SUBJECT
First Reading of Ordinance No. 164, 2006, Adopting, and Determining the Effective Date of, the
District-Precinct Map for the 2007 Regular Municipal Election.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY
This Ordinance adopts the District-Precinct Map for the 2007 regular municipal election for the
purposes of(1) determining the eligibility for District Council offices for the April 2007 election;
(2)determining eligibility for any interim appointments to fill any District Council vacancies which
may occur after November 17, 2006; and (3) determining residency for voting in any special
municipal election conducted after November 17, 2006.
BACKGROUND
Council district boundaries are reviewed each fall prior to the regular biennial election,pursuant to
Article II, Section 1 of the City Charter, which requires that the City Clerk determine if the number
of registered electors in the District containing the lowest number of registered electors is less than
85%of the number of registered electors in the District containing the highest number of registered
electors. If so, the City Clerk must recommend to the Council changes to the District boundaries,
which must be established by ordinance at least 120 days before the election (December 4, 2006).
This formula for determining District boundaries was approved by the voters at the April 8, 1997
election.
As of September 12,2006,there are 66,733 active,registered City voters. District 3 has the highest
number with 12,517 active voters,while District 2 has the lowest number of active voters with 9,853,
or 78.72%of the voters in District 3. These figures indicate that an adjustment of District boundaries
is needed.
Proposed District-Precinct Map
While reviewing the current District-Precinct Map and determining what adjustments,if any,should
be made to achieve the required balance of voters, staff considered the following:

(1) Alignment of City and County precinct boundaries;
(2) Alignment of Council district boundaries to precinct boundaries;
(3) Maintaining College Avenue as the north/south dividing line between the
west districts and the east districts;
(4) The number of active registered electors in each proposed district; and
(5) The residence address of each Councilmember,so that no Councilmember is
disenfranchised from his or her district.
In order to adjust the District boundaries to meet the formula described in the Charter, and in an
effort to minimize the impact to voters in adjusting the boundaries,staff is recommending that City
Precinct 26 (County Precinct 4145235228) be moved from District 3 to District 2. Precinct 26
contains 1,162 active registered voters. Although this change achieves a better balance between
District 2 and District 3, it does not completely address the need to balance the numbers of voters
between Districts.
After the move of Precinct 26, District 4 becomes the district with the highest number of active
voters (11,802) and District 6 becomes the district with the lowest number of voters (9,896),which
is 83.85%of the voters in District 4. In order to achieve the required balance,staff is recommending
that Precinct 68 (County Precinct 4145335305)be moved from District 5 to District 6. Precinct 68
contains 1,181 active registered voters. With both changes,District 4 will have the highest number
of active voters(11,802),and District 5 will have the lowest number of active voters (10,437),with
District 5 having 88.43% of the number of voters in District 4.
These changes can be made without negatively impacting affected voters. The voters in both
precincts being moved chose a District representative in 2005,and will again be choosing a District
representative in 2007.
The recommended district boundaries will provide the following balance in registered voters,based
on data obtained from Latimer County as of September 12, 2006.

Notice of Proposed Redistricting
As required by Section 7-87 of the City Code, notice of the date, time and place of Council's
consideration of this redistricting ordinance was published twice in the Coloradoan, on October 1
and October 4 (not less than 14 days and not less than 10 days before First Reading). In addition,
notice was posted on the City's web site. No comments were received in the City Clerk's Office.
Following approval of the new District-Precinct Map,individual notices will be mailed to the active,
registered voters in Precincts 26 and 68 advising them of the boundary change and how the change
affects them. This mailing will cost approximately$925.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
ADOPTING, AND DETERMINING THE EFFECTIVE DATE
OF, THE DISTRICT-PRECINCT MAP FOR THE
2007 REGULAR MUNICIPAL ELECTION
WHEREAS, Article II, Section 1 of the Charter requires that the City be divided into six
Council districts, each representing one contiguous, reasonably compact unit; and
WHEREAS, no later than 180 days before each regular biennial election, the City Clerk is
to determine if the number of registered electors in the district containing the lowest number of
registered electors is less than 85%of the number of registered electors in the district containing the
highest number and,if so,the City Clerk is to recommend to the Council district boundary changes,
which shall be established by ordinance at least 120 days before the election; and
WHEREAS,the City Clerk,in reviewing the composition of the existing districts of the City,
has determined that District 2,which has the lowest number of registered electors,has less than 85%
of the number of registered electors in District 3, which has the highest number of electors; and
WHEREAS,the City Clerk has recommended that Precinct 26 be moved from District 3 to
District 2, and that Precinct 68 be moved from District 5 to District 6 in order that the number of
registered electors in District 5 (now the District with the lowest number of registered electors)will
be more than 85% of the number of registered electors in District 4 (the District with the highest
number of registered electors); and
WHEREAS,the City Council wishes to clarify that the District-Precinct Map adopted for the
April 3,2007 regular municipal election shall also be used to determine eligibility for appointment
to fill any vacancy in Council office which may occur following the effective date of this ordinance
and prior to the adoption of a District-Precinct Map for the next ensuing regular municipal election;
and
WHEREAS,the City Council wishes to clarify that the District-Precinct Map adopted for the
April 3, 2007 regular municipal election shall also be used for determining residency for voter
registration purposes for any special municipal election held following the effective date of this
ordinance and prior to the adoption of a District-Precinct Map for the next ensuing regular municipal
election.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the 2007 District-Precinct Map dated November 17,2006,on file in the office of the
City Clerk, is hereby adopted and shall be in effect for the following purposes:
(1) determining eligibility for District Council offices for the April 3, 2007
regular municipal election;
(2) determining eligibility for District Council offices for any interim
appointments to fill any District Council vacancies which may occur
following the effective date of this ordinance on November 17, 2006, and
prior to the adoption of a District-Precinct Map for the 2007 regular
municipal election; and
(3) determining residency for voting purposes for any special municipal election
conducted on or after November 17, 2006.
Introduced, considered favorably on first reading, and ordered published this 17th day of

NOTICE OF PROPOSED

BOUNDARY CHANGES
Pursuant to the City Code and
Charter, the Fort Collins City Council
will be considering an Ordinance on October 17,
2006 to amend the Council District boundaries. If
approved, the proposed amendment would make the
following changes:
■ Move Precinct 26 (County Precinct 4145235228)
from District 3 to District 2
■ Move Precinct 68 (County Precinct 4145335305)
from District 5 to District 6
Interested individuals are invited to comment on the
proposed boundary change at the October 17, 2006
City Council meeting, which begins at 6:00 p.m. in
the City Council Chambers, City Hall West, 300
LaPorte Avenue. Any registered elector desiring to
protest the proposed redistricting may file a written
protest setting forth with particularity the grounds of
protest. The notice of protest must be submitted to
the City Clerk's Office, City Hall West, 300 LaPorte
Avenue, P.O. Box 580, Fort Collins, CO 80522, no
later than Tuesday, October 10, 2006.
