RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. EXECUTIVE SUMMARY: In 1997, the voters approved Ordinance No. 29, 1997, which provided funding for the establishment of the Community Horticulture Center (now referred to as the Gardens on Spring Creek), as part of the Building Community Choices capital improvement program. A private 40 501(C)(3) fundraising group, Friends of the Gardens on Spring Creek, was established to assist City staff with membership development and private fundraising. Their efforts were successful in raising $80,000 in private donations, to be used for the design and construction of a 900 square foot Education Room. This room is currently being designed, and will be completed as part of the first phase of construction for the Gardens on Spring Creek, scheduled to open in late fall this year. The Education Room will significantly expand the programming capabilities of the Gardens on Spring Creek, allowing for a broad spectrum of classes, meetings and activities for people of all ages. It will be a very attractive, functional and environmentally-designed room, to complement the rest of the building included as part of the first phase of construction. The $80,000 was raised through 15 donations of $1,000, one $5,000 donation and a very generous donation of $60,000 from Francis Clark, in memory of his wife, Evelyn Clark. The Education Room will be named in Evelyn Clark's honor. ORDINANCE NO. 088, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND BUILDING COMMUNITY CHOICES - COMMUNITY HORTICULTURE CENTER CAPITAL PROJECT TO BE USED FOR DESIGN AND CONSTRUCTION OF THE EDUCATION ROOM WHEREAS, on April 8, 1997, the voters of the City approved Ordinance No. 29, 1997, authorizing the imposition of a quarter cent sales and use tax for the purpose of generating revenues to construct certain capital projects described in the"Building Community Choices"("BCC")capital improvement program; and WHEREAS,one such project approved for funding by the voters was the construction of a community horticulture center(the"Gardens on Spring Creek"); and WHEREAS,a total of$2,608,542 has been appropriated,to date,in the Building Community Choices - Community Horticulture Center capital project; and WHEREAS, a private fundraising group, Friends of the Gardens on Spring Creek, was established to assist City staff with membership development and private fundraising; and . WHEREAS,the aforementioned group has been successful in raising$80,000 in donations, of which $50,000 has been appropriated into the project, by Council, through the adoption of Ordinance No. 169, 2002 on November 29,2002(2003 City Budget),to be used for the design and construction of a 900 square foot education room to be constructed as part of the first phase of construction for the Gardens on Spring Creek; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,City staff has determined that the appropriation of an additional$30,000, from the Friends of the Gardens on Spring Creek, to be added with the previously appropriated funding sources for the Gardens on Spring Creek will not cause the total amount appropriated in the project to exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,it is the desire of the City Council to appropriate the sum of$30,000 in private sector funding,upon receipt from Friends of the Gardens on Spring Creek,to be used with existing private sector appropriations,totaling$50,000,to construct improvements associated with the design and construction of a 900 square foot Education Room at the Gardens on Spring Creek. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from unanticipated revenue in the Capital Projects Fund Building Community Choices-Community Horticulture Center capital project,the sum of THIRTY THOUSAND DOLLARS($30,000),upon receipt,from private sector contributions to be used with existing appropriations to construct improvements associated with the design and construction of a 900 square foot Education Room at the Gardens on Spring Creek. Introduced, considered favorably on first reading, and ordered published this 3rd day of June, A.D. 2003, and to be presented for final passage on the 17th day of June, A.D. 2003.
