SUBJECT
Resolution 2007-046 Approving the Refurbishment of Equipment for Traffic Operations as an
Exception to the Competitive Procurement Process.
RECOMMENDATION
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT
Funds for lease-purchase payments are budgeted for the balance of 2007 and will be budgeted in
subsequent years, as needed.
EXECUTIVE SUMMARY
This Resolution will authorize the purchase of materials, equipment and services needed to repair
and refurbish the TMT paint striper as an exemption to the use of competitive bid or proposal as
provided in Section 8-161(d).
BACKGROUND
Traffic has a 1992 TMT paint striper mounted on a Ford CF8000 chassis. The chassis has about
60,000 miles on it and is in good repair. The paint striper is largely worn out. It needs new or
refurbished components, including the paint carriages, bead tank, hoses, hydraulic paint pump
drivers, air compressor, and computer control system.
A company called EZ-Liner, located in Orange City, Iowa has offered to completely refurbish the
paint striper for$126,372. Other striper companies staff contacted were either too busy to undertake
a major rebuild like this or they did not do that kind of work.
Currently,new paint stripers run about$240,000. Since the truck chassis it is mounted on will likely
last another 10 - 15 years, it is in the best interests of the City to have the old striper refurbished.
EZ-Liner will install new paint carriages with new paint and bead guns. Old steering sectors and
wheels will be replaced with joystick controls, new operator seats will be installed, low pressure

pumps will be replaced, along with paint hoses, hydraulic hoses and low pressure plumbing. A
Skipline paint and bead data acquisition system will be installed, with laptop monitor. Hydraulic
pumps will be rebuilt and the deck under the bead tank will be reinforced. Paint tanks will be
removed and replaced with a two-color tote draw system. Night lighting will be added and a video
guidance system installed. Various electrical components will be modified and updated.
Section 8-161 of the Code allows Council to authorize exemptions to the use of competitive bidding
if the Purchasing Agent and City Manager agree that the request fits one of a limited number of
exemptions, including a single responsible source.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE REFURBISHMENT OF EQUIPMENT FOR TRAFFIC
OPERATIONS AS AN EXEMPTION TO THE COMPETITIVE PROCUREMENT PROCESS
WHEREAS,Section 8-161(d)ofthe Code ofthe City ofFort Collins authorizes the awarding
of a contract without competition if the Purchase Agent determines, with the approval of the City
Manager, that only one responsible source exists; and
WHEREAS, the City's Traffic Operations department presently uses a 1992 TMT paint
striper which needs to be replaced or refurbished; and
WHEREAS, City staff has searched for companies to refurbish the striper and only one
company has the available time and necessary expertise; and
WHEREAS, the cost of refurbishing of the striper, in the amount of$126,372, is roughly
half the cost of purchasing a new one; and
WHEREAS,the Purchasing Agent has submitted the required written justification to the City
Manager for approval; and
WHEREAS,the City Manager has reviewed and approved an exemption to the competitive
process for this procurement; and
WHEREAS,funds to pay the cost of refurbishing via lease-purchase have been budgeted and
approved in the budget for 2007; and
WHEREAS, Section 8-161(d)(3) requires approval of this purchasing method by the City
Council for items costing more than One Hundred Thousand Dollars($100,000)prior to acquisition.

COLLINS that the refurbishing of Traffic's TMT paint striper, as an exemption to the City's
competitive Purchasing requirements, is hereby approved.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 15th
day of May, A.D. 2007.
