SUBJECT
Second Reading of Ordinance No. 100, 2007, Authorizing the Purchasing Agent to Enter into an
Extension of the Restaurant/Snack Bar Concession Agreement at Collindale Golf Course for up to
Five Additional Years.
RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
The existing Agreement with the Collindale Golf Course food and beverage concessionaire,Brauns
Bar & Grill at Collindale, LLC, dba Manno's Grille at Collindale, owned and operated by Fort
Collins residents Scott and Karrie Manning, expires on December 31, 2007. This Ordinance,
unanimously adopted on First Reading on September 4,2007,extends the Agreement for up to five
additional one-year renewable periods through December 31,2012,as per the terms and conditions
of the original Agreement with a few modifications as required by the City.

Extension of the Restaurant/Snack Bar Concession Agreement at Collindale Golf Course for up to
Five Additional Years.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
At its July 18, 2007 meeting, the Golf Board voted unanimously to extend the term of the
Agreement an additional five years.

There are no direct City expenditures to the Concessionaire. However, under the terms of the
existing five-year Agreement, in 2007 the City Golf Fund will be paid a Concession Fee from the
Concessionaire of 10 percent of Net Sales (defined as Gross Sales minus Sales Taxes and Voids)
less $14,000 for specified Clubhouse Janitorial Services. It is estimated that in 2007 the City will
receive a Concession Fee payment of between$65,000 to$80,000 in cash and/or In-Kind Payments
as the Net Sales for 2007 are estimated at this time to be well over$800,000. This Concession Fee
payment represents nearly three percent of the total Operating Revenues to the Golf Fund in 2007.

Agreement was entered into on u 1 0 ,a being a ded through Request For Proposal
(RFP)#P-869. As per RFP Specification No. 1, .....The duration of the Agreement...(runs through
2007) with possible extensions of the original five-year term for up to five additional years if
performance is satisfactory and subject to City Council approval...... This is contingent on public
input and comment, the Golf Board recommendation, and the ability of the City and the
Concessionaire to negotiate a mutually acceptable extension agreement.

BACKGROUND
Manno's Grille at Collindale is a -servic it to an nack bar that includes a liquor
bar. Manno's also provides foo d b v age s t o nds of the golf course with carts.
Staff has been very pleased wi the pe an o t an ar .e Manning and Manno's Grille
at Collindale, especially since 4 the o t out th original partners in Brauns Bar&
Grill at Collindale, LLC, and began operating the concession themselves. They have done many
things to make the Agreement successful and have provided good food, beverages, and service to
the golfers and general public. They were able to bring stability and consistency to the food and
beverage operation at Collindale that had been somewhat missing under the previous management
structure of Brauns. During the Mannings' tenure, almost every aspect of the concession services
has improved and they continue to express a desire for further improvements over the next five
years,if the Agreement is extended. Manno's has recently received some significant accolades from
both Lydia's Style Magazine and from the Coloradoan Newspaper Ticket restaurant review that
validated their actions.
The Golf Board met with Scott Manning at its meeting of June 20, 2007 in a "round table-type
setting" to discuss the issues with him. The Board held a Public Input/Comment Meeting on July
18, 2007 at the Collindale Clubhouse where more than 40 people attended. Staff also received a

after further discussion,voted imoumen tending the term of the agreement
with the Collindale Restaurant nc ) for e five additional years. However,
it should be noted that some members of the Collindale Women's Golf Association (CWGA)
provided input/comments negative to Manno's regarding what they consider as lesser quality service
to their group,and they believe that Manno's needs to serve the golfers better. Therefore,in addition
to its recommendation for the extension, the Board also stipulated that staff and Manno's continue
to work to improve service to golfers and improve relationships with the CWGA. Staff, Scott
Manning, and the officers of the CWGA have been meeting since then and staff believes that their
specific concerns have been solved, including banquet room usage and the provision of food
services, et. al.
Staff has negotiated a mutually acceptable extension of the Agreement for up to five additional
one-year renewable periods through December 31, 2012, as per the terms and conditions of the
original Agreement with a few modifications as required by the City.

ORDINANCE NO. 100, 2007
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE PURCHASING AGENT TO ENTER
INTO AN EXTENSION OF THE RESTAURANT/SNACK BAR
CONCESSION AGREEMENT AT COLLINDALE GOLF COURSE
FOR UP TO FIVE ADDITIONAL YEARS
WHEREAS, Section 8-186(a) of the City Code requires that any contract for services with
a potential total term over five years in length be authorized by Council by ordinance; and
WHEREAS, the Purchasing Agent has determined that Brauns Bar & Grill at Collindale,
LLC, dba Marino's Grille at Collindale, the current contractor providing restaurant/snack bar
concession services at Collindale Golf Course, has performed those services well and to the
satisfaction of the City and the general public over the course of the existing Restaurant/Snack Bar
Concession Agreement (the "Agreement"); and
WHEREAS, the Purchasing Agent has further determined that in order to continue with the
delivery of high quality food and beverage concession services to the public at Collindale Golf
Course, the extension of the Agreement for up to an additional five one-year terms, without a new
competitive process for such services, is advisable and would maintain continuity and provide
concessionaire stability in the delivery of those services; and
WHEREAS, the original 2003 competitive process for the restaurant/snack bar concession
services at Collindale Golf Course and the Agreement contemplated possible extension of the
Agreement beyond the original one year plus four one-year renewals, based on the expectation that
a longer term arrangement for those services would enable proposers to offer more desirable services
to the City at a more advantageous quality and rate than without such a longer term potential; and
WHEREAS,the Golf Board reviewed the proposed extension described herein at its regular
meetings on June 20, 2007, and July 18, 2007, and after receiving positive public input/comments,
unanimously agreed to encourage the City Council to authorize such an extension.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Council hereby authorizes,pursuant to City Code Section 8-186(a),the extension
of the Agreement between the City and Brauns Bar&Grill at Collindale, LLC,dba Manno's Grille
at Collindale, for Restaurant/Snack Bar Concession Services at Collindale Golf Course, dated
January 17, 2003, along with the First Addendum dated May 26, 2004 and the Second Addendum
dated August 27, 2004, for the year 2008, with annual renewal options for the years 2009 through
2012, or a potential total term of ten(10) years.
Introduced, considered favorably on first reading, and ordered published this 4th day of
September, A.D. 2007, and to be presented for final passage on the 18th day of September, A.D.
