RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. EXECUTIVE SUMMARY The Colorado state agency responsible for emergency management was formally known as the "State Division of Disaster Emergency Services" and was so identified in City Code Sec. 2-671. It is currently named "Colorado Division of Emergency Management'. The recommended amendment provides a general term for the state agency that will allow for any future reorganization and renaming of the State office so that the Code need not be amended each time the State makes changes. ORDINANCE NO. 080, 2007 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 2-671 OF THE CODE OF THE CITY OF FORT COLLINS PERTAINING TO EMERGENCY MANAGEMENT PROVISIONS WHEREAS , the Office of Emergency Management was created by Ordinance No . 40, 1990 ; and WHEREAS , Section 2-671 of the City Code requires any emergency ordinance passed pursuant to this Section to be filed with the County Clerk and the State Division of Disaster Emergency Services ; and WHEREAS , the State Division of Disaster Emergency Services has been renamed; and WHEREAS , this amendment uses a general term for the State agency so that the Code section need not be amended each time the agency is reorganized, re-named or otherwise changes . NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 2-671 (a)( 1 ) of the Code of the City of Fort Collins is hereby amended to read as follows : Sec. 2 -671 . Powers and duties of the director and assistant director of the Office of Emergency Management. (a) The director is hereby empowered: ( 1 ) To proclaim the existence or threatened existence of a local emergency. Whenever a local emergency is proclaimed by the director, it shall not be continued or renewed for a period in excess of seven (7) days, except by or with the consent of the City Council. Any such proclamation shall be given prompt and general publicity and shall be filed promptly with the City Clerk or the Larimer County Clerk and Recorder and with the State Divisivn of Disa Emergency State agency responsible for emergency management.
