SUBJECT
First Reading of Ordinance No. 107,2006,Authorizing the Transfer of Appropriations Between the
Building Community Choices-Taft Hill Road Improvements,Drake Road to Derby Court Project
and the Building Community Choices-Prospect Road Improvements,Poudre River to Summitview
Drive Project to Be Used for the Riverbend Ponds Berm Stabilization Work.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
Current appropriated funding for the East Prospect Road Project(the"Project")is$5,847,385. The
estimated total Project cost is $6,907,948. This total amount includes the Riverbend Pond berm
stabilization work as well as $280,673 in trail work to be paid by the Natural Areas program. This
request is for the remaining$779,890 which is available from the previously constructed Taft Hill
—Drake to Derby Project (the "Taft Hill Project"). The current balance in the Taft Hill Project is
$978,225. The remaining $198,225 balance is anticipated to be sufficient to finalize the Taft Hill
Project.
EXECUTIVE SUMMARY
This request is to transfer $779,890 of excess funds from the previously constructed Taft Hill —
Drake to Derby project, to the Prospect Road - Poudre River to Summitview Project to address a
greater than anticipated drainage need.
BACKGROUND
The Project is part of the voter-approved"Building Community Choices Program"("BCC")funding
The main goal of the Project is to improve safety for all m f package. g � p y odes o transportation along
East Prospect Road from the Poudre River to Summit View Drive. The Project elements identified
by the approved ballot language include widening East Prospect Road to provide two travel lanes,
on-street bicycle lanes, turn lanes, installing a sidewalk, raising the roadway section to protect it
from major floods, and constructing an additional bridge east of the Poudre River to pass 100 year
flood flows.

Staff is presently constructing an interim two lane roadway that meets the BCC criteria while
purchasing right-of-way for the future four lane roadway. The current roadway construction
schedule calls for roadway construction to be completed by October 31,2006 and completion of all
remaining items in early 2007. The Riverbend Ponds Berm Stabilization work is currently
scheduled to be bid this summer with construction completed prior to the spring 2007 runoff season.
PROJECT DETAILS
1. East Prospect Road Widening Description:
Roadway design includes the following from the BCC ballot language:
• Bicycle lanes
• Two travel lanes
• A left turn lane
• A sidewalk
• Raised roadway to protect East Prospect Road from the 100 year flood
• An additional bridge to protect East Prospect Road from the 100 year flood
The need to strengthen the upstream berms within the Riverbend Ponds Natural Area to keep
the Poudre River within its existing banks was not anticipated in the original 1997 cost
estimate. This work is critical since East Prospect's new bridge is sized to pass the 100-year
flood under current conditions with the Poudre River remaining within its current channel.
If the new bridge needed to be sized for the full Poudre River flow,it would need to be sized
four times larger than originally planned. This condition was only revealed well into the
design process.
2. Cost
Appropriated funding for the project is $5,847,000. The total project cost estimate is
$6,907,948 including some trail work for Natural Areas valued at $280,673 and one-third
of the estimated construction costs for the Riverbend Ponds Stabilization work. Thus, a
deficit of$779,890 exists for the Project.
The remaining two-thirds of the estimated construction costs for the Riverbend Ponds
Stabilization work is being funded one-third by the Stormwater Department and one-third
by the Natural Areas program.
3. Schedule
Construction is underway for the main roadway portion of this project. Staff anticipates
advertising for construction bids for the Riverbend Ponds Stabilization work in the summer
of 2006 with construction completed prior to spring runoff in 2007.
ORDINANCE NO. 107, 2006
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN THE BUILDING
COMMUNITY CHOICES -TAFT HILL ROAD IMPROVEMENTS, DRAKE ROAD TO
DERBY COURT PROJECT AND THE BUILDING COMMUNITY CHOICES -
PROSPECT ROAD IMPROVEMENTS, POUDRE RIVER TO SUMMITVIEW DRIVE
PROJECT TO BE USED FOR THE RIVERBEND PONDS BERM STABILIZATION WORK
WHEREAS, on April 8, 1997, the voters of the City approved Ordinance No. 031, 1997,
authorizing the imposition of a quarter cent sales and use tax for the purpose of generating revenues
to construct certain capital projects described in the Building Community Choices("BCC")capital
improvement program; and
WHEREAS, included in the projects approved for funding by the voters were the Prospect
Road Improvements,Poudre River to Summitview Drive project("Prospect Road Project')and the
Taft Hill Road Improvements,Drake Road to Derby Court project("Taft Hill Road Project'); and
WHEREAS,the scope of work for the Prospect Road Project included widening the roadway
to provide two travel lanes, on-street bicycle lanes, turn lanes, installing a sidewalk, raising the
roadway section to protect it from major floods, and constructing an additional bridge east of the
Poudre River to pass 100 year flood flows; and
WHEREAS, the scope of work for the Taft Hill Road Project included widening Taft Hill
Road from Drake Road south to Derby Court to a full arterial street and adding curb, gutter and
sidewalks to provide safer effective facilities for bicyclists and pedestrians; and
WHEREAS, the cost of the improvements associated with the Prospect Road Project is
$5,847,385; and
WHEREAS, the estimated cost of the Taft Hill Road Project is $6,085,262; and
WHEREAS,staff has identified savings in the Taft Hill Road Project,totaling$979,890;and
WHEREAS,the cost to strengthen the upstream berms that keep the Poudre River within its
existing banks was not anticipated in the original cost estimate for the Prospect Road Project; and
WHEREAS,the estimated cost to strengthen the upstream berms within the Riverbend Ponds
Natural Areas is $1,060,563; and
WHEREAS, the Natural Areas Program has agreed to spend,from existing appropriations,
a total of$280,673 for trail work included in the Prospect Road Project, freeing up a like amount
within the Prospect Road Project budget to be used to offset the cost to strengthen the upstream
berms; and
WHEREAS, staff recommends the additional appropriation needed, totaling$779,890, be
funded using savings in the Taft Hill Road Project; and
WHEREAS,the current construction of roadway improvements to the Prospect Road project
are underway and scheduled for completion at the end of October 2006; and
WHEREAS,the Riverbend Ponds berm stabilization work is scheduled to be bid during the
Summer 2006 with construction completed prior to the spring 2007 runoff season; and
WHEREAS, Article V,Section 10,of the Charter of the City of Fort Collins authorizes the
City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof
from one fund or capital project to another fund or capital project, provided that the proposed
transfer is from a fund or capital project account in which the amount appropriated exceeds the
amount needed to accomplish the purpose specified in the appropriation ordinance; and
WHEREAS, it is the desire of the Council to authorize the transfer of$779,890 from the
Building Community Choices -Taft Hill Road Improvements,Drake Road to Derby Court project
to the Building Community Choices-Prospect Road Improvements, Poudre River to Summitview
Drive project to be used to stabilize the upstream berms within the Riverbend Ponds Natural Area.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the unexpended and unencumbered appropriated amount of SEVEN HUNDRED
SEVENTY-NINE THOUSAND EIGHT HUNDRED NINETY DOLLARS ($779,890) is hereby
authorized for transfer from the Building Community Choices-Taft Hill Road Improvements,Drake
Road to Derby Court project to the Building Community Choices -Prospect Road Improvements,
Poudre River to Summitview Drive project to be used to stabilize the upstream berms within the
Riverbend Ponds Natural Area.
Introduced,considered favorably on first reading,and ordered published this 18th day of July,
