Items Relating to the Final Design and Construction of the Transfort South Transit Center.
A. Resolution 2010-048 Authorizing the Execution of an Amendment to the Intergovernmental Agreement
Between the City of Fort Collins and the Colorado Department of Transportation for the Design and
Construction of the South Transit Center.
B. First Reading of Ordinance No. 093, 2010, Appropriating Prior Year Reserves in the Transit Services Fund
For Transfer to the Capital Projects Fund and Appropriating Unanticipated Revenue in the Capital Projects
Fund, Mason Corridor Project for the South Transit Center Project.
EXECUTIVE SUMMARY
The South Transit Center(STC)will serve as Transfort's southern transit hub, replacing the current Transit Center
at The Square shopping mall.The STC will serve a wide range of users with parking spaces and access to the Mason
Trail, as well as the Transfort bus service. The South Transit Center will also serve as a transfer point for regional
FLEX service and the Mason Bus Rapid Transit system known as MAX. The South Transit Center will contain a bus
turnaround, pedestrian shelters, customer service counter, retail space, site furnishings for passenger comfort and
safety,security lighting, identification signage, signage for transit rider information and landscape improvements.The
project is funded through the Colorado Department of Transportation and is being leveraged as local match towards
the overall Mason Corridor Project.
BACKGROUND / DISCUSSION
The South Transit Center Project will be located on City-owned property that is located west of South College Avenue
(US-287), near the intersection of Fairway Lane and Fossil Boulevard,approximately 1/2 mile south of Harmony Road
(see Attachment 1). This site is currently used as the trailhead parking area for the City's Mason Corridor
bicycle/pedestrian trail and the Fossil Creek trail. The South Transit Center will be a permanent Transit Center that
caters to a wide range of users with parking spaces, a "Kiss-N-Ride" passenger drop-off area, and access to the
Mason Trail. The South Transit Center will also be designed to allow buses other than those of the MAX Bus Rapid
Transit(BRT) system to circulate in and out to make east/west passenger transfers. The South Transit Center will
contain a bus turnaround, pedestrian-waiting shelters, customer service counter, retail space, site furnishings for
passenger comfort and safety, security lighting, identification signage, signage for transit rider information and
landscape improvements.
The full CDOT Senate Bill-I(SB-I)funding contract for the design and construction of the South Transit Center is being
leveraged as local match towards the overall Mason Corridor Bus Rapid Transit project. The total State contribution
approved for the South Transit Center portion of the Mason Corridor Project is$4,000,000. The initial contract with
CDOT(Attachment 2)was for$212,000 that started the preliminary design for the South Transit Center. The contract
amendment (Attachment 3) is for the remaining $3,788,000 that will complete final design and construction.

The construction phase for the South Transit Center will be coordinated with the overall Mason Corridor MAX BRT
system construction. The South Transit Center and MAX BRT service are scheduled to be operational by the end of
2012.

The South Transit Center Project is designed to be implemented and operational either as a component of the overall
Mason Corridor/MAX Project, or if necessary, as an independent standalone improvement, should any of the
anticipated federal funding be delayed or not secured.
FINANCIAL/ ECONOMIC IMPACTS
This funding contract between the Colorado Department of Transportation (CDOT)and the City of Fort Collins is for
the final design and construction of the South Transit Center,which is a component of the Mason Corridor/MAX Bus
Rapid Transit (BRT) Project. CDOT's State Senate Bill-1 (SB-1) "Strategic Transit Project" funding program is
providing eighty percent of the transit center improvements and the remainder is being provided by the City of Fort
Collins, via in-kind match from the site's land value, Building On Basics intersection improvement funds, and the
Transit Capital Fund:

The State Transportation Commission has approved a total amount of$4,000,000 for the City's South Transit Center
Project. The approved State SB-1 funds are part of the City's local matching funds for the Federal Transit
Administration federal funding for the overall Mason Corridor BRT Project.
The South Transit Center will be operational in 2012, functioning as Transfort's southern bus terminal. North/south
and east/west bus routes will feed into this facility including FLEX,the new regional bus route to Longmont.The South
Transit Center complex will consist of a bus turnaround, pedestrian-waiting shelters, customer service counter, retail
space, site furnishings for user comfort and safety, security lighting, identification signage, signage for transit rider
information and landscape improvements.The following operational and maintenance expenses for the South Transit
Center have been submitted as an offer in the 2011 and 2012 Budgeting for Outcomes.

ENVIRONMENTAL IMPACTS
The South Transit Center was included in the National Environmental Policy Act(NEPA) Environmental Assessment
for the Mason Corridor Bus Rapid Transit Project. On September 9, 2008, the Federal Transit Administration
determined that there was a Finding of No Significant Impact resulting from the construction and ongoing operation
of the South Transit Center.

STAFF RECOMMENDATION
Staff recommends adoption of the Resolution and Ordinance on First Reading.
BOARD / COMMISSION RECOMMENDATION
On September 20, 2000, the Transportation Board unanimously voted to approve the Mason Street Corridor Master
Plan, which included plans for the South Transit Center. Since 2000, staff has regularly updated the Transportation
Board regarding the progress of the Mason Corridor, most recently on July 21, 2010. (Attachments 3 and 4)
PUBLIC OUTREACH
Public outreach has been conducted since 1998 for the Mason Corridor project. The most recent public outreach
event was an Open House held June 2, 2010. Information and renderings of the South Transit Center were included
as part of the Mason Corridor materials presented. A list of outreach conducted as part of the Mason Corridor

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CITY OF FORT COLLINS AND
THE COLORADO DEPARTMENT OF TRANSPORTATION FOR
THE DESIGN OF THE SOUTH TRANSIT CENTER
WHEREAS,the Mason Corrdior/MAX Bus Rapid Transit(BRT)Project includes within its
scope the construction of a Transit Center to function as a"Park-n-Ride"and southern terminal for
the MAX BRT service, which South Transit Center will be located in the approximate vicinity of
the intersection of Fairway Lane and Fossil Boulevard; and
WHEREAS,it is scheduled that the architectural and engineering design phase of the South
Transit Center will be completed by the end of 2009 and in support of that effort, the Colorado
Department of Transportation has made available to the City the sum of$212,000 to assist in funding
the design phase of the South Transit Center upon the condition that the City provide local funds in
the amount of$53,000 through an "in-kind" match by reason of the City's provision of land upon
which to locate the South Transit Center, for a total project cost of$265,000. _
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor is hereby authorized to execute an intergovernmental agreement with the
Colorado Department of Transportation in the form of agreement on file in the office of the City
Clerk together with such additional terms and conditions as the City Manager, in consultation with
the City Attorney,deems necessary or appropriate to protect the interests of the City or to effectuate
the purposes of this Resolution, for the funding of the design phase of the South Transit Center for
the MAX BRT Project.

5. MASON ST. TRANSPORTATION CORRIDOR—Durkin-Schindler
Durkin-Schindler said that a recommendation is needed from the Board on the same three
action items that the Council will be asked to approve. They are:
I. Adopt the Master Plan
2. Extending the boundaries of the corridor to Fossil Creek(this has to be
done formally as the ballot language did not have it extend that far)
3. Authorize the City Manager to enter into a Memorandum of
Understanding with the railroad.
Moe presented the latest corridor design, segment by segment, to the Board using
PowerPoint. Costs and project phasing were also discussed. Upon conclusion of the
presentation, the floor was opened for questions and comments.
Warring: What is the "New Start Money"process? SDS: We already talked with FTA
so they know we're here. We've already talked to our legislative delegation in
Washington and they know we're coming. In addition to starring an application process,
which includes an environmental assessment(we have a lot of work already done on
that), we would have to then beef ourselves up in terms of our Iegislative interest in the
project. It's a lobbying effort as well as the formal application process. The good news is
that FTA considers this a fairly"small potatoes"kind of project compared to the requests
they get such as $525 M for light rail in Denver and this project is somewhat unique to
boot.
Yeldell: What is the discussion of whether or not Mason would replace the College
buses? SDS: Right now, Transfort is reviewing its own overall strategic plan and one of
the issues they have is getting riders to their destinations. The biggest complaint they
think they might get if they move the transit from College to Mason is from our disabled
community because some of those folks will have a lot greater difficulty getting from
Mason to College. However, they do have a Dial-A-Ride facility that could help those
folks out. Yeldell: Yes, it seems to me that it is a very bad statement to make—to have
both a transit option on College and on the Corridor. That would be a bad message to
send out.
Kramer: Why did you leave out sales tax on automobiles? Moe: I don't have an answer
for that—I'll have to get back to you.
Chair Johnson asked for a motion on the first action item which is the Master Plan
adoption.

Thordarson made a motion to recommend that the City Council adopt the Master Plan.
There was a second and the motion passed unanimously. Chair Johnson thanked staff
for the extensive public outreach.
There was a motion to recommend approval of the extension of the corridor boundary
past Harmony to Fossil Creek. There was a second and the motion passed by a
unanimous vote:

Mr.Hahn ted that currently they are working on the Environmental Assessment(EA).
The firs tep of an EA is to do an alternative analysis. The numbers of measurable sites
are n owed down,which is where they are right now. If they can determine there is no
si cant impact,they will move to the next step which is to prepare a document called
NSI (Finding of no significant impact). At the present time,they are not making any
determination or prediction if they will reach that level yet.

South Transit Center utilizing funding from the Colorado Department of Transportation in the
amount of$3,788,000,together with City local matching contributions from Site Land Value,BOB
intersection funds and transit funds in the amounts of $545,487, $285,000, and $116,525,
respectively, for a total capital cost of$4,735,000; and
WHEREAS, the South Transit Center project was included in a National Environmental
Policy Act Environmental Assessment, which assessment found that there was no significant
environmental impact resulting from the construction and operation of the South Transit Center;and
WHEREAS, City staff has conducted significant public outreach regarding the design and
construction of the South Transit Center,and the Transportation Board has approved the design and
construction of the South Transit Center as a part of its approval of the Mason Street Corridor Master
Plan; and
WHEREAS, the City Council has determined that it is in the best interests of the City that
the amendment to the Intergovernmental Agreement for the design and construction of the South
Transit Center should be authorized and approved.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor is hereby authorized to execute an Amendment to the Intergovernmental
Agreement with the Colorado Department of Transportation in substantially the form of the
"Contract Amendment to the Intergovernmental Agreement for the Design and Construction of the
South Transit Center" that is on file in the office of the City Clerk, with such additional terms and
conditions as the City Manager, in consultation with the City Attorney, deems necessary or
appropriate to protect the interests of the City or to effectuate the purposes of this Resolution.

APPROPRIATING PRIOR YEAR RESERVES IN THE TRANSIT SERVICES FUND
FOR TRANSFER TO THE CAPITAL PROJECTS FUND AND APPROPRIATING
UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND, MASON

WHEREAS, the Mason Corridor Project is a five-mile, north-south byway extending from
Cherry Street to just south of Harmony Road; and
WHEREAS,the South Transit Center,a component of the Mason Corridor Bus Rapid Transit
project, is ready for final design and construction; and
WHEREAS,the South Transit Center will be built on City-owned property located near the
intersection of Fairway Lane and Fossil Boulevard, which property was specifically purchased in
2003 to use as a transit center; and
WHEREAS, the City Council has adopted Resolution 2010-048 authorizing a contract
amendment between the City and the Colorado Department of Transportation("CDOT")for the final
design and construction of the South Transit Center;
WHEREAS,pursuant to the Senate Bill-1 amended funding contract between CDOT and the
City, CDOT is providing eighty percent of the cost of constructing the transit center ($4,000,000)
and the City is providing matching funds for the remaining twenty percent of the costs; and
WHEREAS, the initial contract with CDOT for $212,000 was approved and the funds,
including the City's matching funds, were appropriated by Ordinance No. 069, 2009, and the
remaining $3,788,000 of the CDOT funds is available for appropriation; and
WHEREAS, the City's remaining matching funds of$947,000 consist of. (1) an in-kind
match of$545,475 representing the land value of the South Transit Center site; (2) intersection
improvement funds in the amount of$285,000 from the Building on Basics capital projects program,
which funds were previously appropriated for the transit center; and (3) $116,525 to be transferred
from the Transit Services Fund prior year reserves; and
WHEREAS,Article V,Section 9,of the City Charter permits the City Council to appropriate
by ordinance at any time during the fiscal year such funds for expenditure as may be available from
reserves accumulated in prior years, notwithstanding that such reserves were not previously
appropriated
WHEREAS, Article V, Section 9, of the City Charter authorizes the City Council to make
supplemental appropriations by ordinance at any time during the fiscal year,provided that the total
amount of such supplemental appropriations,in combination with all previous appropriations for that
fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received
during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the revenue as described
herein will not cause the total amount appropriated in the Capital Projects Fund to exceed the current
estimate of actual and anticipated revenues to be received in that fund during any fiscal year.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from prior year reserves in
the Transit Services Fund,the sum of ONE HUNDRED SIXTEEN THOUSAND FIVE HUNDRED
TWENTY-FIVE DOLLARS ($116,525) to be transferred to the Capital Projects Fund, Mason
Corridor Project,and appropriated therein for the final design and construction of the South Transit
Center.
Section 2. That there is hereby appropriated from unanticipated revenue from the
Colorado Department of Transportation SB-1 funds in the Capital Projects fund the sum of THREE
MILLION SEVEN HUNDRED EIGHTY-EIGHT THOUSAND DOLLARS ($3,788,000) for
expenditure in the Capital Projects Fund, Mason Corridor Project, for the final design and
construction of the South Transit Center.
