SUBJECT
Second Reading of Ordinance No.039,2007,Appropriating Unanticipated Grant Revenue and Prior
Year Reserves in the General Fund for the Restorative Justice Program.
RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
The Restorative Justice Program (the "Program") is an alternative method of holding a young
offender accountable by facilitating a meeting with the young offender,the victim and members of
the community to determine the harm done by the crime,and what should be done to repair the harm.
This Ordinance,unanimously adopted on First Reading on March 6,2007, appropriates funds from
two grants that have been received for the purpose of continuing this program.

First Reading of Ordinance No. 039, 2007, Appropriating Unanticipated Grant Revenue and Prior
Year Reserves in the General Fund for the Restorative Justice Program.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
The City has received the fol ing gr s for i ,tices:
1. A grant in the amount o 5,000 om The Bohemian oundation, Pharos Fund, for the
continuation of The Restorative Justice Program. No cash match is required.
2. A grant in the amount of$19,404 from the Colorado Division of Criminal Justice,Juvenile
Accountability Block Grant,for the continuation of The Restorative Justice Program.A cash
match of$2,156 is required and will be met by appropriating previous project income(client
fees) in the Restorative Justice revenue account.

BACKGROUND
Bohemian Foundation, Pharos Fund Grant
A grant in the amount of$25,000 has been received from the Bohemian Foundation for salaries and
training associated with the continued operation of the Program. The Program is an alternative

method to the criminal justice system that seeks to hold a young offender accountable by facilitating
a meeting with the young offender, the victim and members of the community. The parties discuss
the harm done by the crime and what should be done to repair the harm. The objective is to address
the needs of the victim and it tYbemle
to help the young offender
understand how his/her actio affect o rs an ntable for the harm caused by

will be addressed and the offe will co ged to a productive member of the
community.
The grant period is from December 1, 2006 to November 31, 2007.
Colorado Division of Criminal Justice,Juvenile Accountability Block Grant
The Colorado Division of Criminal Justice awarded a $19,404 grant for salaries and training
associated with the continued operation of the Program. A $2,156 cash match is required and will
be met by appropriating previously collected project income from user client fees of the Program.
The grant period is from February 1, 2007 to January 31, 2008.
ORDINANCE NO. 039, 2007
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED GRANT REVENUE AND PRIOR
YEAR RESERVES IN THE GENERAL FUND FOR THE RESTORATIVE
JUSTICE PROGRAM
WHEREAS,the Colorado Division of Criminal Justice has awarded the City of Fort Collins
Police Services("Police Services")a grant in the amount of$19,404(the"DCJ Grant") for salaries
and training associated with the continued operation of the Restorative Justice Program, which
includes Restorative Justice Youth Conferencing and RESTORE; and
WHEREAS, the Bohemian Foundation has also awarded Police Services a grant in the
amount of$25,000(the "Bohemian Grant") for salaries associated with the continued operation of
the Restorative Justice Program; and
WHEREAS, the Restorative Justice Program is an alternative method to the traditional
criminal justice system that holds youth offenders accountable for their actions by facilitating a
conference with the offender, the victim, and community members to identify the harm caused by
the incident and to find meaningful ways for the offender to repair that harm; and
WHEREAS, the DCJ Grant requires $2,156 of City matching funds, which is available
through appropriating previous project income (client fees) from the Restorative Justice Youth
Conferencing Program; and
WHEREAS, Article V, Section 9,of the Charter of the City of Fort Collins (the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the CDJ Grant and the
Bohemian Grant funds as described herein will not cause the total amount appropriated in the
General Fund to exceed the current estimate of actual and anticipated revenues to be received in that
fund during the fiscal year; and
WHEREAS, Article V, Section 9, of the Charter permits the City Council to appropriate by
ordinance at any time during the fiscal year such funds for expenditure as may be available from
reserves accumulated in prior years, notwithstanding that such reserves were not previously
appropriated.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from unanticipated revenue in the General
Fund the sum of TWENTY FIVE THOUSAND DOLLARS ($25,000) from the Bohemian
Foundation for expenditure in the General Fund to continue of the Restorative Justice Program.
Section 2. That there is hereby appropriated from unanticipated revenue in the General
Fund the sum of NINETEEN THOUSAND FOUR HUNDRED FOUR DOLLARS ($19,404) from
the Colorado Division of Criminal Justice for expenditure in the General Fund to continue the
Restorative Justice Program.
Section 3. That there is hereby appropriated for expenditure from prior year reserves in
the General Fund the amount of TWO THOUSAND ONE HUNDRED FIFTY-SIX DOLLARS
($2,156) for the Restorative Justice Youth Conferencing Program.
Introduced, considered favorably on first reading, and ordered published this 6th day of
March, A.D. 2007, and to be presented for final passage on the h day of March, A.D. 2007.
