SUBJECT :
Second Reading of Ordinance No. 092, 2003, Authorizing the Acceptance of Property Donated
by Willowood Corporation and Appropriating Unanticipated Revenue in the General Fund for
Said Property Acceptance.
RECOMMENDATION:
Staff and the Natural Resources Advisory Board recommend adoption of the Ordinance on
Second Reading.
EXECUTIVE SUMMARY:
This Ordinance, which was adopted 6-0 (Mayor Martinez was absent) on June 17, 2003,
authorizes the Mayor to accept the conveyance of approximately 1.54-acres of land to be owned
by the City and managed as a natural area by the Natural Resources Department.
ORDINANCE NO. 092, 2003
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACCEPTANCE OF PROPERTY DONATED BY WILLOWOOD
CORPORATION AND APPROPRIATING UNANTICIPATED REVENUE IN THE
GENERAL FUND FOR SAID PROPERTY ACCEPTANCE
WHEREAS, Willowood Corporation is the owner of approximately 1.54 acres of land
located adjacent to the City's Prairie Dog Meadow Natural Area, more particularly described as
Tract A, Huntington Hills West (the "Property"); and
WHEREAS, the 1.54 acres of land has been appraised at$150,000; and
WHEREAS, the objectives of the Natural Areas Policy Plan as adopted by the City
Council in Ordinance No. 29, 1997 and Resolution No. 98-62, 1998 include establishing a
system of publicly owned natural areas to protect the integrity of critical conservation sites;
protecting corridors between natural areas; preserving outstanding examples of Fort Collins'
diverse natural heritage; and providing a broad range of opportunities for educational,
interpretive and recreational programs to meet community needs; and
WHEREAS, City staff and the Natural Resources Advisory Board have reviewed the
resource, natural heritage and open space values of the Property, and have determined that the
Property would provide a valuable opportunity to advance the objectives of the Natural Areas
Policy Plan; and
WHEREAS, the acquisition of the Property will add acreage to a currently protected site
that is used by prairie dogs, allowing expansion of the colony onto upland habitat and providing
additional feeding areas for the prairie dogs; and
WHEREAS, Willowood Corporation has agreed to donate the Property to the City for
use by the City for Natural Area purposes; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the
City Council to make supplemental appropriations by ordinance at any time during the fiscal
year, provided that the total amount of such supplemental appropriations, in combination with all
previous appropriations for that fiscal year, does not exceed the then current estimate of actual
and anticipated revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the donated Property, as
described herein, will not cause the total amount appropriated in the General Fund to exceed the
current estimate of actual and anticipated revenues to be received in that fund during the fiscal
year.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the City Council hereby approves and authorizes the acceptance by the
Mayor of a deed of conveyance of the Property for natural area purposes.
Section 2. That there is hereby appropriated from unanticipated revenue in the General
Fund the sum of ONE HUNDRED FIFTY THOUSAND DOLLARS ($150,000) for expenditure
in the General Fund for the purpose of recording the donated Property asset.
Introduced, considered favorably on first reading, and ordered published this 17th June,
A.D. 2003, and to be presented for final passage on the 1st day of July, A.D. 2003.

FINANCIAL IMPACT:
Willowood Corporation has proposed to donate 1.54 acres of property to the City, having an
appraised value of $150,000, f�natural area purposes.-Maintenance costs for this parcel are
estimated to be $100/year (2003 dollars or routing weed o trol site cleanup, fence repair, etc.
Site restoration costs are expected to be minimal, o a ing less than $500 (one-time cost; 2003
dollars) for reseeding upland nonnative gasslandI atrve g asses.

This Ordinance authorizes the Mayor to accept the conveyance of approximately 1.54-acres of
land to be owned by the City and managed as a natural area by the Natural Resources
