SUBJECT
First Reading of Ordinance No. 186, 2006, Appropriating Unanticipated Revenue in the Capital
Projects Fund- Inspiration Playground Capital Project to Be Used for Design and Construction of
a Fully Accessible Playground for All Children at Spring Canyon Community Park.
RECOMMENDATION
Staff recommends the adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
The community is donating funds to help build a playground at the Spring Canyon Park that will be
fully accessible to all children. The total construction cost for the playground, including the water
splash park, is $1,195,000. The City has $475,000 available for the playground from the park
construction budget. Contributions, totaling $720,000, include $200,000 from a Great Outdoors
Colorado("GOCO")grant,$250,000 from the Colorado Eagles Foundation,and$270,000 from the
All Children Together("ACT") fund raising efforts. This ordinance appropriates $720,000 in the
Capital Projects Fund - Inspiration Playground capital project from the aforementioned funding
sources.
Annual operation and maintenance costs for the playground are budgeted at $5,000.
EXECUTIVE SUMMARY
This totally accessible playground will ensure that children of all abilities will be able to play side-
by-side. No child will be left out at this playground. The playground will have a rubberized surface
for accessibility, enhanced play equipment that allows children to play together throughout the
playground with unique sensory and audio features. The water splash park will be barrier-free for
the enjoyment of all children.
The community fund raising effort includes$250,000 in matching money from the Colorado Eagles,
a$200,000 Great Outdoors Colorado grant, and numerous donations from citizens,businesses and
community organizations.
On September 16,2003,City Council adopted Resolution 2003-103 supporting the development of
the Inspiration Playground.
ORDINANCE NO. 186, 2006
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS
FUND - INSPIRATION PLAYGROUND CAPITAL PROJECT TO BE USED FOR
DESIGN AND CONSTRUCTION OF A FULLY ACCESSIBLE PLAYGROUND
FOR ALL CHILDREN AT SPRING CANYON COMMUNITY PARK
WHEREAS,Spring Canyon Park represents the sixth community Park developed by the City
of Fort Collins (the "City"); and
WHEREAS, City community parks are developed with large playgrounds that contain a
variety of play equipment, constructed to comply with the guidelines contained in the Americans
with Disabilities Act, that can be enjoyed by children of all ages; and
WHEREAS, the vision of the City and the community has been to construct a universally
accessible playground at a City park that would integrate play and socializing between able-bodied
children and children with disabilities; and
WHEREAS,on September 16,2003,City Council adopted Resolution 2003-103 supporting
the development of a 100%universally accessible playground as part of the City's park system; and
WHEREAS, the estimated cost to design and construct a totally accessible playground at
Spring Canyon Community Park ("Inspiration Playground") is $1,195,000; and
WHEREAS,the scope of improvements at Inspiration Playground will include a rubberized
surface for accessibility, enhanced play equipment with unique sensory and audio features, and a
barrier-free water splash park; and
WHEREAS,the City and the All Children Together("ACT")group applied for and received
a Great Outdoors Colorado Trust Fund ("GOCO") grant to help fund improvements for the
Inspiration Playground; and
WHEREAS,the City Council adopted Resolution 2005-093,on August 16,2005,authorizing
the City Manager to enter into a grant agreement with the GOCO state board obligating the City to
use $200,000 in grant proceeds for construction of the Inspiration Playground at Spring Creek
Community Park; and
WHEREAS, funding sources for the remaining cost of improvements for Inspiration
Playground, totaling $995,000, have been identified as follows:
Spring Canyon Community Park Existing Appropriations $ 475,000
Colorado Eagles Foundation 250,000
All Children Together(ACT) Fund-raising 270,000
Total $ 995,000
WHEREAS,Under Article V,Section 9 of the Charter of the City of Fort Collins permits the
City Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS,City staff has determined that the appropriation ofthe proceeds from the GOCO
grant, the contribution from the Colorado Eagles Foundation, and fund-raising receipts from ACT
will not cause the total amount appropriated in the Capital Projects Fund - Inspiration Playground
capital project to exceed the current estimate of actual and anticipated revenues to be received during
the fiscal year; and
WHEREAS, it is the desire of the City Council to appropriate the sum of $720,000,
representing the proceeds from a GOCO grant($200,000),a contribution from the Colorado Eagles
Foundation($250,000), and contributions ($270,000) from the Fund-raising efforts of ACT, upon
receipt, to be used for design and construction of a fully accessible playground for all children at
Spring Canyon Community Park.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Capital Projects Fund - Inspiration Playground capital project, the sum of SEVEN HUNDRED
TWENTY THOUSAND DOLLARS ($720,000), upon receipt from the following sources:
Great Outdoors Colorado (GOCO) Grant Proceeds $ 200,000
Colorado Eagle Foundation Contribution 250,000
All Children Together(ACT) Fund-raising 270,000
Total $ 720,000
to be used for design and construction of a fully accessible playground for all children at Spring
Canyon Community Park.
