RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. EXECUTIVE SUMMARY The Rigden Farm development site is located south of Drake Road, east of Timberline Road and west of Ziegler Road. As a part of Rigden Farm, Filing One, it was anticipated that an unnamed street would extend westerly beyond Kansas Drive between Custer Drive and Limon Drive. The street stub for this anticipated street was dedicated with Rigden Farm, Filing One. Rigden Farm, Twelfth Filing Brooklyn Park Row Houses for which an Administrative Hearing was held on February 12, 2007 shows that the street stub is no longer needed and will be removed. Therefore, the right-of-way for the street stub is no longer necessary and is proposed for vacation at this time. All public and private utilities have been notified of the proposed vacation and no objections were reported. ATTACHMENTS 1. Location Map. ATTACHMENT Right-of-Way Vacation Right-of-Way Vacation Drake Rd v j i g OIi Ii Q I 3 CUSTER DR 8 D r Rigden Farm Filing I Vicinity Map April 30, 2007 ORDINANCE NO. 071, 2007 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF RIGHT-OF-WAY AS DEDICATED ON THE PLAT OF RIGDEN FARM, FILING ONE WHEREAS, on the plat of Rigden Farm, Filing One, certain rights-of-way are dedicated to the public, including rights-of-way for future street extensions; and WHEREAS, the City's Administrative Hearing Officer has approved a project development plan for a project entitled "Rigden Farm, Twelfth Filing Brooklyn Park Row Houses" (the `Brooklyn Park Row Houses PDP"), which plats certain property abutting said rights-of-way; and WHEREAS, the approval of the Brooklyn Park Row Houses PDP necessitates the vacation of a portion of the original right-of-way dedicated on the plat of Rigden Farm, Filing One, since that portion of right-of-way was intended to accommodate a future street extension that is no longer needed under the Brooklyn Park Row Houses PDP; and WHEREAS, pertinent City agencies and private utility companies have been contacted and reported no objection to the proposed vacation, provided that utility easement be reserved unto the City; and WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said street right-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the portion of street right-of-way, more particularly described on Exhibit "A", attached hereto and incorporated herein by this reference, is hereby vacated, abated and abolished.
