Second Reading of Ordinance No. 130,2009, Appropriating Unanticipated Revenue in the Capital Projects Fund for
the Fort Collins Museum/Discovery Science Center Joint Facility Project.
EXECUTIVE SUMMARY
The City will receive $200,000 from the Energy and Mineral Assistance Program through the Colorado Department
of Local Affairs to facilitate the environmental site improvements for the Fort Collins Museum and Discovery Science
Center Joint Facility. The City will also receive $200,000 from the Brownfields Revolving Loan Fund through the
Colorado Housing and Finance Authority in support of the environmental site cleanup for this project. A commitment
of$3,000,000 was received from the Downtown Development Authority supporting the construction of the new Fort
Collins Museum and Discovery Science Center Joint Facility. A Grant Agreement with the Downtown Development
Authority will be completed as required. The Ordinance,unanimously adopted on First Reading on December 1,2009,
appropriates a total of$3,400,000 in the Building on Basics (BOB), New Museum Facility Project.
STAFF RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.

A commitment of$3,000,000 was received from�th Downtown Development Authority, in support of the new Fort
Collins Museum and Discovery Science Center Joint Facility.
BACKGROUND / DISCUSSION
On August 18, 2009, the Fort Collins Museum and Discovery Science Center received written notice that it had been
awarded$200,000 from the State of Colorado, Department of Local Affairs, Energy and Mineral Assistance Program.
The Fort Collins Museum and Discovery Science Center's Joint Facility Project is located at the corner of Mason and
Cherry Streets. Two environmental studies demonstrated soil contamination of hydrocarbons and friable and non-
friable asbestos. Support from the State of ColoradoDepartT ent of ocal Affairs, Energy and Mineral Assistance
Program will support environmental site'improve�m`ents.
In September 2009,the City of Fort C Ilinsreceived written notice that it had.been awarded a grant award of$200,000
from the Colorado Brownfields Revolving Loan Fund, by and through the Colorado Housing and Finance Authority.
This award supports environmental site cleanup of the new facility site for the Fort,Collins Museum and Discovery
Science Center.
In April 2004, the Fort Collins Museum received notification that the Fort Collins Downtown Development Authority
would support the building project with a $1,000,000 pledge. In May 2009 the Fort Collins Museum and Discovery
Science Center received notification that the Fort Collins Downtown Development Authority had approved an additional
commitment of$2,000,000 toward the construction of the Fort Collins Museum and Discovery Science Center Joint
Facility.

ORDINANCE NO. 130, 2009
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE
CAPITAL PROJECTS FUND FOR THE FORT COLLINS MUSEUM/DISCOVERY SCIENCE
CENTER JOINT FACILITY PROJECT
WHEREAS, on November 1, 2005, Fort Collins voters passed Ordinance No. 092, 2005,
approving the "Building on Basics" ("BOB") tax for certain capital projects; and
WHEREAS, included in the BOB capital projects is $6,000,000 for construction of a new
combined-use facility in the Fort Collins downtown area for the Fort Collins Museum and the
Discovery Science Center; and
WHEREAS, this facility will be jointly owned, managed, and funded by the City and
Discovery Science Center and will expand the educational experience of City residents by providing
a broader array of scientific,cultural and historical exhibits in a single location,and will also provide
an exciting new City amenity; and
WHEREAS, the Fort Collins Museum and Discovery Science Center have been awarded
$200,000 from the State of Colorado, Department of Local Affairs,Energy and Mineral Assistance
Program; and
WHEREAS, two environmental studies have been completed at the site of the Fort Collins
Museum& Discovery Science Center Facility that have shown soil contamination of hydrocarbons
and friable and non-friable asbestos; and
WHEREAS, the State of Colorado Energy and Mineral Assistance'Program grant will help
pay for the necessary environmental site improvements; and
WHEREAS,the City has been awarded a grant of$200,000 from the Colorado Housing and
Finance Authority; and
WHEREAS, this grant will be used for environmental site cleanup at the new Fort Collins
Museum & Discovery Science Center site; and
WHEREAS,the Downtown Development Authority has approved a$3,000,000 commitment
to help fund the construction of the Fort Collins Museum&Discovery Science Center Joint Facility;
and
WHEREAS, Article V, Section 9, of the City Charter permits the City Council to make
supplemental appropriations by ordinance at any time during the fiscal year, provided that the total
amount of such supplemental appropriations,in combination with all previous appropriations for that
fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received
during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the revenue as described
herein will not cause the total amount appropriated in the Capital Projects Fund to exceed the current
estimate of actual and anticipated revenues to be received in that fund during any fiscal year.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Capital Projects Fund the sum of THREE MILLION FOUR HUNDRED THOUSAND DOLLARS
($3,400,000)to be used for the Building on Basics-Fort Collins Museum/Discovery Science Center
Joint Facility Project.
Introduced, considered favorably on first reading, and ordered published this 1st day of
December,`A.D. 2009, and to be presented for final passage on t 5th day of December, A.D.
