RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY The Fort Collins Library Board has indicated it no longer wishes to meet and recommends disbanding the Board, effective immediately. This Ordinance, unanimously adopted on First Reading on February 6, 2007, dissolves the Library Board. ATTACHMENTS 1. Copy of the First Reading Agenda Item Summary- February 6, 2007. BACKGROUND The Fort Collins Library Board was created to advise City Council on matters pertaining to the Fort Collins Public Library. The Board met monthly and reviewed library concerns, challenges and opportunities and shared its recommendation with the City Council about improvements to the Library. Passage of the November ballot question creating and funding the Fort Collins Regional Library District means that the Fort Collins Public Library will become part of the Library District as soon as the IGA between the City, County and Library District Board is signed. The Library District Board selection process has begun and a governing board will soon be selected. The District became official on January 1, 2007. ORDINANCE NO. 020, 2007 OF THE COUNCIL OF THE CITY OF FORT COLLINS DISSOLVING THE LIBRARY BOARD AND AMENDING THE CODE OF THE CITY OF FORT COLLINS BY REPEALING SECTIONS RELATING TO THE LIBRARY BOARD WHEREAS,the Fort Collins Library Board is a City board established by ordinance for the purposes of advising the City Council and staff on policies, rules, regulations and other matters related to the administration,management and development of the Fort Collins Public Library, and encouraging the making of grants or gifts in support of the Library; and WHEREAS, on November 7, 2006, the voters approved the establishment and funding of the Fort Collins Regional Library District (the "Library District"); and WHEREAS, on November 21, 2006, the City Council passed Resolution 2006-118 establishing the Library District and appointing two Councilmembers to a committee to select candidates for the board of trustees of the Library District; and WHEREAS, once the Library District board of trustees is in place, the City, County and Library District are required by the state Library Law to enter into an intergovernmental agreement ("IGA") within 90 days describing the rights and responsibilities of all three parties; and WHEREAS, the City intends, through the IGA, to turn over responsibility for funding and operation of the City's libraries to the Library District during 2007; and WHEREAS, after the voters approved the establishment of the Library District, the Library Board,at its regular meeting on November 8,2006, voted to recommend to the City Council that the Library Board be dissolved; and WHEREAS, the Council agrees with such recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Fort Collins Library Board is hereby dissolved. Section 2. That Sections 2-291 through 2 295 of Article III of Chapter 2 of the City Code are hereby repealed in their entirety.
