RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT The total cost of the proposed capital expenditures amounts to $2,474,832, which will be 100% funded with ARRA dollars. No local matching funds are required from the City and there are no related operating and maintenance costs associated with the capital expenditures. Federal funding will be channeled through the Federal Transit Administration (FTA), via the Urbanized Area Formula Program (49 U.S.C. Section 5307), of which the City of Fort Collins is a designated recipient of funds. EXECUTIVE SUMMARY The City of Fort Collins has received American Recovery and Investment Act of 2009 (ARRA) stimulus funding to purchase six NABI 40-foot Low Floor Compressed Natural Gas (CNG) replacement buses and several Proximity Card Readers in 2009. The buses will replace the oldest model vehicles and are a timely addition to an aging fleet. The addition will increase the CNG fleet component to 10 buses (37%) in an era when sustainability is a priority. ARRA stimulus funding was also received to purchase Proximity Card Readers for the current fleet of vehicles to facilitate the use of CSU student IDs as legitimate fare media. BACKGROUND The American Recovery and Reinvestment Act, 2009, signed into law by President Barack Obama on February 17, 2009, includes $8.4 billion for transit capital improvements. This law implements the transit formula program related provisions of the ARRA and provides program and grant application requirements for these funds, to be made available through Federal Transit Administration (FTA) assistance programs. October 20, 2009 -2- Item No. 12 ARRA funding in the amount of$2,433,792 will be used to replace six older model, heavy duty Gillig buses with six ADA accessible, NABI, 40-foot, low-floor alternative fueled replacement buses. These new buses will also include 3 position bicycle racks to encourage bike-on-bus use. The older model Gillig buses have an average of 536,000 lifetime miles accumulated. Already at least 15 years old, these buses exceed the Federal Transit Administration 12-year transit bus life cycle. Traveling more than 100 miles a day, 6 days a week, Transfort buses are a constant fixture of the Fort Collins transportation network. The replacement of these older vehicles will reduce CO2 emissions by over 50% per vehicle and ensure Transfort's ability to provide reliable service to Northern Colorado and reduce the maintenance costs associated with putting these vehicles in service each day. Replacing six aging vehicles with today's improved engines and advanced fuel technology will have immediate and sustainable emissions impacts. Also,ARRA funding in the amount of$41,039 will be used to purchase Proximity Card Readers for Transfort's fixed route fleet of buses. These Readers will enable CSU students to utilize their student identification(RAM Card)as Transfort annual bus passes. The major benefits of this project are ease of use, increased student ridership and lower operating costs for Transfort. This Ordinance appropriates unanticipated revenue from the FTA in the amount of$2,474,832. There is no required local match and there are no related operating and maintenance costs or FTE additions associated with this funding. ORDINANCE NO. 102, 2009 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE FROM THE AMERICAN RECOVERY AND REINVESTMENT ACT TO THE TRANSIT FUND WHEREAS, the American Recovery and Reinvestment Act("ARRA"), signed into law by President Barack Obama on February 17, 2009, included $8.4 billion made available for transit capital improvements; and WHEREAS,the City has received$2,474,832 in ARRA funds("ARRA Funds")that do not require local matching funds; and WHEREAS, $2,433,792 of the ARRA Funds will be used to replace the oldest model vehicles in the Transfort fleet, consisting of heavy duty Gillig buses, with six NABI 40 foot low- floor Compressed Natural Gas ("CNG") replacement buses; and WHEREAS, the addition of these new buses will increase the City's CNG fleet component to ten buses and demonstrate the City's commitment to sustainability; and WHEREAS, the remaining $41,040 of ARRA Funds will be used to purchase Proximity Card Readers for Transfort's fixed route fleet of buses to facilitate the use of Colorado State University student identification badges as legitimate fare media; and WHEREAS,Article V, Section 10, of the City Charter authorizes the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,-City staff has determined that the appropriation of the revenue as described herein will not cause the total amount appropriated in the Transit Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during any fiscal year. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from unanticipated revenue from the American Recovery and Reinvestment Act in the Transit Fund the sum of TWO MILLION FOUR HUNDRED SEVENTY FOUR THOUSAND EIGHT HUNDRED THIRTY TWO DOLLARS ($2,474,832 for expenditure in the Transit Fund. Introduced, considered favorably on first reading, and ordered published this 20th day of October, A.D. 2009, and to be presented for final passage on the 3rd day of November, A.D. 2009.
