SUBJECT
Second Reading of Ordinance No.085,2007,Appropriating Unanticipated Revenue in the Form of
Developer Contributions in the Transportation Services Fund for the Purpose of Providing
Improvements to the Railroad Crossing on Vine Drive East of Timberline Road.
RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
As a condition of approval of the Water Glen PUD, the developer of the project paid the City
$95,000, which represented the Developer's share of the costs to improve and widen the railroad
crossing on Vine Drive, east of Timberline Road. This Ordinance, unanimously adopted on First
Reading on August 21, 2007, appropriates these funds to pay for the improvements.

FINANCIAL IMPACT
The developer of Waterglen P paid City Effarlithare of costs to improve the Vine
Drive railroad crossing east of in und to be appropriated in order for
the City to pay the Burlington Northern Santa Fe Railway Company(BNSF) and the City Streets
Department for its costs for the crossing improvements.
EXECUTIVE SUMMARY
When the Water Glen PUD was approved, a condition of that approval was for the developer to
improve and widen Vine Drive offsite from its development to Timberline Road. This connection
was required in order for the PUD to comply with the City's Adequate Public Facilities
requirements. The improvement included widening and improving the Burlington Northern Santa
Fe Railway Company(BNSF) railroad crossing. Since the agreements with the BNSF were slow
to happen, the developer deposited funds with the City to pay for its anticipated expense.

ORDINANCE NO. 085, 2007
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE FORM OF DEVELOPER
CONTRIBUTIONS IN THE TRANSPORTATION SERVICES FUND FOR THE PURPOSE
OF PROVIDING IMPROVEMENTS TO THE RAILROAD CROSSING ON VINE DRIVE
EAST OF TIMBERLINE ROAD
WHEREAS,as a condition of approval of the Water Glen PUD,the developer of said project
(the "Developer") paid the City $95,000, which represents the Developer's share of the costs to
improve and widen the railroad crossing on Vine Drive, east of Timberline Road; and
WHEREAS,the aforementioned funds were paid to the City by the Developer in 2003 to be
appropriated and used at such time as improvements to the railroad crossing on Vine Drive were
constructed; and
WHEREAS,as part of improvements funded by the City's Pavement Management Program
this summer,the City did additional paving and shoulder widening work to accommodate pedestrian
and bicycle traffic on Vine Drive east of Timberline Road; and
WHEREAS, in addition to the aforementioned improvements to Vine Drive, the City
contracted with the Burlington Northern Santa Fe Railway Company to improve the railroad
crossing on Vine Drive east of Timberline Road and staff proposes using the$95,000 received from
the Developer for that project; and
WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated
revenues to be received during the fiscal year ; and
WHEREAS,staff has determined that the appropriation of the$95,000 contribution from the
Developer, as described herein, will not cause the total amount appropriated in the Transportation
Services Fund to exceed the current estimate of actual and anticipated revenues to be received
during the fiscal year.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Transportation Services Fund, the sum of NINETY-FIVE THOUSAND DOLLARS ($95,000),
representing a contribution from the Developer of the Water Glen PUD to be used to improve the
railroad crossing on Vine Drive east of Timberline Road.
Introduced, considered favorably on first reading, and ordered published this 21st day of
August, A.D. 2007, and to be presented for final passage on th ay of eptember, A.D. 2007.
