EXECUTIVE SUMMARY This Resolution approves expenditures of$39,500 for design,materials,installation and contingency for a project with the artist Andy Dufford of Chevo Studios to create two water quality boxes that will house and protect water quality testing equipment located in the Old Town area. The project also become an educational component for this program. BACKGROUND / DISCUSSION Section 23-303 of the City Code established the Art in Public Places Reserve Account, and designated it for use in acquiring or leasing works of art, maintenance, repair or display of works of art, and administrative expenses related to the Art in Public Places Program, in accordance with the Art in Public Places Guidelines adopted by the Council in Ordinance No. 020, 1995. Council permanently adopted the Art in Public Places Program, and reenacted City Code Chapter 23, Article IX, with certain modifications in 1998. The Art in Public Places(APP) Board reviewed the design for this project at its February 17, 2010 board meeting and moved to select an artist for this project from the APP Design Consultant Resource List. Artist Andy Dufford, from Chevo Studios,was selected to work with the project team. The artist worked with the project team to develop design concepts that would fit into the Old Town location and meet the goals of the project.This design concept was reviewed and recommended by the project team and the APP Board. The artist will design,fabricate,and install two water quality boxes in the Old Town area. The City's Stormwater Utility, in partnership with Colorado State University, is monitoring the effectiveness of a new approach to water quality treatment in downtown Fort Collins, commonly referred to as a Low Impact Development (LID) approach. The on- street parking at Walnut Street and East Mountain Avenue features block porous pavers in place of traditional asphalt. Beneath the street, a gradient medium of crushed stone filters the runoff before it enters the storm sewer system. The artist worked with the design team to develop functional, sculptural boxes to house and protect the equipment needed for testing the water quality of the stormwater runoff. The artist also developed the boxes to serve as an educational component, making visible the filtration process that was occurring below the parking area. Each patterned steel box will graphically represent the flow of water through the medium on its journey of filtration and cleaning. Water quotes will wrap around the lid of the box and a bronze car harking back to Fort Collins history will be mounted on the top of the boxes. FINANCIAL/ ECONOMIC IMPACTS The funds for this item have been appropriated in the Art in Public Places Reserve Account in the Storm Drainage Utility Fund. The Art in Public Places program has a maintenance fund for the long-term care of the APP art collection. The Water Quality Box Project budget is $39,500 to be used for design, materials, installation, and contingency for this project. March 15, 2011 -2- ITEM 19 ENVIRONMENTAL IMPACTS The Water Quality Box Project is a functional and educational component for the innovative water quality testing program being performed by the City's Stormwater Utility. The boxes are functional enclosures that house the equipment needed to extract periodic runoff samples during storm events for the purpose of testing the water quality of the samples. STAFF RECOMMENDATION Staff recommends adoption of the Resolution. BOARD / COMMISSION RECOMMENDATION At its February 17, 2010 meeting, the APP Board voted to recommend these design concepts. Patterned steel graphically represents the flow of water through the medium on its journey of filtration and cleansing , illustrating the parking area ' s filtration process . A hinged lid allows utility personnel access to the monitoring equipment . A quote about the importance of water will wrap the edge of the lid . The two boxes created for this site will have different water quotes . The top surface of the lid will have a bronze antique car securely mounted to a thin veneer of the porous pavers found on site . The dimensions of the boxes are approximately 40 " x 24 " x 3 ' high . Water Quality Boxes (Urban) Design Review: Basil Hamdan of Stormwater Utilities gave an overview of the project.Andy Dufford, the artist on the project, showed images of the site and his concept. The artist proposed two sculptural boxes that will protect the water quality monitoring equipment and illustrate the filtration process occurring below the parking area. There will be one box on the Mountain Ave. side of the building and a second box on the Walnut St. side of the building. The work will be pedestrian friendly with no sharp edges and also as tamper-proof as possible. Final locations and look of the interpretive signage has yet to be decided by the team. Ms Francuz moved to accept the design concept presented for the Water Quality Boxes. Mr.York seconded the motion. RESOLUTION 2011-027 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE STORM DRAINAGE UTILITY FUND TO COMMISSION AN ARTIST TO CREATE WATER QUALITY BOXES WHEREAS, Section 23-303 of the City Code established the Art in Public Places Reserve Accounts in the Light and Power, Water, Wastewater and Storm Drainage Funds for use in the acquisition or leasing of works of art, maintenance, repair or display of works of art, and administrative expenses related to the Art in Public Places Program, in accordance with the Art in Public Places Guidelines adopted by the City Council in Ordinance No.20, 1995(the"Guidelines"); and WHEREAS,as part of the recent construction of the Mitchell Block at Mountain Avenue and Walnut Street, the developer installed a new on-street parking surface consisting of porous block pavers over a gradient medium of crushed stone,which filters runoff before it enters the storm sewer system; and WHEREAS, the Stormwater Utility, in partnership with Colorado State University, is monitoring the effectiveness of this new approach to water quality treatment, and as part of the monitoring process wishes to install in the Old Town area two water quality boxes that will house and protect the equipment needed for testing the water quality of stormwater runoff(the"Project"); and WHEREAS, the Stormwater Utility has completed a number of projects that did not offer appropriate sites for Art in Public Places projects; and WHEREAS, one percent of the funds from such projects has been set aside in the Art in Public Places reserve account in the Storm Drainage Utility Fund, and the Stormwater Utility proposed that a portion of those funds be used for artwork to enhance the Project; and WHEREAS, the Art in Public Places Board (the "Board") selected an artist for the Project from the APP Design Consultant Resource List; and WHEREAS, artist Andrew Dufford(the"Artist")was selected to develop a design concept for the Project that would fit into the Old Town location and meet the goals of the Project while adding educational and artistic components to the Project; and WHEREAS,the Board evaluated the Artist's final design at its regular meeting on February 17, 2010, pursuant to the Guidelines; and , WHEREAS,based on that evaluation, the Board is recommending the Artist's proposal for two patterned steel boxes that will graphically represent the flow of water through the filtration medium, with water-related quotations that will wrap around the lids of the boxes and bronze cars mounted on the tops of the boxes; and WHEREAS,the estimated cost to create the Project,including design,materials,installation and contingency, is $39,500; and WHEREAS, those funds are available in the Art in Public Places reserve account in the Storm Drainage Utility Fund and are appropriated as part of the 2011 budget to be spent on the Project; and WHEREAS, Section 23-308 of the City Code requires that the Board selection of the recommended art be presented for City Council review and approval, because the cost of the art exceeds $10,000; and WHEREAS, Section 23-303 of the City Code states that monies credited to Utility Art in Public Places reserve accounts shall be expended only for the acquisition of works of art that provide a betterment to such utility or that are otherwise determined by the City Council to be for a specific utility purpose that is beneficial to the rate payers of such utility. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the proposed Project provides a betterment to the Stormwater Utility. Section 2. That the City Council hereby authorizes the expenditure of up to THIRTY NINE THOUSAND FIVE HUNDRED DOLLARS($39,500)from the Art in Public Places reserve account in the Storm Drainage Utility,Fund for the Project proposed by Andrew Dufford, the conceptual designs for which were reviewed and approved by the Art in Public Board on February 17, 2010.
