RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: The City was awarded a$75,000 grant from the National Park Service. This Ordinance appropriates that grant money in the Museum's NAGPRA grant project. EXECUTIVE SUMMARY: On August 1, 2003 the Museum received written notice that it had been awarded a $75,000 NAGPRA Documentation Grant from the National Park Service. This Documentation Grant will enable the Museum to evaluate and determine the cultural affiliation of human remains and cultural artifacts in the Museum's holdings. The overarching goal for this project is to submit three Notices of Inventory Completion to the National Park Service determined through consultation with several Californian and Puebloan tribes,the Hopi tribe,the Navajo Nation,and continued consultations with Plains Indian tribes. The Museum will utilize the grant funds to hire a NAGPRA Coordinator and part time Collections Manager,who will organize and facilitate the consultation with tribes,and to cover travel expenses and consultation fees. The $75,000 will be disbursed on a reimbursement basis over an eighteen-month period. The Museum is requesting that Council appropriate the $75,000 into the Museum's NAGPRA grant project for use over the next two fiscal years, 2003 and 2004. ORDINANCE NO. 121, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE CULTURAL SERVICES AND FACILITIES FUND TO BE USED TO EVALUATE AND DETERMINE THE CULTURAL AFFILIATION OF HUMAN REMAINS AND CULTURAL ARTIFACTS IN THE MUSEUM'S HOLDINGS WHEREAS, in 1990, Congress established the Native American Graves Protection and Repatriation Act(NAGPRA),Public Law 101-601,providing for a process for determining the rights of lineal descendants of Indian tribes,Alaskan Natives,and Native Hawaiian organizations to certain human remains, funerary objects, sacred objects,or objects of cultural patrimony that are currently held in.public museums; and WHEREAS, the Fort Collins Museum has been working towards compliance with the aforementioned law,by completing a physical inventory of its collections, sending out notification letters to tribal communities, and consulting with various plains Indian tribes to evaluate and determine the cultural affiliation of human remains and cultural artifacts in the Museum's holdings; and WHEREAS,the Museum's goal is to receive certification of Inventory Completion from the • National Park Service through consultation with several Californian and Puebloan tribes,the Hopi tribe, the Navajo Nation, and continued consultations with Plains Indians tribes; and WHEREAS,on August 1,2003,the Museum was awarded a NAGPRA grant,in the amount of$75,000 from the Department of Interior, National Park Service; and WHEREAS, during the remainder of 2003 and into 2004, the Museum will use the grant proceeds to hire a NAGPRA Coordinator and part-time Collections Manager, to organize and facilitate the consultation with tribes, and to cover travel expenses and consultation fees; and WHEREAS, no local matching funds are required; and WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,City staff has determined that the appropriation of the federal Native American Graves Protection and Repatriation Act grant as described herein will not cause the total amount appropriated in the Cultural Services and Facilities Fund Museum budget to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and • WHEREAS,it is the desire of the Council to appropriate the sum of$75,000 in National Park Service NAGPRA grant funds in the Cultural Services andFacilities Fund,Museum NAGPRA grant project to be used to evaluate and determine the cultural affiliation of human remains and cultural artifacts in the Museum's holdings. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CYfY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Cultural Services and Facilities Fund the sum of SEVENTY-FIVE THOUSAND DOLLARS ($75,000), upon receipt from the National Park Service, to be used to evaluate and determine the cultural affiliation of human remains and cultural artifacts in the Museum's holdings. Introduced and considered favorably on first reading and ordered published this 2nd day of September, A.D. 2003, and to be presented for final passage on the 16th day of September, A.D. 2003.
