Second Reading of Ordinance No. 019, 2007, Appropriating Prior Year Reserves in the Street
Oversizing Fund for Transfer to the Capital Projects Fund-Drake and Zeigler Road Improvements
Project, Phase II.
RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
Arterial street improvements are planned for Ziegler Road, from Environmental Drive south to
Horsetooth Road. These street improvements will include the realignment and construction of
Ziegler Road to a minor arterial street. Prior to actual construction of the roadway improvements,
several drainage improvements need to be made in the area. These improvements include relocating
a portion of the Fossil Creek Inlet Ditch (FCRID) to accommodate the arterial roadway, the
construction of bridge over the FCRID,and the construction of an outfall channel from the existing
Rigden Pond (Pond 261) to the Poudre River. This Ordinance, unanimously adopted on First
Reading on February 6, 2007, appropriates funds for these improvements.

FINANCIAL IMPACT
This Ordinance appropriates $ 44,80 om o ear rese s in the Street Oversizing Fund in
order to construct drainage impr ents he a and gler Road Project, Phase II, from
Environmental Drive to Horsetooth Road. Developer contributions from the Rigden Farm and
Sidehill Development in the amount of$909,438 were previously appropriated into the project with
Ordinance No. 152,2006. This appropriation will allow the drainage improvements to go to bid this
spring.
EXECUTIVE SUMMARY

realignment and construction of Ziegler Road to a minor arterial street. Prior to actual construction
of the roadway improvements, several drainage improvements need to be made in the area. These

Staff has coordinated this project with the planned construction of a new trunk sewer line to be
constructed by the City's water and wastewater utility.

This is the second phase of the Drake Ziegler Project, a continuation of the roadway improvements
constructed in 2005 of Drake Road from Timberline to Environmental Drive. A third phase of
improvements to complete the arterial roadway will be constructed at a later date, once these
drainage improvements are co COPY
BACKGROUND
This second phase of construction will complete drainage improvements necessary to realign Ziegler
Road to the west side of the Fossil Creek Reservoir Inlet Ditch, to replace the existing substandard
CR-13 (County Road #13, now named Ziegler Road). This portion is funded through the Street
Oversizing Program, Stormwater Utility, and developer contributions.
The project includes an outfall channel for stormwater detention from the Rigden Pond 216 to the
Poudre River. Funding for the outfall channel is by developer contributions from Rigden Farm and
Sidehill Developments. The outfall channel runs through the existing LaFarge gravel mining
operation and does not affect any wetland or natural resource. The terminus of the outfall channel
is at the high water elevation of the Poudre River,which will require reshaping of the river bank at
this location. The river bed will not be affected. As is standard practice,an Army Corps of Engineer
404 permit has been submitted7(,,

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES
IN THE STREET OVERSIZING FUND FOR TRANSFER
TO THE CAPITAL PROJECTS FUND -- DRAKE
AND ZIEGLER ROAD IMPROVEMENTS PROJECT, PHASE II
WHEREAS, Phase I of the Drake Road and Ziegler Road Improvements Project resulted in
the construction of improvements to Drake Road, from Timberline east to Environmental Drive,
including the widening of Drake Road to minor arterial street standards, and the construction of the
Environmental Drive connection; and
WHEREAS, the aforementioned improvements, constructed in 2005, included the
installation of curb-and-gutter, sidewalks, asphalt paving, bike lanes, and storm sewers; and
WHEREAS, Phase II of the Drake Road to Ziegler Road Improvements Project will include
relocating a portion of the Fossil Creek Reservoir Inlet Ditch("FCRID")to accommodate the arterial
roadway, constructing a bridge over the the FCRID, and constructing an outfall channel from the
existing Rigden Pond (Pond 261) to the Poudre River(the"Project'); and
WHEREAS, the estimated cost of the drainage improvements associated with the Project is
$1,844,806; and
WHEREAS, on October 17, 2006, City Council adopted Ordinance No. 154, 2006,
appropriating unanticipated revenue,in the form ofdeveloper contributions totaling$909,43 8,which
allowed Project engineering to be undertaken and bid documents for the Project to be prepared; and
WHEREAS,additional appropriations needed($1,844,806)to complete construction of Phase
II of the Drake Road to Ziegler Road Improvements Project, are available in the form of prior year
reserves in the Street Oversizing Fund; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter")
permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for
expenditure as may be available from reserves accumulated in prior years, notwithstanding that such
reserves were not previously appropriated; and
WHEREAS, it is the desire of the City Council to appropriate prior year reserves in the Street
Oversizing Fund, totaling $ 1,844,806, for transfer to the Capital Projects Fund- Drake and Ziegler
Road Improvements, Phase II capital project,for appropriation, to construct drainage improvements
to Drake and Ziegler Roads.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated from prior year reserves in the Street Oversizing Fund,
the sum of ONE MILLION EIGHT HUNDRED FORTY-FOUR THOUSAND EIGHT HUNDRED
SIX DOLLARS ($ 1,844,806) for transfer to the Capital Projects Fund - Drake and Ziegler Road
Improvements Project, Phase Q, and appropriated therein, to be used to construct drainage
improvements to Drake and Ziegler Roads.
Introduced, considered favorably on first reading, and ordered published this 6th day of
February, A.D. 2007, and to be presented for final passage on th th day of February, A.D. 2007,
