Resolution 2009-063 Approving the Acceptance of the Proposed Donation of the Sculpture
"Transcend."
RECOMMENDATION
Staff recommends adoption of the Resolution.
The Art in Public Places Board reviewed this art donation at its February 18, 2009 meeting,
approved this piece and requests that the City Council accepts this work of art on behalf of the City.
FINANCIAL IMPACT
This item does not impact the City's General Fund account. The design, construction and
installation costs will be paid for by donors,including the DDA. Maintenance costs for the sculpture
will be funded through the Art in Public Places program, but are expected to be minimal.
EXECUTIVE SUMMARY
This Resolution accepts the donation of artwork, a sculpture entitled "Transcend" by artist Collen
Nyanhongo, to the City. The sculpture will become part of the City's Art in Public Places
collection.
BACKGROUND
The Art in Public Places Guidelines state that all works of art with a value over$10,000 donated to
the City of Fort Collins and that are to be placed in a public area, must be approved by the Art in
Public Places (APP) Board. Once approved, the APP Board recommends that City Council accept
the work of art on behalf of the City. The City is to accept ownership and responsibility for
maintenance only of works of art that meet the objectives of the APP program. The work of art must
also meet the criteria for works of art and site selection set forth in the APP guidelines.
The sculpture, "Transcend" was created in Old Town Square by artist Collen Nyanhongo through
the generosity of the Neenan,Family LLC. The community watched as the artist carved the
sculpture from marble. The Neenan Family LLC now wishes to donate the sculpture to the City.

The Downtown Development Authority will partner this summer with the City's Art in Public
Places Program to engage artists to create art in Old Town Square on the same location now
occupied by this sculpture. The art created from this partnership will be located in the new
renovated alleys and in other public areas in the Downtown. ,The "Transcend" sculpture needs to
be relocated so this new project can begin.
City staff and the APP Board considered a variety of sites in the downtown area for the donated
sculpture. Sites at Library Park,Lee Martinez Park, Washington Park, Heritage Park and along the
Poudre River Trail were explored. The size, scale and bright white color of the sculpture did not
relate to the expansive park settings. It would simply be out of place. The many locations along the
Poudre Trail in the downtown area were too remote and did not give high enough visibility to the
sculpture. Staff and the APP Board also believe the sculpture would be very prone to graffiti if it
were located along the trail. It could be treated with an anti-graffiti coating but this is fairly
expensive and would not stop the piece from being tagged. It just allows it to be cleaned.
Staff and the APP Board believe the proposed location at the southwest corner of the intersection
of North Mason and Maple Streets (north of the City's 215 North Mason building), is a good
location for the sculpture. This triangle of turf provides a landscaped setting featuring a backdrop
of evergreen trees just west of the sculpture site and bordered by a hedge to the south. The site
provides excellent visibility for the piece, in a downtown location that includes commercial and
residential development at Penny Flats. Staff and the APP Board believe the size, scale and color
of the piece fits nicely on this site,which will allow the sculpture to enhance and add interest to the
area. The visibility of this site will also help to deter graffiti and vandalism.

the gift to the city.The board evaluated the sculpture donation of"Transcend." Votes were tallied.
Mr.Russell made a motion to accept the sculpture, "Transcend" as a donation to the city

Ms Martin passed out information about the Transformer Cabinet M rojects.Discussion was had
regarding the submission parameters.
Mr.Russell made a motion to accept the Transformer et Mural Project RFQ and RFP as we have
presented it in past years.
Ms Francuz seconded the motion

RESOLUTION 2009-063
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE ACCEPTANCE OF THE PROPOSED DONATION
OF THE SCULPTURE "TRANSCEND"
WHEREAS, in the summer of 2007, David Neenan and the Neenan FAmily L.L.L.P.
("Neenans"),in cooperation with the Downtown Development Authority(DDA),commissioned the
artist Collen Nyanhongo to create a sculpture, titled "Transcend" (the "Artwork"); and
WHEREAS, the Artwork was sculpted in Old Town Square so that members of the public
would be able to better appreciate the artistry involved in creating such works of art; and
WHEREAS, the DDA wishes to relocate the Artwork and partner with the City to create
another art attraction in the same location in Old Town Square this summer; and
WHEREAS, to accommodate those objectives, the Neenans wish to donate the Artwork to
the City; and
WHEREAS, the value of the Artwork is estimated at over$10,000; and
WHEREAS, if the donation is accepted, the Artwork would be moved to a public location
on City property; and
WHEREAS, Section 23-309 of the City Code requires that works of art with a value of$300
or more donated to the City to be placed in a public area may be accepted only with approval of the
Art in Public Places Board(the"APP Board"), and all such works with a value of$10,000 or more
may be accepted only with approval of the City Council, upon review of the proposed donation and
the recommendation of the APP Board; and
WHEREAS, at its regular meeting on February 18, 2009, the APP Board evaluated the
proposed donation of the Artwork based on the City's Art in Public Places Guidelines and
recommended that the City Council accept the donation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS,that the City Council hereby accepts the proposed donation of the sculpture"Transcend",
created by artist Collen Nyanhongo.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 7th
day of July A.D. 2009.
