Resolution 2010-067 Approving an Amendment to the Collective Bargaining Agreement between the City and the
Fraternal Order of Police Regarding Salary For 2011.
EXECUTIVE SUMMARY
The City and the Northern Colorado Lodge#3, Colorado Fraternal Order of Police ("FOP") entered into a collective
bargaining agreement for 2010 and 2011, which included a provision for the future negotiation of salary levels for
members of the bargaining unit for 2011. City staff and the FOP engaged in negotiations and have tentatively reached
an agreement regarding the'2011 salary levels.
BACKGROUND / DISCUSSION
Passage of Citizen Ordinance No. 001 in August 2004 by City voters modified the City Code to provide for collective
bargaining between the City and members of the Police Services bargaining unit. Members of the bargaining unit
selected the Northern Colorado Lodge#3, Colorado Fraternal Order of Police to serve as their bargaining agent.
Adoption of the Resolution would approve the salary levels for members of the bargaining unit for 2011 and authorize
the City Manager to execute the agreement on behalf of the City.
FINANCIAL / ECONOMIC IMPACTS
No changes were made to the Performance Based Pay Schedule for 2011; it remains the same as for 2010.
STAFF RECOMMENDATION
Staff recommends adoption of the Resolution.
RESOLUTION 2010-067
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING AN AMENDMENT TO THE COLLECTIVE BARGAINING AGREEMENT
BETWEEN THE CITY AND THE FRATERNAL ORDER OF POLICE
REGARDING SALARY FOR 2011
WHEREAS, Chapter 2, Article VII, Division 7 of the City Code contains a comprehensive
scheme for collective bargaining between the City and certain employees of its Police Services; and
WHEREAS, pursuant to those provisions of the City Code, the City and the Northern
Colorado Lodge #3, Colorado Fraternal Order of Police (the "FOP") entered into a collective
bargaining agreement for 2010 and 2011, which agreement included a provision for the future
negotiation of salary levels for members of the bargaining unit for 2011; and
WHEREAS, the City and the FOP have engaged in negotiations regarding the salary levels
for members of the bargaining unit for 2011; and
WHEREAS, City staff and the FOP have tentatively reached an agreement which addresses
the salary levels for members of the bargaining unit for 2011 (the "Proposed Agreement"); and
WHEREAS, the City Manager has recommended City Council approval of the Proposed
Agreement; and
WHEREAS, the City Council, having considered the terms and conditions of the Proposed
Agreement,believes that it would be in the best interests of the City to approve the same.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Council hereby approves the terms and conditions of that certain Amendment
to Collective Bargaining Agreement regarding the salary levels for members of the bargaining unit
for 2011, as shown in Exhibit A, attached hereto and incorporated herein by this reference, and
authorizes the City Manager to execute the Amendment on behalf of the City.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 2nd
day of November A.D. 2010.

EXHIBIT A
AMENDMENT TO COLLECTIVE BARGAINING AGREEMENT
The City of Fort Collins (hereinafter referred to as "City") and the Northern Colorado
Lodge 43, Colorado Fraternal Order of Police (hereinafter referred to as "FOP") hereby agree
that the Collective Bargaining Agreement between City and FOP, January 1, 2010 — December
31, 2011, is amended by the replacement of Article 8: SALARY with ATTACHMENT A
containing the new Article 8: SALARY, with the salary schedule effective for 2011.

Article 8: SALARY
Compensation is dependent on a combination of Skill Level and job performance Rating. A
portion of compensation when advancing to the next Skill Level is provided based upon attaining
the next Skill Level. The remaining portion is based on overall job performance as assessed by
the employee's supervisor and approved by the chain of command. Employees not due for Skill
Level movement will be compensated based upon overall job performance as assessed by the
employee's supervisor and approved by the chain of command.

Increases from one Skill Level to the next in each pay category and any increases on the top Skill
Level of each pay category shall be implemented in accordance with the Performance Based Pay
Plan.
After the completion of the employee's performance review where an overall Rating is received:
if the employee's current pay rate is above the associated Skill and Rating Level, the employee's
pay rate will remain at the current rate of pay ("red circled"), except for a reduction in Skill
Level, and he/she will not be eligible for an increase until such time as the new Skill and Rating
Level is greater than the employee's current rate of pay.
Those who qualify in 2011 for a skill increase to a Skill Level that includes performance Ratings
shall be paid at the Rating 3 pay rate of the applicable Skill Level (example: Police Officer,
Skill Level 4, Rating 3:$64,459). The parties further agree that at any Skill Level that includes
performance Ratings, the pay rates for Rating 4 and Rating 5 shall not be implemented in 2011
and those receiving such performance ratings shall be paid at the Rating 3 pay rate of the
applicable Skill Level.
