EXECUTIVE SUMMARY This Ordinance, unanimously adopted on First Reading on March 2, 2010, transfers $1,881,271 in existing appropriations from the Street Oversizing Fund into the Capital Projects Fund for construction of the College Avenue and Willox Lane Improvement Project to construct arterial improvements related to the Marketplace development. The improvements are needed to construct College Avenue to current City standards and to provide bicycle, pedestrian and bus facilities. Improvements to Willox Lane will add dedicated turn lanes and construct new commercial access for the development. The project is jointly funded by the North College Urban Renewal Authority, the Street Oversizing Program, and developer contributions. BACKGROUND / DISCUSSION The Marketplace development is located-owthe nort eh ast corner-of North College Avenue and Willox Lane. It is a large commercial shopping center with a King Soopers grocery store as\theanchor tenant. There will be significant and beneficial financial impacts to both the City and the Fort-Collins Urban Renewal Authority(URA). The item before Council at this time is the•final funding portion from the City's Street Oversizing Program necessary for the City to construct the arterial roadway improvements as a Capital Project. North College Avenue, adjacent to the Marketplace development,is missing significant transportation facilities. Although there are four travel lanes,there are no left turn lanes, bicycle lanes or pedestrian facilities. Willox Lane was originally constructed as a collector roadway and was reclassified as a minor arterial in 1984. It is deficient in auxiliary turn lanes and pavement structure. Proposed improvements to North College Avenue include curb and gutter, sidewalks, bike lanes and landscaped medians. Improvements to Willox include sidewalks, landscaped parkways, repaving, and the construction of a modern roundabout at the entrance of the Marketplace and the existing commercial center to the south. On September 16, 2008, the URA Board approved Resolution No. 011, authorizing an agreement between the URA and 1908 North College, LLC to provide financial assistance for the North College Marketplace. The City and the URA entered into an intergovernmental agreement on August 15, 2006, allowing the City to advance funds in the form of a loan to the URA in support of its activities. On April 21, 2009, the form of the loan was approved by Council and accepted by the URA Board. On May 5,2009, Council adopted an appropriation ordinance,which transferred$2,812,620 in funding from the URA into a City Capital Project account for the-design and-construction-of the improvements. �/ /�� I�l `�r // Council also adopted an ordinance authorizing the use ofieminent domain to acquire rights-of way to construct the project, if necessary. The developer of the 4Marketpiace. has dedicated the necessary property abutting the development for the planned street improvern'ents�Staff has;negotiated in good faith with all affected owners and has obtained the rights-of-way and construction easements necessary for the construction of the project. March 2, 2010 -2- ITEM 12 In order to accommodate the anticipated increase in traffic flow and to ensure the safety of the public, it is necessary that these improvements be constructed prior to the opening of the Marketplace development in 2011. FINANCIAL IMPACT This Ordinance transfers existing appropriations budgeted in the Street Oversizing Fund to the Capital Projects Fund- North College Avenue and East Willox Lane project. It is anticipated the impact fees from the Marketplace development will cover a significant portion of the project costs. Asphalt is a petroleum product,concrete is a mined and processed limestone,and both construction products use mined aggregates mechanically crushed and washed. Using recycled materials will reduce the use of virgin materials by 10%to 15%. This project will install bicycle, pedestrian and transit facilities in an area that had none. Additional turn lanes on Willox will reduce congestion in the short term, but only slow the rate of congestion for the long term. /ram �� 1 n. This project will increase traffic and pedestrian safety along this busy)corridor�nd make access to businesses safer by restricting dangerous turning movements. This project is an important economic benefit to the City and the URA. As the first URA tax increment development, this large commercial project will provide the initial funding for the URA, leveraging funds for further economic redevelopment of the North College Corridor. Staff has met with each individual property owner affected by the proposed construction. The project design process has been enhanced by several meetings with the North Front Range Business Owners Association and coordination with design efforts of the North College Building on Basics Project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the unexpended and unencumbered appropriated amount of ONE MILLION EIGHT HUNDRED EIGHTY-ONE THOUSAND TWO HUNDRED AND SEVENTY-ONE DOLLARS ($1,881,271) is hereby authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund and appropriated therein for the North College Avenue and East Willox Lane Improvements project.
