Second Reading of Ordinance No. 106, 2003, Appropriating Unanticipated Revenue in the Cultural
Services and Facilities Fund for the Art in Public Places Reserve Account and Approving
Expenditures from the Art in Public Places Reserve Account to Commission an Artist to Create a
Front Entry Piece for the Lincoln Center.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY:
This Ordinance, which was unanimously adopted on First Reading on August 19, 2003, appropriates
the donation by the Lincoln Center Support League and ArtWear Fund to the Art in Public Places
Reserve Account, and authorize expenditure of the donated funds to commission the creation of the
"Portal" project for the Lincoln Center.
ORDINANCE NO. 106, 2003
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE
CULTURAL SERVICES AND FACILITIES FUND FOR THE
ART IN PUBLIC PLACES RESERVE ACCOUNT AND APPROVING
EXPENDITURES FROM THE ART IN PUBLIC PLACES RESERVE ACCOUNT
TO COMMISSION AN ARTIST TO CREATE A FRONT ENTRY PIECE
FOR THE LINCOLN CENTER
WHEREAS, the City has received a donation from the Lincoln Center Support League and
ArtWear Fund, to the Art in Public Places Reserve Account in the Cultural Services and Facilities
Fund for the Art in Public Places Program; and
WHEREAS, this money was donated with the understanding that it will be used to pay an
artist to create,install and work on a new front entry piece for the Lincoln Center(the"Art Project");
and
WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the donated funds, as
described herein, will not cause the total amount appropriated in the relevant funds to exceed the
current estimate of actual and anticipated revenues to be received in that fund during the fiscal year;
and
WHEREAS,artist Tim Upham was selected through the City's RFP process and worked with
a subcommittee to design the Art Project; and
WHEREAS, the Art in Public Places Board (the "Board") at its July 16, 2003 meeting
reviewed and approved the design for the Art Project entitled "Portal", consisting of a new
sandstone, quartzite and stainless steel paving design, stainless steel trellis and granite bench; and
WHEREAS,the estimated cost to create the Art Project,including commission of the Artist,
purchase of materials, fabrication, installation and contingency for the Project is $31,000; and
WHEREAS, Section 23-308 of the City Code requires that the Board's selection of the
recommended art be presented for Council review and approval,because the cost of the art exceeds
$10,000; and
WHEREAS,it is the desire of the Council to authorize the appropriation of$31,000, from
donations, in the Art in Public Places reserve account in the Cultural Services and Facilities Fund,
to be applied towards payments on the"Portal" project for the front entry piece for the Lincoln
Center.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue
in the Art in Public Places reserve account in the Cultural Services and Facilities Fund, the sum of
THIRTY-ONE THOUSAND DOLLARS($31,000)from donations to be used for payments towards
the front entry project at the Lincoln Center.
Section 2. That the Council hereby authorizes the expenditure of up to THIRTY-ONE
THOUSAND DOLLARS ($31,000) from the Art in Public Places reserve account in the Cultural
Services and Facilities Fund for the Art Project "Portal", consisting of a sandstone, quartzite and
stainless steel paving design,stainless steel trellis and granite bench,proposed by artist Tim Upham,
the design for which was reviewed and approved by the Art in Public Places Board on July 16,2003.
Introduced and considered favorably on first reading and ordered published this 19th day of
August A.D. 2003, and to be presented for final passage on the 2nd dv..of September A.D. 2003.

FINANCIAL IMPACT:
The unanticipated funds of$31,000 will be appropriated to the Art in Public Places Reserve account

EXECUTIVE SUMMARY:
Section 23-303 of the Code, which was added in 1995, established the Art in Public Places Reserve
Account, and designated it for use in ac wiring or leasing works of art, maintenance, repair or
display of works of art, and a "nistrati exp a la a in Public Places Program, in
accordance with the Art in lic Plac Gui i pte Council in 1995. The Council
permanently adopted the Art in blic I s and ree led City Code Chapter 23, Article
IX, with certain modifications in
The Lincoln Center Support League and the ArtWear Fund within the Community Foundation
Serving Northern Colorado are donating$31,000 to the City to be used for an art project to enhance
the main entrance to the Lincoln Center. An artist was selected through the City's usual RFP
process, and a subcommittee comprised of members from the Lincoln Center Support League, staff
and a representative from the ArtWear Fund worked with the artist to develop the overall concept
for the site. At its July 16,2003 meeting, the Art in Public Places Board reviewed and approved the
design.
Fort Collins artist,Tim Upham, will create the piece entitled"Portal". This front entry piece for the
Lincoln Center includes a new sandstone, quartzite, and stainless steel paving design, stainless steel
trellis and granite bench. It will create a new, welcoming artistic element and seating area for the

front entrance of the building and help commemorate the 25th anniversary of the Center. A written
description and drawings of the proposed work of art are attached as Attachment "A". The final
piece may vary from this description. _
This Ordinance would appropriate the donation by the Lincoln Center Support League and ArtWear
Fund to the Art in Public Places Reserve Account, and authorize expenditure of the donated funds to
commission the creation of the "Portal'project for the Lincoln Center.
