RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. EXECUTIVE SUMMARY On September 7, 2006, the North Front Range Metropolitan Planning Organization ("MPO") awarded the City a grant of$25,420 to develop the I-25/SH 392 Interchange Improvement Plan. The Plan is identified in the 2006-2007 Work Program for the Advance Planning Department and $50,000 was allocated in the budget to represent the City's share in the joint project. The MPO money was awarded after the project budget was allocated, so this Ordinance is needed to appropriate the unanticipated additional amount of$25,420. BACKGROUND In January 2006, the City of Fort Collins and Town of Windsor entered into an Intergovernmental Agreement to jointly develop a comprehensive development plan for the interchange area of I-25 and State Highway 392. The planning process began in August 2006,with an anticipated 12-month time frame to complete the work. The City of Fort Collins agreed to allocate 50% of the project budget totaling $50,000. To match this amount, the Town of Windsor also allocated $50,000 for Plan development. In coordinating with key stakeholders, the MPO has identified additional available money to contribute to this project in the amount of$25,420. The MPO has expressed an interest in contributing funds for this project to conduct facilitation work between both jurisdictions in developing the Plan. With new growth in Windsor and in southeast Fort Collins in recent years, the capacity of the existing interchange facility has been significantly impacted to the point of failing traffic level of service standards. This in turn triggers the need to provide adequate public facilities in order for new development to proceed adjacent to the Interchange. The Colorado Department of Transportation("CDOT")has identified this interchange facility as a high priority project targeted for full replacement with a new interchange design. However, federal funding is not available now or in the foreseeable future. In 2004, CDOT initiated the Northern Colorado I-25 Corridor October 17, 2006 -2- Item No. 15 Environmental Assessment to look at design alternatives and associated impacts for each interchange along the corridor,including the SH-392 facility. A separate Environmental Overview Study and Access Control Plan by CDOT are in progress for the SH-392 corridor from US- 287/College Avenue west of I-25,to Highway 85 north of Greeley. Carpenter Road/Larimer County Road 32 is planned to become a part of SH-392 later in 2006. The SH-392 Corridor represents a major gateway into the Town of Windsor to the east from I-25 and access west into Fort Collins southern boundary. Both jurisdictions have recognized the need to work together in finding ways to maximize land uses,infrastructure improvements and generation of revenues to support a new interchange. In January 2006, the City of Fort Collins and the Town of Windsor entered into an Intergovernmental Agreement("IGA")regarding land use and development at the Interstate 25 and Carpenter Road/392 interchange.The purpose of the IGA includes the need to cooperate among Fort Collins,Windsor,Larimer County,and the MPO on design and funding interchange improvements. The key elements of the IGA include developing a joint comprehensive plan to combine land use objectives between the two jurisdiction ,] jurisdictions, as well as shared revenues and strategies and funding to support the development proximate to I-25/SH 392 Interchange. An important focus of the Plan will be on the Corridor Activity Center located on both sides of the Interstate. Fundamental to this effort is developing action strategies to implement completion of improvements to the Interstate 25/Highway 392 Interchange, through a concise step-by-step plan. This effort represents a joint project involving Fort Collins and Windsor staff. However,Fort Collins staff will take the lead for project facilitation and management. It is anticipated that area property and business owners will need to be involved throughout this planning process and act as key stakeholders. In addition,close coordination with CDOT,the MPO and the Division of Wildlife is necessary. This Plan will need a well designed citizen participation process that involves concepts of informed consent. The Plan will need to be reviewed by boards and commissions of each jurisdiction, along with work sessions by the Windsor Town Board and Fort Collins Planning and Zoning Board, Fort Collins Transportation Board, City Council and Larimer County. Final adoption of the Plan will require a public hearing with the Windsor Trustees and the Fort Collins City Council. ORDINANCE NO. 178, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE GENERAL FUND TO DEVELOP THE I-25 AND STATE HIGHWAY 392 INTERCHANGE IMPROVEMENTPLAN WHEREAS,in January 2006,the City of Fort Collins and the Town of Windsor entered into an Intergovernmental Agreement("IGA")to jointly develop a comprehensive development plan for the Interchange area of I-25 and State Highway 392 (the"Plan"); and WHEREAS,the Plan represents a joint project involving Fort Collins and Windsor staff,with Fort Collins staff taking the lead for project facilitation and management; and WHEREAS,the City of Fort Collins and the Town of Windsor have each allocated$50,000 for the Plan development project; and WHEREAS, the North Front Range Metro Planning Organization ("MPO") expressed interest in contributing funds for the Plan development project to conduct facilitation work in developing the Plan; and WHEREAS, the MPO awarded the City of Fort Collins a grant in the amount of$25,420 to develop the I-25 and State Highway 392 Interchange Improvement Plan; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for the fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the grant funds from the MPO as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from unanticipated grant revenue in the General Fund the sum ofTWENTY-FIVE THOUSAND FOUR HUNDRED TWENTY DOLLARS($25,420)for expenditure in the General Fund to develop the I-25 and State Highway 392 Interchange Improvement Plan. .__ .._...._.._...
