SUBJECT
Resolution 2007-079 Approving Expenditures from the Art in Public Places Reserve Account in the
Cultural Services and Facilities Fund to Commission an Artist to Create an Art Element for the
Spring Canyon Community Park Tree Project.
RECOMMENDATION
Staff and the APP Board recommend adoption of the Resolution.
FINANCIAL IMPACT
The funds for this item have been appropriated in the Art in Public Places Reserve Account in the
Cultural Services and Facilities Fund. The Art in Public Places program has a maintenance fund for
the long-term care of the APP art collection.
The Spring Canyon Community Park Tree Project art budget is $15,000 to be used for design,
fabrication, travel, signage and contingency for this project.
EXECUTIVE SUMMARY
This Resolution would approve expenditures of$15,000 for design, fabrication, travel, signage and
contingency for a project with the artist Kenny Davis to carve three existing trees for the Spring Canyon
Community Park Tree Project.
BACKGROUND
Section 23-303 ofthe City Code,which was added in 1995,established the Art in Public Places Reserve
Account, and designated it for use in acquiring or leasing works of art,maintenance,repair or display
of works of art,and administrative expenses related to the Art in Public Places Program,in accordance
with the Art in Public Places Guidelines. The Council permanently adopted the Art in Public Places
Program, and reenacted City Code Chapter 23,Article IX, with certain modifications in 1998.
The Art in Public Places Board moved to select an artist for this project using an RFP process through
the City's Purchasing Department. The artist Kenny Davis was selected to work with the proj ect team.
The artist worked with the project team to develop design concepts appropriate to the site.This design

concept was reviewed and recommended by the project team and the APP Board. The APP Board
reviewed the design for this project at the Board's regular meeting on August 15, 2007.
The artist will design and carve three existing cottonwood trees on the site of Spring Canyon
Community Park. This sculptural piece will have an organic reference to the trees and its location in
a natural setting. Kenny Davis will work with the three trees to convey one story concept. One tree will
have a mountain lion perched on top and the second will feature her kittens near by. The third will
represent a sculptural carved tree form.The artist will carve on site and work with the subtle qualities
of each tree.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES
RESERVE ACCOUNT IN THE CULTURAL SERVICES AND FACILITIES FUND
TO COMMISSION AN ARTIST TO CREATE AN ART ELEMENT FOR THE
SPRING CANYON COMMUNITY PARK TREE PROJECT
WHEREAS, the City is currently working on construction of the new Spring Canyon
Community Park (the"Project"); and
WHEREAS, pursuant to Sections 23-303 and 23-304 of the City Code, one percent of the
funds appropriated for the Project was set aside in the Art in Public Places reserve account in the
Cultural Services and Facilities Fund for use in the acquisition or leasing of works of art, the
maintenance, repair or display of works of art, and administrative expenses related to the Art in
Public Places Program, in accordance with the Art in Public Places Guidelines adopted by Council
in Ordinance No. 047, 1998 (the"Guidelines"); and
WHEREAS, the Art in Public Places Board (the "Board"), selected an artist to design
artwork for the Project using an RFP process through the City's Purchasing Department; and
WHEREAS,Kenny Davis(the"Artist")was selected to work with the Project Team to create
a design concept appropriate to the Project site; and
WHEREAS, the Board evaluated the Artist's final design at its regular meeting on August
15, 2007, pursuant to the Guidelines; and
WHEREAS,based on that evaluation,the Board voted to recommend the Artist's proposal
for a sculptural piece created by the carving of three existing cottonwood trees at the Project site(the
"Art Project"); and
WHEREAS, the Art Project will convey one story concept, with one tree depicting a
mountain lion, a second featuring her kittens, and the third representing a sculptural carved tree
form; and
WHEREAS, the estimated cost to create the Art Project, including design, materials,
fabrication, installation and contingency for the Art Project, is $15,000; and
WHEREAS, those funds are available in the Art in Public Places reserve account in the
Cultural Services and Facilities Fund,and are appropriated as part of the 2007 budget,to provide for
the Artist's design fees, fabrication, travel, signage and contingency for the Art Project; and
WHEREAS, Section 23-308 of the City Code requires that the Board's selection of the
recommended art be presented for Council review and approval,because the cost of the art exceeds
$10,000.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Council hereby authorizes the expenditure of up to FIFTEEN THOUSAND
DOLLARS ($15,000) from the Art in Public Places reserve account in the Cultural Services and
Facilities Fund for the Art Project,which will consist of three sculptural pieces carved from existing
cottonwood trees at Spring Canyon Community Park, as proposed by the artist, Kenny Davis, and
the conceptual design of which was reviewed and approved by the Art in Public Places Board on
August 15, 2007.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 4th
day of September, A.D. 2007.
