RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY Following a detailed analysis and review,the City Manager has decided to implement some changes to the City's internal organizational structure. These changes impact some of the existing service areas and result in a new reporting structure. This Ordinance,unanimously adopted on First Reading on January 16, 2007, updates to related provisions of the City Code. Since First Reading,refinements have been made to better reflect the terminology that will be used by the City Manager in designating subdivisions of the City organization. A revision to Section 2- 494 has also been added to clarify that the City Clerk will be responsible to the City Manager or his or her designee. ATTACHMENTS 1. BACKGROUND In August 2006, the firm, Management Partners, was retained by the City to review the organizational structure of the City government. The initial focus of the study centered on potential changes and related efficiencies within Transportation Services (TSA), Utilities and CPES. The consultant team used a combination of techniques to assess the current organizational design; individual interviews, focus groups and an online survey were used to gather employee input, and the structure and best practices of 16 benchmark cities were examined. Under the current structure,the er h tPeesponsi tyii ne key recommendation made by the consultant team is to re ce the berhe City Manager. This will be accomplished by assigning the ut C M gor operations and the Assistant City Manager responsibility for internal services. As a reschange,the City Manager will be better able to focus on the goals and priorities of the City Council, regional partnerships and strategic leadership of the organization. Under the new structure, a new Community Services Area directed by Deputy City Manager will include functions currently found in Transportation Services (TSA), Community Planning and Environmental Services (CPES), and Cultural, Library and Recreational Services (CLRS). (One exception to this is library services, which will transition to the new library district in early 2007.) January 16, 2007 -2- Item No. 15 The City Manager is also implementing additional structural changes within the various departments in order to maximize services and efficiencies. A second recommendation speaks to the need for the City to designate significant attention to the area of financial management. Presently,the Deputy City Manager has responsibility for budget and finance and, as noted above, this role will change. A new Chief Financial Officer(CFO)position will be created and report directly to the City Manager. This individual will be responsible for a Financial Services area that includes Finance, Budget and Economic Development. This change integrates the traditional finance and budgeting functions with the economic future of the community. The third key recommendation addresses the structure of Utility Services. Currently, the Utilities General Manager has eight direct reports, including the four operating areas of the major utilities. This is a significant number of direct reports, given the complexity and specialty of the operations. Much of the opportunity for efficiency and operational savings in the future will be dependent on regional cooperation, shared faili use an otentiall eventual consolidation. The General Manager, whose title will be cov irector, ill focus on external relationships, long-term partnerships, and strategic utility issues. As a result of the above changes, five positions and related functions will report directly to the City Manager: 1. Deputy City Manager—Community Services 2. Assistant City Manager—Internal Services 3. Chief Financial Officer—Financial Services 4. Utilities Executive Director—Utility Services 5. Chief of Police—Police Services These changes result in the creation of three new service areas — Community Services, Internal Services and Financial Services-and the elimination of TSA,CPES and CLRS as individual service areas. Financial Impact The new Utility Services position will be funded by the four utility enterprise funds (Water Fund, Wastewater Fund,Light&Power Fund and Stormwater Fund). A detailed position analysis has not yet been completed, however, it is anticipated that the impact on the four enterprise funds will be minimal. The impact of the new CFO position on the General Fund will be nominal. This change is essentially"revenue neutral'because funding for the CFO will come from the savings realized by January 16, 2007 -3- Item No. 15 having one fewer service area director position. The proposed reorganization would not abolish any of those essential functions and services. The organizational structure of the City is contained in Chapter 2, Article V of the City Code. The service areas are established in Division 3 of Article V. This Ordinance would amend Division 3 to codify the organizational changes described above. It would also allow for those changes to be implemented gradually,through December 31,2007,in such manner and order as the City Manager deems appropriate. ATTACHMENTS 1. City of Fort Collins Pro 'on ORDINANCE NO . 005 , 2007 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING CHAPTER 2 , ARTICLE V, DIVISION 3 OF THE CODE OF THE CITY OF FORT COLLINS PERTAINING TO CITY SERVICE AREAS WHEREAS , under Article II, Section 5 of the City Charter, the City Council has the power to establish, change, consolidate or abolish administrative offices, service areas or agencies of the City by ordinance, upon report and recommendation of the City Manager, so long as the administrative functions and public services established by the Charter are not abolished in any such reorganization; and WHEREAS , the organizational structure of the City is contained in Chapter 2, Article V of the City Code; WHEREAS , Division 3 of Article V establishes the service areas of the City; and WHEREAS , the City Manager recently retained the services of an outside consultant to review the organizational structure of the City and make recommendations as to any changes that might enhance the efficiency and cost effectiveness of City operations ; and WHEREAS , after considering the consultant's report and recommendations, the City Manager is proposing that the number of persons directly reporting to the City Manager be reduced, that the operations of certain service areas be consolidated, that certain organizational changes be made in the area of financial management and Utility Services ; and WHEREAS , the City Manager has further recommended that the proposed changes be implemented throughout the upcoming fiscal year, as finances and personnel permit, so as to allow for an orderly and effective transition from the existing structure; and WHEREAS , the Council believes that the organizational changes recommended by the City Manager and the phased implementation of those changes are in the best interests of the City and will further enhance the efficiency and cost effectiveness of City operations . NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows : Section 1 . That Chapter 2 , Article V, Division 2 , Section 2-494 of the Code of the City of Fort Collins is hereby amended to read as follows : Sec. 2-494. Office of the City Clerk; duties of the City Clerk. The Office of the City Clerk shall be under the direction of the City Clerk, who shall be appointed in accordance with Article II, Section 12 of the Charter and who shall be direet}y-responsible to the City Manager or his or her designee for giving notice of City Council meetings ; keeping a journal of City Council proceedings; authenticating by his or her signature, and permanently recording in full, all ordinances and resolutions; and performing all other duties required by the Charter, this Code or by the City Manager. Section +2 . That Chapter 2, Article V, Division 3 of the Code of the City of Fort Collins is hereby amended so as to read in its entirety as follows : DIVISION 3 , SERVICE AREAS Sec . 2-500. Community Services ; duties of Director. Community Services is hereby created. Community Services shall be in the charge of a Director who shall be directly responsible to the City Manager for the functions and duties most directly involved in the provision of external services to the community and who shall have control and supervision over such firer agencies, service units, departments, offices or persons as maybe assigneel deemed appropriate by the City Manager. Sec . 2 -501 . Financial Services ; duties of Director. Financial Services is hereby created. Financial Services shall be in the charge of a Chief Financial Officer who shall be directly responsible to the City Manager for the functions and duties of the Financial Officer as provided in Article V, Part III, Section 22 if the Charter and such meter agencies, service units, departments, offices or persons as may be assigned deemed appropriate by the City Manager. Sec. 2-502. Internal Services ; duties of Director. Internal Services is hereby created. Internal Services shall be in the charge of a Director who shall be directly responsible to the City Manager for the functions and duties necessary to provide internal services to the City organization, and who shall have control and supervision over such other agencies, service units, departments, offices or persons as may be assigned deemed appropriate by the City Manager. Sec. 2-503. Police Services. (a) Chief; duties. Police Services is hereby created. Police Services shall be under the immediate supervision and control of the Chief of Police, who shall be directly responsible to the City Manager for the functions and duties necessary to preserve the public peace, prevent crime, apprehend criminals and protect the rights of persons and property through the enforcement of the penal laws of the State, all ordinances and regulations of the City, and the provisions of the Charter. The Chief of Police shall also perform such other duties as the City Manager may prescribe for -2- the public peace and safety and the protection of property, including the property of the City within and without the corporate limits, and shall cooperate with local, state and federal law enforcement officials . (b) Police officers. ( 1 ) All police officers shall be authorized to enforce the provisions of this Code and may be assigned to such positions or special duties as the Chief of Police and the City Manager may deem to be in the best interests of Police Services . Such special assignments may or may not limit the enforcement authority of such officers . Any such limitation shall be specified in writing within the commissions of the officers by the Chief of Police . (2) For the purposes of the enforcement of this Code and the preservation of public peace, certain individuals, whether or not employed by the City, may be appointed by the Chief of Police as special police officers to enforce particular provisions of this Code, and as peace officers to enforce particular provisions of the state law; provided, however, that such officers shall be given only such limited authority with respect to enforcement as is set forth in the administrative regulations relative thereto, which shall be adopted by the Chief of Police . Such appointment, in and of itself, shall not constitute employment with the City. (c) Issuance of concealed weapons permits. ( 1 ) The Chief of Police is authorized to issue permits to persons for the carrying of concealed weapons . Such permits shall be conditioned upon reasonable terms for the protection of the public safety and welfare . (2) The Chief of Police shall promulgate rules and regulations to implement the issuance of concealed weapons permits, providing for, among other things, a background check of each applicant, a determination of the need of each applicant to be issued a concealed weapons permit and a determination of the proficiency of each applicant in the care and use of any weapon the applicant may carry. (3 ) Each person issued a concealed weapons permit shall sign an agreement to indemnify and to hold the City, its officers, agents and employees harmless from any loss or damage legally imposed upon them as a result of the act or omission of the permit holder. Such indemnification shall include any judgment rendered against the City, its officers, agents and employees or any of them, together with costs of suit and cost of defense . (4) Each permit issued shall be valid for a period of one ( 1 ) year from the date of issuance unless a lesser period of time is specified on such permit. -3 - (5 ) Each permit issued shall be subject to revocation by the Chief of Police for violation of any state statute, City ordinance or rule and regulation pertaining thereto promulgated by the Chief of Police. (6) Each applicant for a concealed weapons permit shall pay an application fee of one hundred dollars ($ 100 . ) which shall be nonrefundable . A fee of sixty dollars ($ 60 .) shall be charged for the annual renewal of any permit. Sec. 2 -504. Utility Services ; duties of Director. Utility Services shall be and is hereby created. Utility Services shall be in the charge of a Director who shall be directly responsible to the City Manager for the functions and duties of Utility Services, including, without limitation, the functions and duties necessary to provide for the design, construction, reconstruction, addition, repair, replacement, operation and maintenance of the City's electric, water, wastewater and stormwater utility services, and shall have control and supervision over such otter agencies, service units, departments, divisions, offices or persons as may be assigne deemed appropriate by the City Manager. Secs. 2-505 - 2-514. Reserved. Section 23 . That the City Manager is hereby authorized and directed to implement the foregoing organizational structure, at such time and in such manner and order as he deems appropriate, but no later than December 31 , 2007 .
