RECOMMENDATION Staff and the Downtown Development Authority Board of Directors recommend adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY This Ordinance,unanimously adopted on First Reading on May 15,2007, amends the City Code to increase the number of members on the Downtown Development Authority Board of Directors from nine to eleven, and designates that one of the additional seats will be occupied by a member of the Larimer County Board of Commissioners. BACKGROUND The Downtown Development Authority Board of Directors(the"Board")currently consists of nine members, eight of whom are either residents, landowners or tenants within the boundaries of the Authority, and one of whom is a City Councilmember. The Board believes that the DDA would benefit from having a member of the Larimer County Board of Commissioners(the`Board of Commissioners")on the Board because Larimer County is the one of the largest employers within the boundaries of the DDA, and it has made significant capital investments in the central business district. The Board believes it would be beneficial to the economic welfare of the central business district to include formal representation from the County on the Board itself. This Ordinance increases the membership from nine to eleven members to accommodate a representative of the Board of County Commissioners. The other additional seat will be filled by a resident,landowner or tenant within the boundaries of the District. 0�) Py COPY cl�" 0 P ORDINANCE NO. 067, 2007 OF THE CODE OF THE CITY OF FORT COLLINS AMENDING SECTION 2-462 OF THE CODE OF THE CITY OF FORT COLLINS TO ALLOW FOR INCLUSION OF A MEMBER OF THE LARIMER COUNTY BOARD OF COMMISSIONERS ON THE BOARD OF DIRECTORS OF THE DOWNTOWN DEVELOPMENT AUTHORITY WHEREAS, Chapter 2, Article IV, Division 1 of the City Code establishes a Downtown Development Authority("DDA") pursuant to Title 31, Article 25, Part 8, C.R.S.; and WHEREAS, under C.R.S. Section 31-25-805(1),the affairs of the DDA are to be under the direct supervision and control of a board(the"Board")consisting of not less than five nor more than eleven members, with one such member being a member of the City Council ; and WHEREAS,under C.R.S.Section 31-25-806(1),all other members of the DDA Board must reside, be a business lessee, or own real property in the DDA district, provided, however, that an officer or director of a corporation having its place of business in the DDA district is eligible for appointment to the Board; and WHEREAS, Section 2-462 of the City Code currently states that the Board shall consist of nine members; and WHEREAS, the members of the Board believe that the DDA would benefit from having a member of the Larimer County Board of Commissioners (the "Board of Commissioners") on the Board; and WHEREAS, the Board of Commissioners has agreed to designate one of its members to serve in such capacity, subject to appointment by the City Council; and WHEREAS, Larimer County is eligible for representation on the Board by reason of its ownership of real property within the boundaries of the DDA; and WHEREAS, the City Council believes it to be in the best interests of the City to amend Section 2-462 of the City Code to allow for such participation on the Board by the Board of Commissioners. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 2-462 of the Code of the City of Fort Collins is hereby amended to as follows: Sec. 2-462. Membership; term. (a) Members of the Board of the Authority shall be appointed by resolution of the City Council.The Authority shall consist of eleven(11)members, nine(9)of whom shall be either residents, landowners or tenants within the boundaries of the Authority, one (1) of whom shall be a City Councilmember, and one (1) of whom shall be a member of the Board of County Commissioners of Larimer County, Colorado, provided that Latimer County continues to meet the qualifications for membership on the Board of Authority as either a landowner or tenant within the boundaries of the Authority, and further provided that the Board of County Commissioners formally designates one of its members to serve in such capacity. In addition to appointing one(1) of its members to regularly serve on the Board of the Authority, the City Council may appoint another of its members to serve as an alternate member of said Board who shall become a voting member of the Board in the absence of the regular appointee, with the same duties and privileges. (b) Terms of office, appointments, removals and the filling of vacancies of Authority Board members shall be established and governed as set forth in Title 31, Article 25,Part 8,C.R.S.No member shall serve more than two(2)consecutive four- year terms.
