SUBJECT
First Reading of Ordinance No. 190, 2006, Appropriating Unanticipated Revenue in the
Recreation Fund to Be Used for the Purpose of Improving Youth Football Operations and
Increasing Awareness And Interest in the Sport.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY
The Recreation Division was awarded a three-year National Recreation and Park Association
(NRPA) Grant in the amount of$150,000 over three years. The Recreation Division will receive
$50,000/year to be used for staffing a full-time youth football Coordinator. NRPA, as part of its
grant agreement with USA Football, has received funds to be sub-awarded to five community
organizations for the purpose of improving youth football operations and increasing awareness
and interest in the sport. Fort Collins was selected as one of the five Hubs. This Ordinance
appropriates the funding from NRPA for this sub-grant.
BACKGROUND
The three year sub-grant from NRPA will fund a full-time Coordinator who will be responsible
for capacity building, increasing community awareness, planning a community celebration,
utilizing resources, and completing measurement and assessment information to further NRPA's
agenda of improving overall youth football operations and developing and increasing interest in
the sport.
The Sub-grant Agreement expressly outlines the provisions for which the grant was awarded.
The Agreement requires appropriate reporting, recognition, and a commitment to execute the
Agreement and all its terms and conditions. This Agreement will guide staff for the next three
years to successfully fulfill all aspects of the requirements.

2006- 2009 Sub-Grant Agreement
This Agreement, effective as of October 3, 2006 is made between the National Recreation and
Park Association, a non-profit corporation, hereinafter referred to as NRPA, with its office
located at 22377 Belmont Ridge Road, Ashburn, VA 20148, and the City of Fort Collins, a
Colorado municipal corporation, with its office located at 300 La Porte Ave., Fort Collins, CO
80521 hereinafter referred to as AGENCY.
WHEREAS, NRPA has received grant funding from the National Football League("NFL")
Youth Football Fund ("YFF") to improve the quality of youth football programs, facilities, and
leadership at the community level nationwide; and
WHEREAS, as part of its grant agreement with USA Football, NRPA has received funds to be
sub-granted to community organizations for the purpose of improving youth football operations;
and
WHEREAS, NRPA and AGENCY, pursuant to the purpose of improving youth football
operations, have entered into this Agreement for the conduct of the project entitled NRPA/USA
Football Hub Grant, hereinafter referred to as (Project), the parties agreement as follows:
1. Scone of Work
AGENCY agrees to use its best efforts to conduct and carry out the project in accordance
with the scope of work addressed below in section b, and is an integral part of this
Agreement. The scope of work will commence upon the execution of the agreement and
continue though October 31, 2009.
a. Date for three-year scope of work
Year 1 —October 2006— September 2007
Year 2 —October 2007—September 2008
Year 3 —October 2008— September 2009
b. Scope of Work:
I. Capacity Building:
Youth Football is already being implemented in departments, and it is important to
recognize that the NRPA Youth Football Agenda is very different than
implementing youth football programming.
1. Identify the key stakeholder within the local markets. Coordinate with
target agency staff and independent leagues.
2. Develop and implement the NRPA Youth Football Agenda(training
coordinated by Magnet Center Youth Football Coordinator)—review the 7
Ps (People, Places, Programs, Partnerships, Performance Measures, Public
Visibility, and Policies), etc.

I Specialty football training for coaches and staff—Ask recreation staff what
they want to learn more about for their programs. Promote USA Football
Resources and materials.
4. Complete agency facility inventory in preparation to support local/regional
in conducting the facility inventory.
ii. Community Organizing
Engaging local youth football leaders in a cooperative effort to increase
participation and improve quality programming.
1. Conduct a local stakeholder's summit to engage youth football leaders in
the agenda and promote resources and tools that will assist with enhancing
the quality of youth football in their community.
a. Engage youth football associations, universities, local college or
professional level athletes, etc., a county board member or city official,
and a celebrity spokesperson.
1. Support local agencies with the completion of the facility inventory
through technical assistance.
2. Hold a community youth football festival to promote community
awareness and expose youth to football opportunities.
iii. Resources
There are a variety of resources available for youth football. With partner
resources and materials, the AGENCY can enhance their youth football initiative.
Partners include:
1. USA Football
2. NFL
iv. Measurement/Assessment
Completing a comprehensive evaluation and gap analysis will be required at the
completion of the first year. This evaluation will be part of the determination for
continued funding.
1. Evaluating the overall goals and objectives based on the grant
initiative.
2. The gap analysis will assess the current strengths and deficits in the
youth football program. Recommendations on best ways to
mobilize communities towards improving youth football will be
addressed.
2. Term of Agreement
This Agreement shall begin on or about September 2006 and is to be completed by October 2009,
unless the Parties mutually agree to a different date.
a. AGENCY will receive an annual grant of$50,000 to be used for staffing a full
time youth football coordinator. Grant funds can be used for wages and benefits
for the Youth Football Coordinator position and all other expenses incurred
pursuant to the agreements made annually. Under no circumstances will NRPA
reimburse incurred expenses in excess of$50,000 annually.

b. Funding for the second year of the project is contingent upon successfully
completing all project elements identified for completion by September 2007, and
third year funding is contingent upon successfully completing all project elements
identified for completion prior to September 2008.
C. AGENCY agrees to accept responsibility for increasing the quality of youth
football programming and participation levels over the three year period of time
both through self-operated programs and those provided by independent
organizations.
d. AGENCY agrees to accept responsibility for completing the youth football
inventory and program contact data base as prescribed in Article 1 b.
e. AGENCY agrees to acknowledge NRPA and USA Football in all correspondence
associated with the Hub project.
f. AGENCY agrees to provide additional support for the successful completion of
the project as needed.
3. Key Personnel
The AGENCY shall be responsible for the hiring and directing of the Youth Football Coordinator
position funded through the grant and should act in accordance with AGENCY policies and
procedures and comply with all local, state, and federal laws and regulations governing
employment. The AGENCY is considered to be Key Personnel, (Youth Football Coordinator
and Sr. Administrator) and essential to the work performed hereunder. In the event this person
leaves AGENCY or is reassigned to another program, the AGENCY shall notify NRPA in
writing. Any individual(s) appointed to replace the Key Personnel (Youth Football Coordinator/
Sr. Administrator) must have the written notice to the NRPA within 15 days. If any individual(s)
is not acceptable to NRPA, NRPA reserves the right to terminate this agreement.
The AGENCY will be reimbursed for its costs incurred throug
h such termination date. Under no
circumstances will NRPA reimburse incurred costs in excess of$50,000 annually.
4. Method of Payment
NRPA will pay the AGENCY in accordance with the payment schedule included in this
agreement in Article 4d. NRPA shall reimburse any expenses associated with travel to the annual
project training, reporting, and for any other items outlined in scope of work and follow NRPA
procedures and review upon invoice from the AGENCY. Under no circumstances will NRPA
reimburse incurred costs in excess of$50,000 annually.
Although not anticipated, NRPA and AGENCY agree that NRPA may at any time withdraw
funding for lack of funds or for failure of the grantee to fulfill the provisions of the Agreement
between USA Football and NRPA. Upon such an occurrence, NRPA's obligations to
AGENCY will be terminated and procedures will be followed as specified in Article 12.

AGENCY agrees that it will use funds granted by NRPA in accordance with the terms of this
Agreement and solely for the purposes expressed herein. AGENCY agrees that any amount of
funds used for purposes other than those outlined in this Agreement shall be reimbursed in full
by AGENCY to NRPA.
a. Accountine: The AGENCY shall submit receipts and other documentation to NRPA
on a quarterly basis. In order to be approved, receipts shall be for allowable,
approved costs incurred in accordance with the terms of this Agreement and shall
display expenses by budget category pursuant to budget. NRPA must receive all
receipts and reports of expenditures submitted under this Agreement, no later than
sixty(30) days after the quarterly submission date. An authorized representative of
the AGENCY shall certify that the receipts submitted are the actual costs as recorded
in AGENCY's records and as expended for the Study actually performed in
accordance with the terms of this Agreement.
b. Payment: Payment shall be contingent upon the availability of funding from USA
Football/NFL Youth Football Fund and upon the AGENCIES compliance with the
terms and conditions of this Agreement.
C. Program Audit: The AGENCY agrees to maintain books, records and documents
and other evidence to all costs and expenses incurred under this grant agreement to
the extent and in such detail as will properly reflect all costs and expenses of the
grant project. The books of account and other records which are applicable shall at
all times be available for inspection, review and audit by NRPA and/or USA
Football/NFL to determine proper application and use of all funds paid to or for the
account of the AGENCY.
d. Payment Schedule: NRPA will advance funds to AGENCY annually in the amount
of$50,000. Payments will commence upon the execution of the agreement and
follow accordingly.

5. Reports
The AGENCY shall furnish quarterly reports to NRPA. These reports will cover progress towards
established program and financial goals and outcomes developed at the beginning of each year.
The AGENCY shall furnish a final report within sixty(60) days of termination of this Agreement.

All communications, reports, and notices required or permitted hereunder shall be deemed
sufficiently given if in writing and hand-delivered, recognized national overnight courier, or sent
by registered mail, postage prepaid, return receipt requested, addressed to the parties as follows:

7. General Conditions
The work will be performed in a manner that is consistent with all applicable federal, state, and
local laws and regulations, including but not limited to those related to the use of human subjects
and/or the use of animals in research.
8. Publications and Publicity
The NRPA reserves the sole right to publish the results of the grant Project and to make public
statements regarding the Project. AGENCY agrees to obtain the express consent of NRPA before

providing any information to the public regarding the Project, including but not limited to,
statements to the media.
9. Indemnification
To the extent permitted by law, the PARTIES agree to indemnify the other and its respective
officers, trustees, agents, and employees, Institutional Review Board (hereinafter referred to as
"INDEMNITEES"), and hold them harmless from any and all injury, illness, death, property
damage, claim, lawsuit,judgment, or cause of action which results either in whole or in part from
the negligent acts or omissions of the indemnitor, its officers, trustees, agents, or employees.
Nothing herein shall constitute a waiver of the provisions of the Colorado Governmental
Immunity Act.
10. Insurance
Both PARTIES agree to procure and maintain, at its sole cost and expense, policies of
comprehensive general and professional liability insurance in amounts of not less than
$2,000,000 per incident and $5,000,000 annual aggregate. Each party shall provide the other,
certificates evidencing such coverage upon request.
11. Access to Records
The AGENCY agrees to permit NRPA to inspect records and facilities relevant to the grant
project upon request at reasonable times.
12. Termination
Either NRPA or the AGENCY may terminate this Agreement at any time by giving ninety(90)
days written notice. The AGENCY shall take all reasonable efforts to minimize further costs
upon such notice. In the event of termination, the AGENCY shall return all unused funds to
NRPA; however, NRPA shall remain responsible for all costs incurred up to the date of
termination and for all non-cancelable costs.
13. Governing Law and Notice
This agreement shall be governed by and construed in accordance with the laws of the State of
Virginia. Any action or proceeding between the parties arising out of this Agreement may only be
brought in a state or federal court located in the State of Virginia and the PARTIES hereto agree
to submit to the jurisdiction of the courts in Virginia.
14. Entire Agreement
This Agreement constitutes the entire understanding of NRPA and AGENCY. No changes,
amendments or alterations shall be effective unless in writing and signed by both Parties

This Agreement is the complete agreement of NRPA and the AGENCY and supercedes all prior
understandings regarding the project.
15. Changes
AGENCY agrees that NRPA may make changes to NRPA's grant procedures as necessary,
without previous notice to AGENCY. AGENCY further agrees to cooperate with NRPA in
amending the terms and conditions of this Agreement as necessary for NRPA to meet its
obligations to USA Football.
16. Operational Agreement
AGENCY agrees that NRPA may require AGENCY to execute a separate Operational
Agreement, which will thereby become part of this Agreement. The Operational Agreement will
detail more specific requirements and goals for the AGENCY performance. The AGENCY
agrees that continued funding by NRPA will be subject to the AGENCY'S execution of the
Operational Agreement and its compliance therewith.

their duly authorized representative, all intending to be legally bound hereby, on the dates
indicated below.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE RECREATION
FUND TO BE USED FOR THE PURPOSE OF IMPROVING
YOUTH FOOTBALL OPERATIONS AND INCREASING AWARENESS
AND INTEREST IN THE SPORT
WHEREAS, the National Football League Youth Football Fund ("YFF"), was established
by the National Football League and the National Football Players Association,to promote positive
youth development and ensure the health and future of the sport at the grassroots level; and
WHEREAS,the YFF has supported numerous programs aimed at strengthening America's
youth football movement; and
WHEREAS,USA Football is an independent,non-profit organization,the purpose of which
is to support and promote football at all amateur levels; and
WHEREAS, the National Recreation and Park Association ("NRPA") as part of its grant
agreement with USA Football,has received funds to be sub-granted to community organizations for
the purpose of improving youth football operations; and
WHEREAS,the City's Recreation Division applied for and was recently awarded a sub-grant
from the NRPA for the conduct of a project entitled NRPA/USA Football Hub Grant; and
WHEREAS,the aforementioned sub-grant totals$150,000 and covers the period beginning
October 2006 and ending September 2009; and
WHEREAS,the scope of work covered by the sub-grant includes hiring a full-time program
coordinator responsible for capacity building, increasing community awareness, planning a
community celebration, utilizing resources, completing measurement and assessment information
to further the NRPA's agenda of improving overall youth football operations, and developing and
increasing interest in the sport of football; and
WHEREAS, no local matching funds are required according to the terms of the sub-grant;
and
WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the NRPA/USA Football
Hub Grant funds will not cause the total amount appropriated in the Recreation Fund-NRPA/USA
Football Hub Grant project to exceed the current estimate of actual and anticipated revenues to be
received during the fiscal year; and
WHEREAS,it is the desire of the Council to appropriate the sum of$150,000 in NRPA/USA
Football Hub Grant funds in the Recreation Fund -NRPA/USA Football Hub Grant project to be
used for the purpose of improving youth football operations and increasing awareness and interest
in the sport.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenues in the
Recreation Fund - NRPA/USA Football Hub Grant project the sum of ONE HUNDRED FIFTY
THOUSAND DOLLARS ($150,000), representing grant proceeds from the NRPA/USA Football
Hub Grant, to be used for the purpose of improving youth football operations and increasing
awareness and interest in the sport.
