RECOMMENDATION Staff recommends adoption of this Ordinance on Second Reading. EXECUTIVE SUMMARY This Ordinance,unanimously adopted on First Reading on September 1,2009,changes the Cemetery Rules and Regulations to allow green burials at Roselawn Cemetery. Unlike Grandview Cemetery, Roselawn has land that can be dedicated to green burials. The other changes to the Rules and Regulations are simple housekeeping measures.The last major update was completed in May 2005. ATTACHMENTS 1. Green burials are burials without embalming, _without a burial vault,using a casket made'of==non-toxic,biodegradable material or a biodegradable burial shroud. The surfaces of the graves are unadorned, unirrigated turf with simple memorial markers. The adoption of this Ordinance changes the Cemetery Rules and Regulations to allow green burials at Roselawn Cemetery. Unlike Grandview Cemetery, Roselawn has land that can be dedicated to green burials. The other changes to the Rules and Regulations are simple housekeeping measures. The last major update was completed in May 2005. BACKGROUND T 7`efor \ 7\ 7T � � � � . � l� There has been increasing interests in nine&.ommj nitgree burials. Two funeral homes in the JL community are certified Green Funeral Homes. The Cemetery will develop a new Garden of Harmony at Roselawn for green burials. Green burials will be allowed at Roselawn Cemetery in the Garden of Harmony section only. Green burials are described as burials without embalming, without a burial vault,using a casket made of non-toxic,biodegradable material or a biodegradable burial shroud. The requesting party must waive any right of disinterment of the remains. The grave size will be 6 ft. by 10 ft., memorials will be flat (grass marker) not larger than 2 ft. by 1 ft. by 4- inch, granite only. No floral vases will be allowed. The section will not be irrigated and maintenance will be minimal. No plantings of any kind will be allowed. September 1, 2009 -2- Item No. 12 • Change CLRS to CPRE, Culture, Parks, Recreation and Environment. • Provide that the City Manager establishes rates, fees and charges (instead of City Council) and directs their expenditure. • Add the words "except green burial" in the burial receptacle requirements. • Change the shape of the insignia on the crypt shutters. • Omit the word "bonded" when referring to monument dealers. • Add the name of"Harmony"to the list of sections that have flat monuments. • Give future sections at Roselawn names instead of numbers. • Omit 14.3.11 (dealing with the type of memorials and monuments allowed in burial Section 6) as it is addressed in a,previous rule. �(�� • Change the word `"lot"lto "burial space"11n se' �ctioh 14 3. 1'S. • State that the Garden of Harmony will have no concrete used in the setting of memorials. • Amend Sections 11.24, 12 2'1-'1e2.3, 1-26, and�12.7 to clarify requirement for interment and disinterment of cremated remains. Rules and Regulations for the Operation of Municipal Cemeteries ORDINANCE NO. 088, 2009 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING UPDATED RULES AND REGULATIONS GOVERNING GRANDVIEW AND ROSELAWN CEMETERIES TO ALLOW GREEN BURIALS AT ROSELAWN AND TO MAKE MINOR LANGUAGE IMPROVEMENTS WHEREAS, the City operates two cemeteries, Grandview Cemetery and Roselawn Cemetery ("Roselawn") (collectively "the Cemeteries") as part of its Culture, Parks, Recreation and Environment Service Unit ("CPRE"); and WHEREAS, the current rules and regulations for the operation of the Cemeteries (the "Regulations") were adopted by the City Council in 1996, were repealed and readopted in 2004, and amended in 2005; and WHEREAS, there is increasing public interest in low-impact or "green" burials, including burials without embalming or burial vault, using a casket made of non-toxic, biodegradable materials or a biodegradable burial shroud ("Green Burials"); and WHEREAS, in response to the public interest in Green Burials, City staff has developed a plan for a new Garden of Harmony at Roselawn, which would be a suitable site for Green Burials; and WHEREAS, the Regulations in their current form include requirements that preclude the use of Green Burials in the Cemeteries; and WHEREAS, in order to move forward with the proposed Garden of Harmony at Roselawn, it is necessary for the Regulations to be amended to provide for and govern Green Burials at Roselawn; and WHEREAS, in its review of the Regulations, staff has also identified a number of revisions that are needed to correct outdated references, and minor inconsistencies with standard and appropriate practices at the Cemeteries; and WHEREAS, CPRE staff has prepared an updated version of the Regulations that would accomplish these various updates and corrections, and would allow the planned use of Green Burials at the Garden of Harmony at Roselawn; and WHEREAS, a copy of the Regulations showing the proposed amendments is on file in the City Clerk's Office and dated August 26, 2009. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Rules and Regulations Governing Grandview and Roselawn Cemeteries are hereby amended in the manner shown in the form that is on file in the City Clerk's Office and dated August 26, 2009.
