RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT This Ordinance appropriates $522,119 in unanticipated revenue from Contributions-in-Aid-of- Construction in the Street Oversizing Fund(received from the Provincetowne Filing 2 and Everitt Enterprises) and transfers an additional $1,141,110 from existing appropriations in the Street Oversizing Fund into the Capital Projects Fund to construct arterial roadway improvements for Lemay Avenue. hi conjunction with this project, maintenance and an overlay of a portion of existing Lemay Avenue will be constructed using $486,571 in funds from the Pavement Maintenance Program. This project will go to bid as soon as funds are available. Funds will be appropriated as follows: Everitt Enterprises Development $ 414,927 Contribution-In-Aid Provincetowne Filing 2 $ 107,192 Contribution-In-Aid Street Oversizing Fund $1,141,110 Street Oversizing Fund Total Transfer to Project $1,663,229 Pavement Management Program $ 486,571 Existing Appropriations Total Project Cost: $2,149,800 EXECUTIVE SUMMARY Intersection and arterial street improvements are planned for Lemay Avenue, from Trilby Road south to Carpenter Road(approximately 5280 linear feet). These street improvements will include the widening of Lemay Avenue to a four-lane arterial street from its existing two-lane configuration, and interim widening at the Lemay/Carpenter intersection to accommodate auxiliary turn lanes. The City's Pavement Management Program is coordinating rehabilitation and overlay work on Lemay Avenue with the intersection and arterial improvements. Roadway improvements include the installation of curb-and-gutter,asphalt paving,bike lanes,some landscaped medians,and stone and sanitary sewers. The construction is planned to begin in July 1, 2006 and be completed on November 16, 2006. May 16, 2006 -2- Item No. 13 BACKGROUND The Street Oversizing Program is preparing to widen the last remaining section of Lemay Avenue to four lanes in conjunction with proposed developments by the Everitt Companies and Provincetowne Filing 2. Staff has completed the engineering design and is ready to begin construction this summer. Right-of-way was previously acquired through normal development dedications. No additional right-of-way is needed, with the exception of a temporary construction easement. The City's Pavement Maintenance Program is coordinating rehabilitation and overlay work on Lemay Avenue with this project. $486,571 in existing appropriations from the Pavement Maintenance Program will be included in the contract work. A closure of Lemay Avenue will be necessary for the installation of water and sewer mains in the center of the roadway. The sewer main requires an 18-foot deep excavation. With this large an excavation there is not sufficient room to protect the traveling public and workers under traffic conditions. There are acceptable detours using Timberline and Trilby Road in this southern area. ORDINANCE NO. 078, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE STREET OVERSIZING FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE STREET OVERSIZING FUND TO THE CAPITAL PROJECT FUND - LEMAY AVENUE, TRILBY ROAD TO CARPENTER ROAD CAPITAL PROJECT WHEREAS, on February 4, 2003, City Council adopted Ordinance No. 011, 2003, appropriating prior year reserves in the Street Oversizing Fund, and authorizing the transfer of appropriations between City funds to construct improvements on Lemay Avenue from the Fossil Creek bridge south to Trilby Road; and WHEREAS, the aforementioned improvements along Lemay Avenue were spurred on by development in the area including Fossil Creek Community Park and the Paragon Point Development, south of the Southridge Greens Golf Course; and WHEREAS, with the engineering design completed and with funding secured, Staff proposes beginning the bid process for the construction of additional improvements on Lemay Avenue from Trilby Road south to Carpenter Road; and WHEREAS,the proposed improvements planned for Lemay Avenue,from Trilby Road south to Carpenter Road (the "Project") include the widening of Lemay Avenue to a four-lane arterial street from its existing two-lane configuration, including installation of curb-and-gutter, asphalt paving,bike lanes, some landscaped medians and storm and sanitary sewers,and interim widening at the Lemay Avenue/Carpenter Road intersection to accommodate auxiliary turn lanes; and WHEREAS, the estimated cost to construct improvements associated with the Project is $1,663,229, with available funding sources identified as follows: Contributions - Everitt Enterprises Development $ 414,927 Contributions - Provincetowne Filing 2 Development 107,192 Street Oversizing Fund - Existing Appropriations 1,141,110 Total $ 1,663,229 WHEREAS, in conjunction with this project, maintenance and an overlay of a portion of existing Lemay Avenue will be constructed using funding, totaling $486,571, from the City's Pavement Management Program; and WHEREAS,the aforementioned funds for Pavement Management are already appropriated in the Transportation Services Fund and are available for the portion of Lemay Avenue described herein; and WHEREAS, upon completion of the bid process, the Project is scheduled to begin July 1 st of this year with completion scheduled for mid November of this year; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter") permits City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Article V, Section 10, of the Charter authorizes City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital account to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, the appropriation of the contributions from Everitt Enterprises and the Provincetowne Filing 2 Developments as described herein will not cause the total amount appropriated in the Street Oversizing Fund budget to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, it is the desire of City Council to appropriate the sum of $522,119 from contributions within the Street Oversizing Fund, for transfer to the Capital Projects Fund - Lemay Avenue, Trilby Road to Carpenter Road capital project, and to authorize the transfer of existing appropriations, totaling $1,141,110, in the Street Oversizing Fund to the Capital Projects Fund - Lemay Avenue, Trilby Road to Carpenter Road capital project to be used to construct arterial roadway improvements for Lemay Avenue from Trilby Road, south to Carpenter Road. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from unanticipated revenue in the Street Oversizing Fund,the sum of FIVE HUNDRED TWENTY-TWO THOUSAND ONE HUNDRED NINETEEN DOLLARS($522,119)for transfer to the Capital Projects Fund-LemayAvenue,Trilby Road to Carpenter Road capital project, and appropriated therein, to be used to construct arterial roadway improvements for Lemay Avenue from Trilby Road, south to Carpenter Road. Section 2. That the unexpended appropriated amount of ONE MILLION ONE HUNDRED FORTY-ONE THOUSAND ONE HUNDRED TEN DOLLARS($1,141,110)is hereby authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund - Lemay Avenue, Trilby Road to Carpenter Road capital project to be used to construct arterial roadway improvements for Lemay Avenue from Trilby Road, south to Carpenter Road.
