Second Reading of Ordinance No. 115,2003,Amending Section 2-238 of the City Code Pertaining
to the Functions of the Golf Board.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY:
This Ordinance,which was unanimously adopted on First Reading on August 19, 2003,amends the
functions of the Golf Board, as contained in the City Code, to reflect the fact that it is the City
Manager, rather than the City Council, who sets the annual fees and charges at City-owned golf
courses.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 2-238 OF THE CODE OF THE CITY OF FORT COLLINS
PERTAINING TO THE FUNCTIONS OF THE GOLF BOARD
WHEREAS, the City Charter states in Article IV Section 1 that the Council may, by
ordinance, establish appointive boards and commissions and that the ordinance establishing such
boards and commissions shall prescribe the powers, duties and operating procedures of the boards
and commissions; and
WHEREAS, pursuant to the foregoing Charter provision, the City Council has established
a Golf Board and has, in Section 2-238 of the City Code, set forth certain functions of the board
which include advising and making recommendations to the City Council concerning the approval
of annual fees and charges at City-owned golf courses; and
WHEREAS, by the adoption of Ordinance No. 115, 1997, dated August 5, 1997, the City
Council has authorized the City Manager to establish all administrative fees, including those to be
paid by the users of City facilities and this authority has been codified in Section 7.4-1 of the City
Code; and
WHEREAS,the City Council wishes to amend the functions of the Golf Board to reflect the
fact that the Golf Board recommendation regarding golf course fees and charges should be made to
the City Manager, rather than the City Council.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 2-238 of the City Code is hereby amended so as to read in its entirety as
follows:
See. 2-238. Functions.
The board shall act as an advisory board and shall have the following functions:
(1) To advise and make recommendations to the Cultural, Library and
Recreational Services Director(the 'Director") and the City Council as
to rules, regulations, policies, administrative and budgetary matters
pertaining to the operation and maintenance of all city-owned golf
courses;
(2) To advise and make recommendations to the Director concerning the
terms and conditions of any agreements to be entered into with golf
professionals and other concessionaires in connection with city-owned
golf courses as well as any other agreements which may affect the
. management,operation,maintenance,construction or acquisition of city-
owned golf courses;
(3) To assist in the procurement of goods and services for city-owned golf
courses,including the selection of golf professionals,concessionaires and
other contractors, by appointing two(2)Board members to serve on any
review committee that maybe established by the city under the provisions
of § 8-158 of this Code for the purpose of making such procurements;
and
(4) To advise and make recommendations to the City Manager concerning
approval of annual fees and charges at city-owned golf courses.

August, A.D. 2003, and to be presented for final passage on the 2nd day of September, A.D. 2003.

EXECUTIVE SUMMARY:
The purpose of this Ordinance is to amend the functions of the Golf Board,as contained in the City
Code, to reflect the fact that it is the City Manager,rather than the City Council,who sets the annual
fees and charges at City-ownC

One of the functions of the 's to J?ime ations regarding annual fees and
charges at City-owned golf cctio 3Se Code states,that the Golf Board's
recommendation in this regard is to be made to the City Council. However, in 1997, the City
Council amended the City Code to authorize the City Manager to establish these kinds of fees.
Therefore, it is appropriate to amend the functions of the Golf Board so that the Golf Board's
recommendation regarding fees is forwarded to the City Manager rather than the City Council. This
Ordinance would accomplish that change.
