SUBJECT
Second Reading of Ordinance No. 077, 2006, Appropriating Unanticipated Grant Revenue in the

Artifacts in the Holdings of the Fort Collins Museum.
RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
The City was awarded two grants from the National Park Service for $16,375. This Ordinance,
which was unanimously adopted on First Reading on May 16, 2006, appropriates the grant money
in the Fort Collins Museum's Native American Graves Protection and Repatriation Act
("NAGPRA") Repatriation grant project.

BACKGROUND
On May 1,2006 the Museum was awarded two grants from the National Park Service. These grants
will enable the Museum to repatriate human remains and cultural artifacts to the Death Valley
Timbi-Sha Shoshone Band of California and the Cheyenne Arapaho Tribes of Oklahoma.
The Museum will utilize the grant funds to hire a Project Coordinator to oversee the repatriations.
The Museum is requesting appropriation of$16,375, which will be disbursed on a reimbursement
basis over a twelve-month period, into the Museum's NAGPRA Repatriation project for use during
the grant cycle of April 2006 to April 2007.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED GRANT REVENUE
IN THE CULTURAL SERVICES AND FACILITIES FUND
TO BE USED FOR THE REPATRIATION OF HUMAN
REMAINS AND CULTURAL ARTIFACTS IN THE
HOLDINGS OF THE FORT COLLINS MUSEUM
WHEREAS, in 1990, Congress established the Native American Graves Protection and
Repatriation Act ("NAGPRA"), Public Law 101-601, providing for a process for determining the
rights of lineal descendants of Indian tribes, Alaskan Natives, and Native Hawaiian organizations
to certain human remains, funerary objects, sacred objects,or objects of cultural patrimony that are
currently held in public museums; and
WHEREAS, the Fort Collins Museum (the "Museum") has been working towards
compliance with the aforementioned law, by completing a physical inventory of its collections,
sending out notification letters to tribal communities,and consulting with various plains Indian tribes
to evaluate and determine the cultural affiliation of human remains and cultural artifacts in the
Museum's holdings; and
WHEREAS, on May 1, 2006, the Museum was awarded two grants totaling $16,375 from
the Department of Interior, National Park Service; and
WHEREAS, during the remainder of 2006 and into 2007, the Museum will use the grant
proceeds to hire a Project Coordinator to oversee the repatriations of human remains and cultural
artifacts to the Death Valley Timbi-Sha Shoshone Band of California and the Cheyenne Arapaho
Tribes of Oklahoma; and
WHEREAS, no local matching funds are required; and
WHEREAS, Article V, Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the National Park Service
NAGPRA grant funds as described herein will not cause the total amount appropriated in the
Cultural Services and Facilities Fund Museum budget to exceed the current estimate of actual and
anticipated revenues to be received during any fiscal year; and
WHEREAS,it is the desire of the Council to appropriate the sum of$16,375 in National Park
Service NAGPRA grant funds in the Cultural Services and Facilities Fund,Museum NAGPRA grant
project to be used to oversee the repatriations of human remains and cultural artifacts to the Death
Valley Timbi-Sha Shoshone Band of California and the Cheyenne Arapaho Tribes of Oklahoma.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Cultural Services and Facilities Fund, Museum NAGPRA grant project, the sum of SIXTEEN
THOUSAND THREE HUNDRED SEVENTY-FIVE DOLLARS ($16,375),upon receipt from the
National Park Service,to be used to oversee the repatriations of human remains and cultural artifacts
to the Death Valley Timbi-Sha Shoshone Band of California and the Cheyenne Arapaho Tribes of
Oklahoma.
Introduced and considered favorably on first reading and ordered published this 16th day of
May, A.D. 2006, and to be presented for final passage on t 6th day of June, A.D. 2006.
