SUBJECT
Resolution 2006-022 Authorizing the Execution by the Purchasing Agent of a Contract for the
Construction of a Portion of Timberline Road.
RECOMMENDATION
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT
Street improvements are proposed for Timberline Road from Drake to Prospect. Most of the
planned improvements are adjacent to development and will be constructed through the Street
Oversizing Program. These developments have also agreed to fund additional improvements
needed in order to proceed with their developments in accordance with the City's Adequate
Public Facilities Ordinance (APF).
Developers have contributed $2,500,000 to the City for the engineering design and construction
of the APF improvements to the Timberline and Prospect Intersection. These funds are in
conjunction with Special Improvement District No. 94 financed privately by property owners
developing in the proposed district. No City funds other than Street Oversizing funds are being
used for the construction of this project.
EXECUTIVE SUMMARY
City Code Section 22-39 specifies the advertising of bids and letting of contracts for Special
Improvement Districts shall be at the sole discretion of City Council.
The Engineering Plans and specifications were advertised for bidding on January 13, 2006
through the normal City Purchasing process. A pre-bid conference was held on January 24,
2006 for all interested contractors.
Bids were solicited and opened on February 14, 2006 at 3:OOPM in the Purchasing Office at 215
North Mason. Staff has reviewed the bid forms and has determined that Connell Resources, Inc.
is the lowest responsible bidder.

BACKGROUND
The Timberline Road, Drake to Prospect Project is the most heavily congested intersection in the
City. Two impacted developers are electing to privately fund intersection improvements in order
to proceed with their development projects. These developers are the majority property owners
and have petitioned for the creation of an involuntary Special Improvement District to spread a
portion of the costs through assessments to other undeveloped property in the area benefited by
the improvements.
Council has created the Timberline and Prospect Special Improvement District No. 94 with
Resolutions 2003-122 and 2005-83 and with Ordinance No. 90, 2005. To meet the requirements
of Article X, Section 20 of the Colorado Constitution (TABOR), a special election of SID
property owners was held on the November 2005 ballot. The ballot measure passed
unanimously, allowing the City to collect the assessments and reimburse the developers over
time.
City Code Section 22-39 specifies the advertising of bids and letting of contracts for Special
Improvement Districts shall be at the sole discretion of City Council. The bids have been
advertised and opened for the project in accordance with Code. Staff recommends that City
Council approve the awarding of the contract to the lowest responsible bidder, Connell
Resources, Inc.
Relocation of electric utilities and tree removal has been completed. Construction of the bridge
over Spring Creek, expansion of the Great Western Railroad crossings on both Timberline and
Prospect, and roadway improvements will begin in the spring of 2006 and be completed by the
end of the year. Utility service and perimeter roadways for the Police Facility will be included
in the Timberline Road Project. This will help with coordination of improvements and realize
significant cost savings for the Police Facility site.

RESOLUTION 2006-022
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE EXECUTION BY THE PURCHASING AGENT
OF A CONTRACT FOR THE CONSTRUCTION OF A PORTION OF TIMBERLINE ROAD
WHEREAS, the Council has heretofore created the Timberline and Prospect Special
Improvement District No.94 by Ordinance No. 090,2005,for the purpose of funding improvements
to Timberline Road between Drake and Prospect Roads; and
WHEREAS, Section 22-39 of the Code of the City provides that all contracts for local
improvements shall be let by the Purchasing Agent upon the determination of the City Council,and
that such contracts shall be let to the lowest responsible bidder as determined by the Council; and
WHEREAS, the Purchasing Agent has, in accordance with Section 22-39 of the Code,
advertised for bids,which bids were solicited and opened on February 14,2006, at 3:00 p.m. in the
Purchasing Office of the City; and
WHEREAS, the Purchasing Agent and staff of the City have recommended to the Council
that it authorize and approve the awarding of a contract to Connell Resources, Inc. as the lowest
responsible bidder; and
WHEREAS, the Council has determined that it is in the best interests of the City that the
contract for the construction of a portion of Timberline Road from Drake Road to Prospect Road be
so awarded and executed by the Purchasing Agent.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Purchasing Agent is hereby authorized to execute a contract for construction of
Timberline Road from Drake to Prospect as a component of the Timberline and Prospect Special
Improvement District No. 94 to Connell Resources, Inc. as the lowest responsible bidder.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 21 st
day of February, A.D. 2006.
