RECOMMENDATION: Staff recommends adoption of the Resolution and of the Ordinance on First Reading. FINANCIAL IMPACT: The City of Fort Collins has received additional federal funding from the Colorado Department of Transportation (CDOT) for the Mason Transportation Corridor (MTC) Bicycle/Pedestrian Trail project. This additional funding is $292,000, which is being funded from the Federal Highway Administration (FHWA) Congestion Mitigation & Air Quality (CMAQ) program: Federal funds (82.79%) $234,706 City's Local Match (17.21% Participating) $ 48,789 (100% Non-participating) 8,505 Total project: $292,000 CDOT requires $8,505 to cover its administrative expenses associated with contract management so that leaves$283,495 for project expenses.The contract language is written to reflect the$292,000 for actual project costs; however, the City is still responsible for the full local match of$57,294. MTC Building Community Choices project funds will be used to cover the local match portion of this project. EXECUTIVE SUMMARY: .A. Resolution 2003-004 Authorizing the Mayor to Enter into a Contract with the Colorado Department of Transportation for the Design and Construction of the Mason Transportation Corridor Bicycle/Pedestrian Trail Project, First Phase. DATE: nuary 21, 2003 ITEM NUMBER: B. First Reading of Ordinance No. 009, 2003, Appropriating Unanticipated Revenue in the Building Community Choices Capital Projects Fund,Mason Transportation Corridor Project, to be used for Design and Construction of Improvements to the Mason Transportation Corridor Project South of Harmony Road to the Future Fossil Creek Trail. The City has received a funding letter from Colorado Department of Transportation (CDOT) that will allow work to proceed on the design and initial construction for the bicycle and pedestrian trail for the Mason Transportation Corridor,south of Harmony Road to the future Fossil Creek regional trail. This will be the first design and construction phase for the Mason Corridor's bicycle and pedestrian system. This funding letter is in addition to the$330,000 in Congestion Mitigation&Air Quality(CMAQ)funding that the City received last year from the CDOT,bringing the total CMAQ funding for the MTC project to $622,000. BACKGROUND: Current Project Status The City of Fort Collins is proceeding with implementation of the Council-approved Mason Transportation Corridor (MTC) Master Plan, beginning with the Preliminary Engineering & Environmental Analysis phase (PE/EA)of the project as presented at the Council study session in November. This work effort is being done in accordance with CDOT and the Federal Transit Administration (FTA) project requirements. Over the next year,the agencies will be working on the design for the bicycle/pedestrian trail as well as the Bus Rapid Transit (BRT) system from Cherry Street to south of Harmony Road. Staff will be working closely with the Burlington Northern Santa Fe (BNSF) railroad, Colorado State University, and other property/business owners adjacent to the corridor as design alternatives are developed for the corridor. Staff welcome suggestions and comments from the community throughout this process.There is a public Open House event scheduled for Wednesday,January 21 from 4-7 p.m. at the Lincoln Center. Next Steps The PE/EA phase will be completed by fall 2003. Final design/engineering and right-of-way(ROW) acquisition including an agreement with the BNSF on shared ROW use will begin on the bicycle/pedestrian trail system in late 2003 and carry through 2004. In mid-2004, construction on the bicycle/pedestrian trail will begin south of Harmony Road, with a connection to the future City Fossil Creek Trail, and will continue northward to Prospect Road. The entire MTC bicycle/pedestrian trail system will be completed in 2005-2006. Construction of the BRT system along the MTC will be done in accordance with FTA federal funding levels and schedules. In October 2000, the City Council approved the overall Master Plan for the Mason Transportation Corridor, including the Bus Rapid Transit alternative and the bicycle/pedestrian improvements. The MTC is a 5.5-mile north-south byway within the city of Fort Collins which extends from Cherry Street on the north to approximately 1/2 mile south of Harmony Road. The majority of the length of the MTC is situated within the BNSF ROW and is centered along the railway tracks,located a few hundred feet west of College Avenue (US287). DATE: anuary z I, ITEM NUMBER: The MTC is envisioned as a transportation corridor that will enhance opportunities for pedestrians, bicyclists, and transit riders. It will also encourage infill development and provide economic opportunities. The MTC Project is funded in part by the City's Building Community Choices 1/4 cent sales tax. In addition,the MTC project has received grant funding from CDOT CMAQ funds. The total funds available for this PE/EA work effort as well as final design and construction of the pedestrian/bicycle trail system along the MTC is$7.7 million. The City of Fort Collins is also seeking Federal Transit Administration "New Starts Program" grant funds to cover the costs associated with the Bus Rapid Transit component of the MTC project. al Bike/ des014 Tc - --- -amass s.rb ..nrww . • Ia' Y K' K L' 4a1G: I*- 10 Ice • RESOLUTION 2003-004 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION FOR THE DESIGN AND CONSTRUCTION OF THE MASON TRANSPORTATION CORRIDOR BICYCLE/PEDESTRIAN TRAIL PROJECT, FIRST PHASE WHEREAS, on October 3, 2000, the City Council approved the Mason Transportation Corridor (MTC) Master Plan, including the 'Bus Rapid Transit Alternative" and the bicycle and pedestrian improvements; and WHEREAS, the MTC is 5.5-mile north/south byway within the City which extends from Cherry Street on the north to south of Harmony Road and is centered along the Burlington Northern Santa Fe railroad track; and WHEREAS, the first phase of the MTC bicycle/pedestrian trail project extends from Harmony Road south to the future Fossil Creek Regional Trail; and WHEREAS,pursuant to the Transportation Equity Act of the 21st Century of 1998,certain funds have been allocated for highway projects, under the Congestion Mitigation and Air Quality (CMAQ)program,that have been proposed by the Colorado Department of Transportation(CDOT) and approved by the Federal Highway Administration; and WHEREAS, certain CMAQ Project funds are made available only for eligible "congestion mitigation and air quality improvement" and those activities are defined in §23 U.S.C. 101(a); and WHEREAS, the City has requested of CDOT that the first phase of the MTC bicycle/pedestrian trail project be funded as part of the CMAQ program,as a congestion mitigation and air quality activity; and WHEREAS, federal funds have been made available for the first phase of the MTC bicycle/pedestrian trail project for the design and construction of said bicycle/pedestrian trail; and WHEREAS, by Resolution 2001-109, the City Council authorized the execution of a congestion mitigation and air quality contract with CDOT for the purpose of providing funding for the first phase of the MTC bicycle/pedestrian trail project,the total cost of which project is estimated to be$330,000 to be funded with federal participating funds in the amount of$265,250 and with City participating funds in the amount of$64,750; and WHEREAS, CDOT has presented to the City for execution an additional congestion mitigation and air quality contract for the purpose of providing additional funding for the first phase of the MTC bicycle/pedestrian trail project, the total cost of which project additional funding is • estimated to be $292,000 to be funded with federal participating funds in the Amount of$234,706 and with City participating funds in the amount of$57,294; and WHEREAS, the Council has determined that it is in the best interests of the City that the proposed congestion mitigation and air quality contract as above-described be entered into between the City and CDOT. NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute a congestion mitigation and air quality contract between the City and the Colorado Department of Transportation for the purpose of providing additional funding for the first phase of the MTC bicycle/pedestrian trail project for the design and construction of the Project,with said contract to provide additional federal participating funds in the sum of TWO HUNDRED THIRTY FOUR THOUSAND SEVEN HUNDRED SIX DOLLARS ( $234,706) and City participating funds in the sum of FIFTY SEVEN THOUSAND TWO HUNDRED NINETY FOUR DOLLARS ($57,294)for a total amount of TWO HUNDRED NINETY TWO THOUSAND DOLLARS ($292,000). A.D. 2003. i Mayor ATTEST: City Clerk i f t ORDINANCE NO. 009, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE BUILDING COMMUNITY CHOICES CAPITAL PROJECTS FUND, MASON TRANSPORTATION CORRIDOR PROJECT, TO BE USED FOR DESIGN AND CONSTRUCTION OF IMPROVEMENTS TO THE MASON TRANSPORTATION CORRIDOR PROJECT SOUTH OF HARMONY ROAD TO THE FUTURE FOSSIL CREEK TRAIL WHEREAS, on April 8, 1997, the voters of the City approved Ordinance No. 30, 1997, authorizing the imposition of a quarter cent sales and use tax for the purpose of generating revenues to construct certain transportation projects described in the"Building Community Choices"("BCC') capital improvement program; and WHEREAS, one such project approved for funding by the voters was the Mason Transportation Corridor project, Phases 1 and 2; and WHEREAS,on October 3,2000,City Council adopted Resolution 2000-124,approving the Mason Transportation Corridor Master Plan, including the design, cost and scheduling contained therein, and extending the southern boundary of the Mason Transportation Corridor project from Harmony Road to the Fossil Creek Trail,provided that revenues are available for said extension;and WHEREAS,the Transportation Board,Planning and Zoning Board and Air Quality Advisory Board also recommended adoption of the Master Plan; and WHEREAS, September 18, 2001, City Council adopted Ordinance No. 138, 2001, appropriating $265,250 in Congestion Mitigation & Air Quality funds from the Colorado Department of Transportation(CDOT)and$64,750 in City matching funds to be used for the design and initial construction of improvements to the Mason Transportation Corridor project, from Harmony Road south to the Fossil Creek Trail; and WHEREAS, CDOT has made available to the City of Fort Collins an additional $234,706 in Congestion Mitigation&Air Quality funds to be used for design and construction of bicycle and pedestrian trail improvements, south of Harmony Road to the Fossil Creek Trail, as part of the Mason Transportation Corridor project; and WHEREAS,local matching funds needed,totaling$57,294,have been identified in the form of existing appropriations in the Building Community Choices - Mason Transportation Corridor capital project; and WHEREAS, the City Council adopted Resolution 2003-004, on January 21, 2003, authorizing the City to enter into an intergovernmental agreement with CDOT for the receipt of Congestion Mitigation & Air Quality funds to be used for design and initial construction of improvements to the Mason Transportation Corridor project,from Harmony Road south to the Fossil Creek Trail; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,City staff has determined that the appropriation of Congestion Mitigation&Air Quality funds from CDOT as described herein will not cause the total amount appropriated in the Capital Projects Fund-Mason Transportation Corridor project to exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, it is the desire of the Council to appropriate the sum of$234,706 in CDOT Congestion Mitigation & Air Quality funds, to be used with existing appropriations, totaling $57,294, representing the City's local match to be used for the design and construction of improvements to the Mason Transportation Corridor project,from Harmony Road south to the Fossil Creek Trail. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Building Community Choices Capital Projects Fund- Mason Transportation Corridor project, the sum of TWO HUNDRED THIRTY-FOUR THOUSAND SEVEN HUNDRED SIX DOLLARS ($234,706) from Colorado Department of Transportation Congestion Mitigation & Air Quality funds,to be used for design and construction of improvements to the Mason Transportation Corridor project, from Harmony Road south to the Fossil Creek Trail.
