RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY Arterial street improvements are planned for Ziegler Road, from Environmental Drive south to Horsetooth Road. This Ordinance, which was unanimously adopted on First Reading on October 3, 2006, appropriates contributions-in-aid-of-construction to allow engineering and bid documents to be prepared and construction of the structures and ditch relocation to be awarded prior to the 2007 construction season. This appropriation of developer contributions will allow ditch relocation and structure improvements to go to bid this winter. Funds will be appropriated as follows: Rigden Farm Development $659,438 Contribution-In-Aid Sidehill Development $250,000 Contribution-In-Aid Additional appropriations into this project from the Street Oversizing Fund and the Stormwater Utility for roadway construction will take place in early 2007. In order to facilitate the roadway construction in 2007,the relocation of the FCRID and the construction of the bridge structures need to be completed this winter,prior to irrigation season. This is the second phase of the Drake Road and Ziegler Road Improvement Project. The first phase consisted of roadway improvements on Drake Road from Timberline to Environmental Drive. BACKGROUND This second phase of construction will realign Ziegler Road to the west side of the Fossil Creek Reservoir Inlet Ditch and replace the existing substandard CR-13 (County Road #13, now named Ziegler Road). The new alignment will meet minor arterial standards and will eliminate the current substandard roadway with its narrow one lane bridges. This portion is funded through the Street Oversizing Program and developer contributions. The project includes an outfall e o;4p t m the Rigden Pond to the Poudre River. Funding for the outfall annel is trib ns from Rigden Farm and Sidehill Developments. The project also includes two structures: A bridge over the Foothills Channel for Zeigler Road funded through the Street Oversizing Program, and a second bridge over the FCRID for access to the McDowell property, funded by developer contributions. ORDINANCE NO. 154, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE STREET OVERSIZING FUND FOR TRANSFER TO THE CAPITAL PROJECT FUND - DRAKE AND ZIEGLER ROAD IMPROVEMENTS PROJECT, PHASE II WHEREAS, Phase I of the Drake Road and Ziegler Road Improvements Project resulted in the construction of improvements to Drake Road, from Timberline east to Environmental Drive, including the widening of Drake Road to minor arterial street standards,and the construction of the Environmental Drive connection; and WHEREAS, the aforementioned improvements, constructed in 2005, included the installatio n of curb-and-gutter, sidewalks, asphalt paving, bike lanes, and storm sewers; and WHEREAS, Phase II of the Drake Road to Ziegler Road Improvements Project will include realigning and constructing Ziegler Road to minor arterial standard,relocating a portionof the Fossil Creek Reservoir Inlet Ditch("FCRID")to accommodate the arterial roadway, constructing bridges over the Foothills Channel and the FCRID, and constructing an outfall channel from the existing Rigden Pond to the Poudre River(the "Project"); and WHEREAS,Section 3.7.3(E)of the Fort Collins Land Use Code allows developers to choose to build or supply funding for required development of transportation facilities; and WHEREAS,the developers of the Rigden Farm Development and the Sidehill Development have chosen to contribute funds in lieu of building the necessary transportation facilities; and WHEREAS, the appropriation of developer contributions, totaling $659,438 from Rigden Farm Development and $250,000 from Sidehill Development, will allow engineering and bid documents to be and th prepared, e construction of the bridges and ditch relocation to be awarded prior to the 2007 construction season; and WHEREAS, additional appropriations needed to complete construction of the Project will be requested early in 2007, once Project costs have been finalized; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the developer contributions from the Rigden Farm and Sidehill Developments as described herein will not cause the total amount appropriated in the Street Oversizing Fund budget to exceed the current estimate of actual and anticipated revenues to be received during the fiscal year, and WHEREAS, it is the desire of the City Council to appropriate the sum of$909,438 from developer contributions within the Street Oversizing Fund,for transfer to the Capital Projects Fund- Drake and Ziegler Road Improvements Project, Phase II, for appropriation therein to be used to construct arterial roadway improvements for the Drake Road and Ziegler Road Improvements Project, Phase It. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from unanticipated revenue in the Street Oversizing Fund, the sum of NINE HUNDRED NINE THOUSAND FOUR HUNDRED THIRTY-EIGHT DOLLARS ($909,438) for transfer to the Capital Projects Fund - Drake and Ziegler Road Improvements Project, Phase II, and appropriated therein, to be used to construct arterial roadway improvements for the Drake Road and Ziegler Road Improvements Project, Phase It. Introduced, considered favorably on first reading, and ordered published this 3rd day of October, A.D. 2006, and to be presented for final passage on the 17th day of October, A.D. 2006.
