SUBJECT
Second Reading of Ordinance No. 103, 2006, Calling a Special Municipal Election on September
12, 2006 and Authorizing the Conduct of Said Election as a Mail Ballot Election.
RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
On May 19, 2006, the City Clerk's Office received an initiative petition to amend the City Charter
relating to collective bargaining. The Clerk's Office has completed its review of the petition and has
determined that the petition contains a sufficient number of signatures to place the initiated measure
on a special election ballot. Pursuant to C.R.S. 31-2-210(4),if the petition is certified as sufficient
by the City Clerk,the election must be held as near as possible to the approximate date stated in the
petition(September 12,2006). This Ordinance,unanimously adopted on First Reading on June 6,
2006, calls for the election to be held on September 12, 2006 and authorizes the election to be
conducted as a mail ballot election.

Staff estimates that the cost of this s ecial election will be $100,000.

On May 19, 2006, the City Clerk's Office received an initiative petition to amend the City Charter
relating to collective bargaining. The Clerk's Office has completed its review of the petition and has
determined that the petition contains a sufficient number of signatures to place the initiated measure
on a special election ballot. Pursuant to C.R.S. 31-2-210(4),if the petition is certified as sufficient
by the City Clerk,the election must be held as near as possible to the approximate date stated in the
petition(September 12, 2006). A Resolution submitting the measure to the voters will be brought
to Council at an adjourned meeting on June 13.
ORDINANCE NO. 103, 2006
OF THE COUNCIL OF THE CITY OF FORT COLLINS
CALLING A SPECIAL MUNICIPAL ELECTION ON
SEPTEMBER 12, 2006 AND AUTHORIZING THE
CONDUCT OF SAID ELECTION AS A MAIL BALLOT ELECTION
WHEREAS, a group of local citizens circulated an initiative petition to amend the City
Charter relating to collective bargaining; and
WHEREAS, the petition was submitted to the City Clerk on May 19, 2006; and
WHEREAS, the City Clerk has determined that the petition contains a sufficient number of
signatures to require Council to place the issue on a special election ballot; and
WHEREAS, C.R.S. 31-2-210(4) requires that the election be held as near as possible to the
approximate date stated in the Petition, which is September 12, 2006; and
2006. WHEREAS, the City Council wishes to call a special municipal election on September 12,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That a special municipal election in the City of Fort Collins is hereby called
for Tuesday, September 12, 2006.
Section2. That the provisions of the Uniform Election Code(C.R.S.,Title 1,Article 7.5,
also known as the"Mail Ballot Election Act")pertaining to mail ballot elections for the conduct of
the September 12, 2006 special municipal election are hereby adopted by the Council for said
election, except that, to the extent that any provisions of the Mail Ballot Election Act pertaining to
the preservation of election records conflict with Title 31, Article 10 of the Colorado Revised
Statutes (the "Municipal Election Code"), the provisions of the Municipal Election Code shall
prevail.
Section3. That the provisions of C.R.S. 1-11-203.5 relating to contests concerning ballot
order or ballot title are hereby adopted by the Council for said election.
Section 4. That the City Clerk is hereby authorized to forthwith submit to the Colorado
Secretary of State a proposed plan for conducting the mail ballot election pursuant to the provisions
of the Mail Ballot Election Act and to follow the other procedures in the Act with regard to the
conduct of the election.
Section 5. That the registered voters of the City of Fort Collins shall have an opportunity
to cast ballots in person as provided by the Mail Ballot Election Act,at a polling place located at the
City Clerk's Office, 300 LaPorte Avenue, Fort Collins, Colorado.
Section 6. That the use of an electronic system to record the votes at said election is
hereby authorized.

A.D. 2006, and to be presented for final passage on the lath day of July, A.D. 2006.
