SUBJECT
First Reading of Ordinance No. 061, 2007, Appropriating Unanticipated Revenue in the Transit
Services Fund for Use with Existing Appropriations for the Purpose of Providing Programming
Aimed at Relieving Urban Congestion.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
The total cost of the three new projects is$337,391 ($249,883 in Federal Funds and$87,508 in local
matching funds). However,staff is only requesting the appropriation of$233,710 in this Ordinance.
A portion ($16,173) of the federal funds has already been allocated/appropriated in the Bicycle
Coordinator Program through the annual budgeting process. No additional local matching funds are
required as the City's share is being met from matching funds from the General Fund in the Bicycle
Coordinator Program-$42,840 and a reallocation of General Fund resources in the Transit Services
Fund - $44,668. Federal funding will come from the Federal Highway Administration's CMAQ
Program, administered through CDOT and will replace a previous 2007 commitment to assist in
funding the City's now-reduced Transportation Demand Program.
EXECUTIVE SUMMARY
The City of Fort Collins has received Congestion, Mitigation & Air Quality (CMAQ) funding to
fund three air quality related projects in 2007. This funding is a reallocation of a portion of the 2007
Transportation Demand Management (TDM) Program — funds not currently required due to the
reduction in scope of the TDM Program. The revised CMAQ funding will aid in funding three
projects which are:
• The Bicycle Coordinator Program(FC Bikes)-an existing Program that seeks to encourage
citizens to utilize bicycling as their preferred method of sensible transportation through the
implementation of special events and campaigns that emulate the many facets of bicycling,
• Transfort Test Ride Marketing Program- a new marketing campaign to promote transit use
among the City's largest employers, and
• Marketing for Transfort's three new routes - a campaign aimed at increasing public
awareness of the new transit fixed routes available in 2007.

BACKGROUND
The primary goal of the Congestion,Mitigation and Air Quality Program(CMAQ),operated by the
Federal Highway Administration,is to relieve urban congestion. As such, the City, with guidance
from the Colorado Department of Transportation(CDOT)decided the Transit Marketing programs
and the Bicycle Coordinator Program would be eligible for CMAQ funding. Due to the reduction
in scope of the City's Transportation Demand Management Program,the original 2007 TDM CMAQ
funding has been reallocated at a lesser rate to the above mentioned projects. This reallocation
would not have occurred had it not been for the support and approval of the North Front Range
Transportation and Air Quality Council in passing two separate resolutions amending the
Transportation Improvement Program(TIP)—the first to deprogram the original TDM funds and the
second to reallocate funds to the new projects.
This ordinance appropriates unanticipated revenue from CMAQ in the amount of$233,710. The
required local match and remaining project costs are being met from existing appropriations. The
Bicycle Coordinator Program has an existing General Fund overmatch sufficient to cover its portion
of the local match requirement. The local match requirement for the two new Marketing Programs
is being met by a reallocation of General Fund from other Transit Fund 404 Program sources.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSIT
SERVICES FUND TO FUND PROGRAMMING THAT
RELIEVES URBAN CONGESTION
WHEREAS, in 2007 the City discontinued funding for local matching dollars used to provide
Transportation Demand Management ("TDM") programming; and
WHEREAS , City staff, in working with the North Front Range Transportation and Air
Quality Planning Council, has successfully petitioned for and received approval to de-program the
original 2007 TDM Congestion and Mitigation Air Quality ("CMAQ") funds to be reallocated to
fund the following three programs managed by Transit Services : ( 1 ) Bicycle Coordinator Program;
(2) Transfort Test Ride Marketing Program; and (3 ) Transfort New Fixed Routes Marketing; and
WHEREAS , the Colorado Department of Transportation ("CDOT") approved a total of
$249, 883 in CMAQ for the following programs :
Bicycle Coordinator Program - to promote bicycle use within
the City $ 35 ,000
Transfort Test Ride Marketing Program - to promote
transit use among the City ' s largest employers 701000
Transfort New Fixed Route Marketing Program - promote
and increase public awareness of the new fixed routes 144, 883
Total $ 2495883
WHEREAS , a portion of the aforementioned federal funds, totaling $ 16, 173 , has already
been appropriated in the 2007 budget established for the Bicycle Coordinator Program; and
WHEREAS , no additional matching funds are required as the City' s share is being met from
existing appropriations within the Transit Services Fund; and
WHEREAS , Article V, Section 9, of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations, in combination with all previous
appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS , City staff has determined that the appropriation of the Congestion Mitigation
and Air Quality Grant funds, administered through the Colorado Department of Transportation, will
not cause the total amount appropriated in the Transit Services Fund Bicycle Coordinator, Transfort
Test Marketing, and Transfort New Fixed Route Marketing programs to exceed the current estimate
of actual and anticipated revenues to be received during the fiscal year; and
WHEREAS , it is the desire of the Council to appropriate the sum of $233 ,710 in Congestion
Mitigation and Air Quality funds in the Transit Services Fund to be used to : promote bicycle use
within the City ($ 18 , 827) ; promote transit use among the City' s largest employers ($70,000) ; and
increase public awareness of the new transit fixed routes available in 2007 ($ 144,883 ) .
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows :
Section 1 . That there is hereby appropriated for expenditure from unanticipated revenue
in the Transit Services Fund - Bicycle Coordinator program the sum of EIGHTEEN THOUSAND
EIGHT HUNDRED TWENTY-SEVEN DOLLARS ($ 18, 827)), representing Congestion Mitigation
and Air Quality funds, administered by the Colorado Department of Transportation, to be used to
promote bicycle use within the City.
Section 2 . That there is hereby appropriated for expenditure from unanticipated revenue
in the Transit Services Fund - Transfort Test Ride Marketing program the sum of SEVENTY
THOUSAND DOLLARS ($70,000)), representing Congestion Mitigation and Air Quality funds,
administered by the Colorado Department of Transportation, to be used to promote transit use
among the City ' s largest employers .
Section 3 . That there is hereby appropriated for expenditure from unanticipated revenue
in the Transit Services Fund - Transfort New Fixed Route Marketing program the sum of ONE
HUNDRED FORTY-FOUR THOUSAND EIGHT HUNDRED EIGHTY-THREE DOLLARS
($ 144, 883 ), representing Congestion Mitigation and Air Quality funds, administered by the
Colorado Department of Transportation, to be used to increase public awareness transit use among
the City ' s largest employers.
