EXECUTIVE SUMMARY This Resolution accepts the donation of granite pavers depicting local children's drawings. The Art in Public Places Program has been collaborating with the Downtown Development Authority (DDA) to create sixty granite pavers sandblasted with drawings by Fort Collins youth.The intention of the DDA is to place the pavers in the City right-of-way in the three current Downtown Alley Enhancement Projects. Because the pavers will be placed in the City right-of-way, City staff and the DDA agreed the pavers should be donated to the City. BACKGROUND / DISCUSSION The Art in Public Places Guidelines state that all works of art with a value over$10,000 donated to the City of Fort Collins that are to be placed in a public area, must be approved by the APP Board. Once approved, the Board recommends that City Council accept the work of art on behalf of the City. The City is to accept ownership and responsibility for maintenance only of works of art that meet the objectives of the APP program. The work of art must also meet the criteria for works of art and site selection set forth in the APP guidelines. The Art in Public Places Program has been collaborating with the Downtown Development Authority(DDA)to create granite pavers sandblasted with drawings by Fort Collins youth. The Art in Public Places Program has been creating similar granite pavers to be placed in city sidewalks since 2002. The DDA pavers have been modeled after this program and process.The addition of the pavers will enhance the existing program and give greater focus to placing the pavers in the Old Town area. The pavers will be placed in the three downtown alleys that are a part of the DDA's Downtown Alley Enhancement Project.The DDA would like to donate the sixty pavers to the City. Its intention is to place the pavers in the city right- of-way in the three current alley enhancement projects. The young artists and their drawings were selected using the City's RFP process through the City's Purchasing Department. Each selected artist received a $50 honorarium for use of their drawing for the paver project. Sixty drawings were selected, with the plan to install twenty pavers in each of the three current alley projects. The three paver drawing themes are: Sustainability in Fort Collins, Fort Collins History, and Music/Art/or Cool Patterns. FINANCIAL/ ECONOMIC IMPACTS This item does not impact the City's general fund account. The artist honorariums, fabrication and installation costs will be paid for by the DDA. The pavers were fabricated in Fort Collins. The estimated value of the sixty 16-inch square pavers is$15,000. As part of the donation,the DDA will agree to be responsible for maintenance, repair,and, if necessary and appropriate, replacement of the pavers. STAFF RECOMMENDATION Staff recommends adoption of the Resolution. August 17, 2010 -2- ITEM 15 BOARD / COMMISSION RECOMMENDATION At its May 19, 2010 meeting, the Art in Public Places Board approved the art and recommended that Council accept these works of art on behalf of the City. PUBLIC OUTREACH The open competition for local youth to submit drawings was promoted during the APP exhibit at Lincoln Centerwhere space was provided for kids to sit and draw. Staff also promoted the competition and provided a table for local youth to create their drawings at Lincoln Center children's concert series and the Thursday night concerts at Civic Center Park. The APP program further promoted this project through websites and the art teachers in the Poudre School District, with many teachers making it a class project. ATTACHMENTS 1. Citizen Participation V.Veterans Plaza Art Donation: Kathleen Benedict of the Caty s Parks PI Department,Diggs Brown,and artist Susan Raymond were in attendance to speak about this posed donation.Ms Benedict gave an overview of the project proposed to go into the future Vete Plaza at Spring Canyon Park. The project concept is to honor those who have served,not a me al to those that have fallen.There will be a raised platform adjacent to a stage on which the sculptor be placed. A provision for future maintenance is not included in this donation.The sculpture be a 7'tall soldier with a boy on his shoulder.Board members filled out their donation evaluation f Mr.York moved to ept the Veterans Plaza Art Donation for the Spring Canyon Park with the caveat that the plaza is b ' and the sculpture be placed at this site. Discussion ad.Ms Francuz would encourage the plaza donors to set aside money in the foundation or establis agreement for any damage that may happen to the sculpture to assist the city in mainte ce costs. The donor group could also make a donation to the APP maintenance fund. DDA Alley Project Art Donation: Derf Green of the Downtown Development Authority(DDA) gave an overview of the DDA alley enhancement projects.Ms Martin spoke about our past collaborations with DDA that have happened in recent years.The DDA pavers will go into the city right-of-way in all three of the upcoming alley enhancement projects. The paver donation will have to go to council.Board members filled out their donation evaluation forms. RESOLUTION 2010-052 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE ACCEPTANCE OF THE PROPOSED DONATION OF ARTWORK ON GRANITE PAVERS FROM THE DOWNTOWN DEVELOPMENT AUTHORITY WHEREAS,the Downtown Development Authority(DDA),in collaboration with the City, is currently working.on improvements to two alleys in the downtown area, with additional similar projects planned in the near future (the "Alley Enhancement Projects"); and WHEREAS, as part of the Alley Enhancement Projects, the DDA commissioned artists to create artworks for the Projects, in a manner similar to the City's Art in Public Places Program; and WHEREAS, one of artworks consists of sixty granite pavers etched with drawings created by local youth, whose drawings were selected using an RFP process through the City's Purchasing Department (the "Artwork"); and WHEREAS,the DDA is paying all costs associated with the creation and installation of the Artwork, with the goal of placing the Artwork in the City alley rights-of-way during work on the Alley Enhancements Projects; and WHEREAS, in order for the Artwork to be placed on City Property, the DDA wishes to donate the Artwork to the City; and WHEREAS, the value of the Artwork is estimated at $15,000; and WHEREAS, as a condition of the City's acceptance of the donation, the DDA would agree to assign any rights it has in the Artwork to the City, and to be responsible for the future costs of maintenance, repair and, if appropriate, replacement of the Artwork; and WHEREAS, Section 23-309 of the City Code requires that works of art with a value of$300 or more donated to the City to be placed in a public area may be accepted only with approval of the Art in Public Places Board(the"APP Board"), and all such works with a value of$10,000 or more may be accepted only with approval of the City Council, upon review of the proposed donation and the recommendation of the APP Board; and WHEREAS,at its regular meeting on May 19,2010,the APP Board evaluated the proposed donation of the Artwork based on the City's Art in Public Places Guidelines and recommended that the City Council accept the donation. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that the City Council hereby accepts the proposed donation of the etched granite pavers featuring drawings by local youth, to be placed in City alley rights-of-way as part of the Alley Enhancement Projects, as approved by the APP Board at its meeting on May 19, 2010.
