RECOMMENDATION Staff recommends adoption of the Resolution. FINANCIAL IMPACT The Revocable Permit to attach Front Range Internet, Inc. ("FRIP') equipment to City of Fort Collins street light poles comprises negotiated exchange of services-in-kind between FRII and the City of Fort Collins. The agreement allows the City of Fort Collins access to a wireless network that has the potential to yield cost savings in operations that make use of broadband data communications. EXECUTIVE SUMMARY FRII has requested a revocable permit to attach communications equipment on City-owned street light poles and other public property. BACKGROUND FRII owns and operates the radio devices that are used to implement the wireless network. In exchange for access to the network, the City of Fort Collins will agree to allow FRII to locate the radio equipment on street light poles and will install the devices on the street light poles. The city will waive the following fees and charges associated with the Old Town wireless network: • Pole attachment fees that would normally be charged to entities that attach equipment to the street light poles. • Energy revenues that would normally be collected in exchange for the electricity supplied to the devices. • Labor and equipment charges normally collected to recoup the cost of installation. October 2, 2007 -2- Item No. 16 Through the partnership between the City and FRII, the City expects to explore the economics of installing and operating a wireless network. This small-scale installation will allow the City to learn about the rate-of-return associated with the public-private business model, as well as offer the opportunity to further explore cost savings associated with electric and water revenue meter communications, distribution load monitoring, Tl communication line replacement, and other savings that can be realized through the use of a ubiquitous communications infrastructure. In addition to the economic aspects being studied,many public safety applications can also be explored during the course of the wireless network pilot project. The wireless data network in the Old Town area currently comprises 19 radio devices mounted on 17 streetlight poles, and 2 buildings owned by the City. It is possible that the network will require as many as 25 devices within the area defined in the agreement to achieve expected data transfer speeds. RESOLUTION 2007-090 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING A REVOCABLE PERMIT TO FRONT RANGE INTERNET, INC. FOR THE DOWNTOWN WI-FI PILOT PROJECT WHEREAS,many municipalities are investigating how large-scale use of outdoor wireless broadband intemet access networks ("Municipal Wi-Fi Network")may advance community goals such as exploring cost savings associated with electric and water revenue meter communications, distributing load monitoring, replacing Tl communication lines, and other savings that can be realized through the use of a ubiquitous communications infrastructure; and WHEREAS, the technology in this area is changing rapidly and the individual uses of the technology are likewise changing in dramatic and vaned ways; and WHEREAS,at a July 24,2007 City Council work session a three-phase study was discussed which would allow the City to explore how a Municipal Wi-Fi Network might benefit the City; and WHEREAS, Front Range Internet, Inc. ("FRII") has partnered with the City to provide a limited geographical test site in the downtown area for a Municipal Wi-Fi Network as the first phase of the study program; and WHEREAS,FRII has agreed to provide necessary equipment and services for the first phase of the study; and WHEREAS,the City will be able to test the functionality and viability of a Municipal Wi-Fi Network to improve City operations; and WHEREAS,based on the agreed upon conditions, FRII has requested that the City grant to it a permit or license for the installation of the equipment on City property, at or in the vicinity of the specific locations described on Exhibit "A", attached hereto and incorporated herein by this reference(the "Permitted Sites"); and WHEREAS, in light of the public purposes to be served and the benefits to the City of the testing of Municipal Wi-Fi Network and the economic development potential offered by a wireless network in the downtown area, City staff believes that the City's ability to obtain access to FRII's network constitutes appropriate compensation for the City providing installation labor, electricity, and pole attachments to FRII; and WHEREAS, upon revocation of the permission authorized hereunder, FRII will remove or relinquish to the City any equipment remaining in place at the City's request; and WHEREAS,Article XI, Section 10, of the Charter of the City of Fort Collins authorizes the Council to permit the use of occupation of any street, alley, or public place, provided that such permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is expressly reserved in such permit. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute such documents as are necessary to grant a revocable permit to FRII as described herein, together with such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary or appropriate to protect the interests of the City or to effectuate the purposes of this Resolution.
