SUBJECT
First Reading of Ordinance No. 181, 2006, Appropriating Unanticipated Grant Revenue and Prior
Year Reserves in the General Fund for the Restorative Justice Program and Authorizing the Transfer
of Matching Funds Previously Appropriated in the Police Services Operating Budget to the Grant
Project.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
The City has received a grant in the amount of$30,635 from the Colorado Division of Criminal
Justice,for the continuation of the Restorative Justice Program. A cash match of$10,212 is required
and will be met by appropriating project income (client fees) from prior year reserves for the
Restorative Justice Program, in the amount of$6,212. The remaining $4,000 required match will
come from already appropriated funds designated for the Restorative Justice Program in the Police
Services budget.
EXECUTIVE SUMMARY
A grant in the amount of$30,635 has been received from the Colorado Division of Criminal Justice
(DCJ) for salaries associated with the continued operation of the Restorative Justice Program.
Restorative Justice is an alternative method of holding a youth offender accountable by facilitating
a meeting with the young offender,the victim and members of the community to determine the harm
done by the crime, and what should be done to repair the harm. By learning to understand the
impact of their actions on the victim and community, criminal justice officials are optimistic repeat
offenses by these youth will be reduced. A $10,212 cash match is required and will be met by
appropriating previously collected project income (client fees) from users of this program in the
amount of$6,212 and$4,000 of already appropriated funds designated for Restorative Justice in the
Police Services budget.
The grant period is from October 18, 2006 to June 30, 2007.
ORDINANCE NO. 181, 2006
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED GRANT REVENUE AND PRIOR
YEAR RESERVES IN THE GENERAL FUND FOR THE RESTORATIVE
JUSTICE PROGRAM AND AUTHORIZING THE TRANSFER OF
MATCHING FUNDS PREVIOUSLY APPROPRIATED IN THE POLICE
SERVICES OPERATING BUDGET TO THE GRANT PROJECT
WHEREAS, the City of Fort Collins Police Services has been awarded a grant from the
Colorado Division of Criminal Justice in the amount of$30,635 for salaries associated with the
continued operation of the Restorative Justice Program, which includes Restorative Justice Youth
Conferencing and RESTORE; and
WHEREAS, the Restorative Justice Program is an alternative method of holding a youth
offender accountable for his or her actions by conferencing with the young person, the victim, and
community members to identify the harm caused by the incident and to find meaningful ways for
the young person to repair that harm; and
WHEREAS,the grant requires$10,212 of City matching funds,which is available through
appropriating previous project income (client fees) in the amount of$6,212 from the Restorative
Justice Youth Conferencing Program and using funds in the amount of$4,000 already appropriated
in the Police Services budget; and
WHEREAS, the matching funds are currently in General Fund budget for Police Services;
and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the Colorado Division of
Criminal Justice grant funds as described herein will not cause the total amount appropriated in the
General Fund to exceed the current estimate of actual and anticipated revenues to be received in that
fund during the fiscal year; and
WHEREAS, Article V, Section 9,of the Charter permits the City Council to appropriate by
ordinance at any time during the fiscal year such funds for expenditure as may be available from
reserves accumulated in prior years, notwithstanding that such reserves were not previously
appropriated, and
WHEREAS,Article V, Section 10, of the Charter authorizes the City Council to transfer by
ordinance any unexpected and unencumbered amount or portion thereof from one project to another
project, provided that the purpose for which the transferred funds are to be expended remains
unchanged.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from unanticipated revenue in the General
Fund the sum ofTHIRTY THOUSAND SIX HUNDRED THIRTY FIVE DOLLARS($30,635)for
expenditure in the General Fund for continuation of the Restorative Justice Program.
Section 2. That there is hereby appropriated for expenditure from prior year reserves in
the General Fund the amount of SIX THOUSAND TWO HUNDRED TWELVE DOLLARS
($6,212) for the Restorative Justice Youth Conferencing Program.
Section3. That the unexpended appropriated amount ofFOUR THOUSAND DOLLARS
($4,000)is authorized for transfer from the Police Services operating budget in the General Fund to
the Police Services grant project for the Restorative Justice Youth Conferencing Program and
appropriated herein.
