colorado
Trust Fund ($100,000) and the Colorado Division of Wildlife ($80,000), together with

During the process of building the Park access road, difficulties were experienced that resulted in
additional construction costs. As a result, additional funds are required to fully fund all
construction activities for the Park. Staff anticipates that there may be as yet undetermined
follow up work required on some of the Park construction. The City is now in the process of

seeking restitution for some of the unexpected construction costs associated with the Park access
road, although the final amount that might be recovered cannot be predicted. If the City is
successful in recovering some of these costs, the funds recovered will be used first to reimburse
the $100,000 Conservation Trust Fund. Any recovery above $100,000 will be placed in the
Gateway Mountain Park Account for future park improvements.
