RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY When Council approved the 2007 Budget last November, $1.2 million was also appropriated for library services. This appropriation was intended to serve as funding during the transition of the library services from City operations to District operations. The District and the City will need to approve an intergovernmental agreement prior to full operations commencing under the direction of the District. This ordinance, unanimously adopted on First Reading on May 15, 2007, allows funding of library services to continue under City direction for 2007. The City will also be reimbursed for expenses incurred during the first quarter of 2007. From that point forward,the City will be reimbursed on a monthly basis. These reimbursements will occur within thirty days after the close of the month during which the charges were incurred. ATTACHMENTS 1. Copy of First Reading Agenda Item Summary- May 15, 2007. EXECUTIVE SUMMARY The Board of the Fort Collins Regional Library District sent a letter dated April 16, 2007 to the Fort Collins' City Council reflecting the Board's approval of reimbursing the City of Fort Collins in an amount of$3,851,153 based upon actual expenditures incurred for the costs of operations and maintenance of public library services for 2007. As of the end of April, the Fort Collins Regional Library District has collected $2,318,000 of property taxes from the mill levy approved by voters last November for funding the regional library district. ORDINANCE NO. 075, 2007 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE FROM THE FORT COLLINS REGIONAL LIBRARY DISTRICT FOR THE CONTINUATION OF LIBRARY SERVICES FOR FISCAL YEAR 2007 WHEREAS, on November 7,2006, the voters approved a citizen initiative to establish and fund the Fort Collins Regional Library District(the"Library District")pursuant to Title 24, Article 90 of the Colorado Revised Statutes (the"Library Law"); and WHEREAS, the City Council and Larimer County Commissioners each appointed two of their members to a committee (the "Committee") to fill seven positions on the initial board of trustees of the Library District as required by the Library Law; and WHEREAS,on March 6,2007,the City Council,pursuant to the requirements of the Library Law, adopted a resolution that ratifies the Committee's appointments of the Board of Trustees of the Fort Collins Regional Library District (the "Board of Trustees"); and WHEREAS, the Board of Trustees sent a letter to the City Council and the City Manager, dated April 16,2007, in which it notified the City Council of its adoption of a motion to reimburse the City of Fort Collins for providing library services during 2007 in an amount not to exceed $3,851,153; and WHEREAS,the City of Fort Collins has been accounting for the cost of library services and the collections of the voter approved mill levy for funding the Library District; and WHEREAS, the Library District has collected property taxes in the amount of$2,318,000 as of the end of April, 2007; and WHEREAS, on November 21, 2006, the City Council adopted Ordinance No. 177, 2006, approving$1,200,000 to provide library services for the first quarter of 2007; and, WHEREAS, City Council desires to fund Library Services for the balance of fiscal year 2007; and WHEREAS, it is the desire of the City Council to appropriate the sum of$2,651,153 to continue offering library services. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from unanticipated revenue the sum of TWO MILLION SIX HUNDRED FIFTY-ONE THOUSAND ONE HUNDRED FIFTY-THREE DOLLARS ($2,651,153), in to the General Fund to provide Library Services.
