First Reading of Ordinance No. 161,2002, Authorizing a Mail Ballot Election for the April 8,2003
Regular Municipal Election.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
One hundred fifty thousand dollars ($150,000) is budgeted for the 2003 regular municipal election.
EXECUTIVE SUMMARY:
This Ordinance authorizes the April 8, 2003 regular municipal election to be conducted by mail
ballot, adopts the Mail Ballot Election Act of the Uniform Election Code governing mail ballot
elections, authorizes the City Clerk to submit a mail ballot plan to the Secretary of State, and
establishes the polling place for in-person voting for the April election.
BACKGROUND:
The City of Fort Collins has used mail ballots since 1995. Voter turnout for each mail ballot election
has exceeded the turnout realized in the City's last polling place election conducted in 1993.
The City will use Larimer County's Accu-Vote 2000 election equipment and will contract with an
election vendor for a variety of services associated with the printing/mailing of TABOR notices and
ballot packages.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CONDUCT OF A MAIL BALLOT ELECTION
FOR THE APRIL 8, 2003 REGULAR MUNICIPAL ELECTION
WHEREAS, a regular municipal election is to be conducted on April 8, 2003, pursuant to
the requirements of the City Charter; and
WHEREAS, Section 31-10-102.7, C.R.S., permits any municipality to utilize the
requirements and procedures of the Uniform Election Code of 1992 with respect to any municipal
election; and
WHEREAS, the City Council wishes to adopt a portion of the Uniform Election Code of
1992 relating to mail ballot elections for the April 8, 2003 regular municipal election; and
WHEREAS, Section 1-7.5-104, C.R.S., provides that the governing board of any political
subdivision may determine that an election shall be by mail ballot; and
WHEREAS, the City Council wishes to give direction concerning the conduct and
implementation of a mail ballot election for the April 8, 2003 regular municipal election.
• NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City of Fort Collins hereby adopts the provisions of the Uniform
Election Code(C.R.S.,Title 1,Article 7.5,also known as the"Mail Ballot Election Act")pertaining
to mail ballot elections for the conduct of the April 8, 2003 regular municipal election, except that,
to the extent that any provisions of the Mail Ballot Election Act pertaining to the preservation of
election records conflict with Title 31, Article 10 of the Colorado Revised Statutes(the"Municipal
Election Code"), the provisions of the Municipal Election Code shall prevail.
Section 2. That the City Clerk is hereby authorized to forthwith submit to the Secretary
of State a proposed plan for conducting the mail ballot election pursuant to the provisions of the Mail
Ballot Election Act and to follow the other procedures in the Act with regard to the conduct of the
election.
Section 3. That registered voters shall have an opportunity to cast ballots in person as
provided by the Mail Ballot Election Act at a polling place located at the City Clerk's Office, City
Hall West, 300 LaPorte Avenue, Fort Collins, Colorado.
Section 4. That the use of an electronic system to record the votes at said election is
hereby authorized.
