RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: Project funds, totaling $4,872,022, have been identified and are available from the following sources: Street Oversizing Fund - Prior Year Reserves (including contributions from the developers of Paragon Point) $ 2,000,000 Street Oversizing Fund - existing appropriations 1,500,596 Conservation Trust Fund - existing appropriations in the ilkFossil Creek Trail project 800,000 uilding Community Choices - existing appropriations in the Fossil Creek Community Park project 351,426 Storm Drainage Fund- existing appropriations in the Developer Repays project 220,000 $ 4,872,022 EXECUTIVE SUMMARY: With the development of the Fossil Creek Community Park, arterial street improvements are planned for Lemay Avenue adjacent to the Park property. The Paragon Point Development south of the Southridge Greens Golf Course previously established a cash escrow for the widening of Lemay Avenue adjacent to their property. These projects have been combined to improve Lemay Avenue to a four lane arterial from the Fossil Creek bridge south to Trilby Road. In conjunction with this project, traffic signals will be installed at Lemay/Trilby, Lemay/Fossil Creek Blvd, and Lemay/Southridge Greens Blvd. In addition, the pedestrian underpass for the Fossil Creek Trail under Lemay Avenue will be constructed with this project. The Stormwater Utility has identified upgrades to the existing drainage crossing at Lemay and Stonegate Drive to be constructed with this project. These improvements will complete the arterial widening of Lemay Avenue to Trilby Road. Except for these Stormwater upgrades and the pedestrian underpass, the project will be funded through developer contributions and the Street Oversizing Program. CKGROUND: Over the past two years, Street Oversizing and Parks staff have completed the design of Lemay Avenue adjacent to the Fossil Creek Community Park site. Lemay Avenue was originally jan DATE: uary ITEM NUMBER: curved at this location to avoid the Portner Reservoir. However, with the elimination of the reservoir, the road will be realigned to reduce the severity of the existing curve. A pedestrian underpass will be installed between the Park site and the Southridge Greens Golf Course for the Fossil Creek Recreation Trail. The Street Oversizing Program has previously collected contributions from the Paragon Point Development to widen Lemay Avenue adjacent to its site. Combining the Park improvements with these development improvements will allow a more efficient construction project, realize cost savings due to economies of scale, reduce the disruption to the traveling public by only having one construction project, and complete a significant section of arterial roadway The improvements will widen Lemay Avenue to a four lane arterial including curbs, gutter, sidewalks, parkways, bike lanes and landscaped medians. Traffic signals will be installed at Lemay/Trilby and Lemay/Fossil Creek Boulevard with this project, and an additional signal at L.emay/Southridge Greens Boulevard will be installed by City Traffic Operations to complete the planned signal system in this area. There will be a realignment of Lemay Avenue between Muirfield Way and Fossil Creek Boulevard to lessen the severity of the curved roadway. The original roadway design was curved to avoid cutting into the dam of the old Portner Reservoir. With the eventual elimination of the reservoir on the park site, there was an opportunity to straighten L-emay Avenue. Parks, Engineering and Golf Course staff worked together to develop options for Lemay that would work with the adjacent uses. Several public meetings and presentations to area HOA's solicited public input. Half of the comments received opted for a straight alignment for safety. The other half opted for a curved alignment to slow traffic down for safety. Staff finally reached consensus with a realignment that lessens the curve to a safer design speed, evening out the curvature to avoid awkward vehicle movements, and regrading to improve sight distances over the top of the hill. This was not the most inexpensive alternative, but increased safety while reducing impacts to the park site and providing a little extra room for the golf course to provide landscape buffers to contain errant golf balls. Included in the project is a pedestrian underpass for Fossil Creek Trail. This trail segment runs through the Park and will cross under Lemay Avenue near the southern boundary of the park. The underpass is 12 feet wide and 9 feet tall, and includes a skylight to increase natural light levels in the daytime as well as traditional electric lights for nighttime use in accordance with the City's new underpass guidelines. Retaining walls for the trail approaches to the underpass were stepped back to provide a more wide open feeling and will have decorative touches such as form liner imprints and portions of colored block wall. Roadway parapet walls will be traditional, with brick inlays matching the existing structures in the area. The installation of the underpass structure requires so much room and such a deep excavation, that a full road closure of Lemay Avenue will be necessary. The Stormwater Utility has looked at the existing drainage culvert on Lemay Avenue at Stonegate Drive, and feels additional improvements are necessary. As a result of the recent changes to the rainfall criteria, additional capacity will be added to the culvert to avoid overtopping the road during a major storm event. These improvements will be funded by Stormwater, through its Capital projects fund. The project is planned to begin construction in the March of 2003. A full road closure of Lemay Avenue for two to three months is expected beginning in April, with construction and landscaping to be completed by September 2003. ORDINANCE NO. 011, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE STREET OVERSIZING FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS TO BE USED TO CONSTRUCT IMPROVEMENTS ON LEMAY AVENUE FROM FOSSIL CREEK TO TRILBY ROAD WHEREAS, with the development of the Fossil Creek Community Park, arterial street improvements are planned for Lemay Avenue adjacent to the park property; and WHEREAS, during the past two years, City staff have been working on the design plans for Lemay Avenue, adjacent to the Fossil Creek Park. The plans will include the realignment and widening of Lemay Avenue to a four-lane arterial including curb, gutter, sidewalks, parkways, bike lanes and landscaped medians; installing traffic signals at the intersections of Lemay Avenue and Trilby Road, Lemay Avenue and Fossil Creek Boulevard, and Lemay Avenue and Southridge Greens Boulevard; construction of a pedestrian underpass for the Fossil Creek Trail, under Lemay Avenue; and storm water upgrades to the existing drainage crossing at Lemay Avenue and Stonegate Drive (collectively, the "Project'); and WHEREAS, combining the aforementioned development improvements with the park improvements increases efficiency, reduces costs, minimizes the disruption to the traveling public, and completes a significant section of arterial roadway; and WHEREAS, the estimated cost of the Project is $4,872,022; and WHEREAS, a funding strategy has been developed, and Project funds, totaling $4,872,022, have been identified and are available from the following sources: Street Oversizing Fund -Prior Year Reserves (including contributions from the developers of Paragon Point) $ 2,000,000 Street Oversizing Fund-existing appropriations 1,500,596 Conservation Trust Fund- existing appropriations in the Fossil Creek Trail project 800,000 Building Community Choices - existing appropriations in the Fossil Creek Community Park project 351,426 Storm Drainage Fund-existing appropriations in the Developer Repays project 220.000 $ 4,872,022 WHEREAS, expenditures relating to the storm water upgrades, totaling$220,000, will be charged against the aforementioned appropriations in the Storm Drainage Fund - Developer Repays project; and WHEREAS, upon completion of the bid process, the Project is expected to begin in March 2003, with final completion and landscaping to be completed by September 2003; and WHEREAS, Article V, Section 9 of the Charter of the City of Fort Collins, (the "Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years, notwithstanding that such reserves were not previously appropriated; and WHEREAS, Article V, Section 10, of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, the purpose for which the previously appropriated funds in the Street Oversizing Fund ($1,500,596), the Conservation Trust Fund - Fossil Creek Trail project ($800,000), and the Building Community Choices - Fossil Creek Community Park project ($351,426), were initially appropriated remains the same, and the City Manager has recommended that said unspent and unencumbered funds be transferred to the Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project and that such funds be earmarked for expenditures associated with the proposed Lemay Avenue Improvements; and WHEREAS, it is the desire of the Council to appropriate $2,000,000 from prior year reserves in the Street Oversizing Fund and authorize the transfer of said amount to the Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project, for appropriation therein, and to authorize the transfer of existing appropriations totaling $1,500,596 in the Street Oversizing Fund, $800,000 in the Conservation Trust Fund - Fossil Creek Trail project, and $351,426 in the Building Community Choices - Fossil Creek Community Park project, to the Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project to be used for expenditures associated with the Lemay Avenue Improvements. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from prior year reserves in the Street Oversizing Fund for transfer to the Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project and appropriated therein the sum of TWO MILLION DOLLARS ($2,000,000) to be used for expenditures associated with the proposed Lemay Avenue, Fossil Creek to Trilby improvements. Section 2. That the unexpended appropriated amount of ONE MILLION FIVE HUNDRED THOUSAND FIVE HUNDRED NINETY-SIX DOLLARS ($1,500,596) is hereby authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project and appropriated therein to be used for expenditures associated with the proposed Lemay Avenue, Fossil Creek to Trilby improvements. Section 3. That the unexpended appropriated amount of EIGHT HUNDRED THOUSAND DOLLARS ($800,000) is hereby authorized for transfer from the Conservation Trust Fund - Fossil Creek Trail project to the Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project and appropriated therein to be used for expenditures associated with the proposed Lemay Avenue, Fossil Creek to Trilby improvements. Section 4. That the unexpended appropriated amount of THREE HUNDRED FIFTY- ONE THOUSAND FOUR HUNDRED TWENTY-SIX DOLLARS ($351,426) is hereby authorized for transfer from the Building Community Choices - Fossil Creek Community Park project to the Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project and appropriated therein to be used for expenditures associated with the proposed Lemay Avenue, Fossil Creek to Trilby improvements.
