2. Neighborhood Quality Items
A. Proposed Revisions to City Code Chanter 5 Article II Division 3 Dangerous
Buildings. (30 minute discussion)
As the first of four of the Neighborhood Quality items to be discussed, this item
reviews the proposed revised,"Dangerous Buildings"provisions currently in the City
Code, renamed, Unsafe, Dangerous or Nuisance Buildings, Structures, Equipment
and Premises. Its purpose is to assure that the City has the tools necessary to
identify, correct and/or abate all buildings, structures, equipment or premises that
either through neglect or mishap have become a danger or nuisance to the public as
the suggested new inclusive title implies. Staff will provide Council with options
and recommendations for adoption of an ordinance.
1. Does Council concur with the proposed revisions to the Code?
2. Does Council wish to consider additional changes?
3. Does Council concur with bringing forward the proposed Unsafe,Dangerous
or Nuisance Buildings, Structures, Equipment and Premises ordinance for
Council consideration on December 4, 2007 or on a different time frame?
Options
Option 1 —No changes to current Code.

• Option 2 — Direct staff to complete development of Code revisions as
recommended to bring forward as an ordinance for adoption on December 4,
2007 or other time frame.
• Option 3 - Direct staff to develop code revisions other than those
recommended to bring forward as an ordinance for adoption on December 4,
2007 or other time frame.
B. Exterior Progertv Maintenance Code(XPMC). (40 minute discussion)
As the second of four of the Neighborhood Quality items to be discussed, this item
focuses on exterior property maintenance — separate from and not included in the
Dangerous Building Code and Rental Habitability Standards. The intent is to update
City Council on the responses to the public outreach staff has performed since the
last work session on September 12, 2006, providing examples of what other
communities are doing, and providing some data showing approximately how many
violations currently exist and where they exist. In addition,staff will provide Council
with optional recommendations both from staff and from a small stakeholder group.
Staff seeks direction and answers from Council in response to the following
questions:
1. Does Council wish to move forward with any of the optional
recommendations and have Exterior Property Maintenance Codes drafted in
regards to:
a. Dirt yards
b. Dilapidated fences
C. Extensive chipping or peeling paint
d. Deteriorated roofing and/or gutters
2. Which option provided does Council wish to move forward with(Option 1,
2A, 213, or 3)?
3. Does Council agree with the proposed time line to do so?
Options
• Option 1 —No changes to current code.
• Option 2—Draft exterior property maintenance codes for violations that can
only be seen from the street.

A. Staff recommends that single violations be addressed as well as
multiple violations when visible from the street.
Staff recommends this option as the best place to begin addressing these
issues as a first step.
B. The small task group of stakeholders would like to include an
escalating matrix which will take the entire property into
consideration and only multiple violations or very egregious single
violations would be addressed.
• Option 3 —Draft exterior property maintenance codes for violations that can
be seen from any public right-of-way(street and/or alley)or ground level of
neighboring properties. Single violations would be addressed as well as
multiple violations.
C. Proposed Revisions to Cily Code Article VI Division 2 Rental Housing Standards.
(35 minute discussion)
As the third of four of the Neighborhood Quality items to be discussed,the proposed
revised Rental Housing Standards are intended to update the City's current Rental
Housing Standards by incorporating minimum habitability codes which have been
incorporated as minimum requirements for dwellings constructed over the past 50
years. The proposed Standards would be applicable to all rental housing,including:
dwellings,hotels and rooming houses.
1. Does Council concur with the proposed revisions to the Code?
2. Does Council wish to consider additional changes?
3. Does Council concur with bringing forward the proposed Rental Housing
Standards forward for adoption on December 4, 2007 or on a different time
frame?
Options
• Option 1 —No changes to current Code.
• Option 2 — Direct staff to complete development of recommended Code
revisions to bring forward as an ordinance for adoption on December 4,2007
or other time frame.
• Option 3 — Direct staff to develop Code revisions other than those
recommended to bring forward as an ordinance for adoption on December 4,
2007 or other time frame.

D. Review and Update of the Over-Occupancy Investigation/Enforcement Program.
(15 minute discussion)
The City's Land Use Code(LUC) Section 3.8.16 sets occupancy limits allowed for
single dwelling units to a family plus one additional person, or two adults and their
dependants plus one additional person. Established occupancy limits are intended to
help maintain the quality of life in Fort Collins single-family neighborhoods by
reducing over-crowding and parking concerns which can lead to neighborhood
disturbances and devaluation of property values.
As the last of the four Neighborhood Quality Items to be discussed,staff is presenting
an update of the Over-Occupancy Investigation/Enforcement Program in effect since
January 1, 2007.
1. Does the Over-Occupancy Investigation/Enforcement Program as presented,
conform to Council's intent and direction?
2. Does Council have suggestions for changes/improvement to the current
process?
3. Police Service Staffing Study report provided by Police Executive Research Forum.
(2 hour discussion)
This discussion is to answer the following questions:
1. What are Council's initial reactions to report and presentation?
2. Does Council concur with findings of study?
3. What are Council's priorities regarding staffing needs?
4. How would Council like to proceed with the study results? What are the
expectations and desired time frame regarding implementation?
