RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT The City has received the following grant funds for Police Services: 1. A grant in the amount of$21,574 from the Colorado Division of Criminal Justice, Juvenile Diversion,for the continuation of Restorative Justice Services.These funds are for the 2009- 10 grant cycle. A cash match of$7,191 (25%) is required and will be met by appropriating the funds from the Police operating budget. 2. Additional funds in the amount of$5,000 from the Colorado Division of Criminal Justice, Juvenile Diversion, for the continuation of Restorative Justice Services. These additional funds were awarded from unspent funds returned to DCJ from other agencies,and are to be used for current grant cycle expenses.A cash match of$1,667 (25%) is required and will be met by appropriating funds from prior program income. EXECUTIVE SUMMARY A grant in the amount of $21,574 and additional funds of$5,000 have been received from the Colorado Division of Criminal Justice (DCJ) for salaries associated with the continued operation of Restorative Justice Services,which includes the RESTORE program for shoplifting offenses,and the Restorative Justice Conferencing Program (RJCP) for all other offenses. Restorative Justice is an alternative method of holding a young offender accountable by facilitating a meeting with the offender, the victim and members of the community to determine the harm done by the crime, and how to repair the harm. By identifying and repairing the harm-caused by the crime, Criminal Justice Officials are optimistic repeat offenses by these youth will be reduced and the needs and concerns of the victims and affected community will be addressed. L July 7, 2009 -2- Item No. 16 A $7,191 cash match is required for the $21,574 grant and will be met by appropriating funds from the police operating budget. A $1,667 cash match is required for the $5,000 additional funds and will be met by appropriating funds from prior program income. The additional funds of $5,000 will be applied to the July 1, 2008-June 30, 2009 grant period expenses. The grant period for the $21,574 grant is from July 1, 2009 to June 30, 2010. ORDINANCE NO. 072, 2009 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND FOR THE RESTORATIVE JUSTICE PROGRAM AND AUTHORIZING THE TRANSFER OF MATCHING FUNDS PREVIOUSLY APPROPRIATED IN THE POLICE SERVICES OPERATING BUDGET WHEREAS, the Colorado Division of Criminal Justice ("CDCJ") has awarded the City a grant in the amount of$21,574 ("Grant I") for operating expenses associated with the operation of the Restorative Justice Program (the "Program") for the 2009-2010 grant cycle; and WHEREAS,CDCJ has also awarded the City a second grant in the amount of$5,000("Grant II"),from funds returned to the CDCJ from other agencies,to be used for operating expenses of the Program in the current grant cycle; and WHEREAS,the Program is an alternative method to the traditional criminal justice system; and WHEREAS, the Program facilitates a meeting with the young offender, the victim, and community members to discuss the harm caused by the young offender and to find meaningful ways for the young person to repair that harm; and WHEREAS,the grants require a cash match from the City in the amount of$7,191 for Grant I and $1,667 for Grant II; and WHEREAS, such matching funds are currently in the General Fund operating budget for Police Services and available for transfer to the grant project for the Program; and WHEREAS, Article V, Section 9, of the City Charter permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the CDCJ grant funds as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year; and WHEREAS,Article V, Section 10,of the City Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one project to another project,provided that the purpose for which the transferred funds are to be expended remains unchanged. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from unanticipated revenue in the General Fund the sum of TWENTY SIX THOUSAND FIVE HUNDRED SEVENTY-FOUR DOLLARS ($26,574)for expenditure in the General Fund to the Police Services grant project for the Restorative Justice Program. Section 2. That the unexpended appropriated amount of EIGHT THOUSAND EIGHT HUNDRED FIFTY-EIGHT DOLLARS ($8,858)is authorized for transfer from the Police Services operating budget in the General Fund to the Police Services grant project for the Restorative Justice Program and appropriated therein.
