RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT Approval of this Ordinance transfers $700,000 to facilitate a potential land acquisition with money that is budgeted and available in the Wastewater Fund. EXECUTIVE SUMMARY The Wastewater Utility has a time sensitive opportunity to purchase land. This can be achieved by transferring money from the budget for land purchases in the Drake Water Reclamation Facility ("DWRF") capital project to the land budget Sludge Disposal Improvements capital project. BACKGROUND The DWRF capital project budget encompasses long-term planning and construction needs. The money proposed to be transferred was budgeted for land purchases as buffer for the DWRF. There is no immediate need for these funds in the DWRF capital project, and future needs will be reviewed during the next biennial budget. The Sludge Disposal Improvements capital project is used for long-term planning, construction, and land acquisitions for the City's sludge disposal. The proposed purchase would expand the land base for the City's biosolids program and would avoid a potential conflict with operations should the land be available to future development. ORDINANCE NO. 030, 2006 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN CAPITAL PROJECTS WITHIN THE WASTEWATER FUND FOR THE PURPOSE OF PURCHASING PROPERTY WHEREAS, the City's Wastewater Utility (the "Utility") has a time-sensitive opportunity to purchase certain real property that would expand the land base for the Utility's Biosolids Program and help buffer the operation of that program; and WHEREAS, staff has identified funding for this land purchase in the form of existing appropriations in the City's Wastewater Fund, and unspent and unencumbered appropriations, totaling $700,000, in the Utility's Drake Water Reclamation Facility ("DWRF") capital project; and WHEREAS, the aforementioned appropriations in the DWRF capital project were budgeted for the purchase of land as a buffer at the facility, but are no longer needed in 2006; and WHEREAS, the unspent and unencumbered appropriations in the Utility's DWRF capital project need to be transferred to the Utility's Sludge Disposal Improvements capital project in order to accommodate the proposed land purchase; and WHEREAS, Article V, Section 10, of the Charter of the City of Fort Collins authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the proposed transfer is from a fund or capital project account in which the amount appropriated exceeds the amount needed to accomplish the purpose specified in the appropriation ordinance; and WHEREAS, it is the desire of the Council to authorize the transfer of$700,000 from the Wastewater Fund - Drake Water Reclamation Facility capital project to the Wastewater Fund - Sludge Disposal Improvements capital project, to be used with existing appropriations for the potential purchase of property to be used for the Utility's Biosolids Program. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the unexpended and unencumbered appropriated amount of SEVEN HUNDRED THOUSAND DOLLARS ($700,000) is hereby authorized for transfer from the Wastewater Fund - Drake Water Reclamation Facility capital project to the Wastewater Fund - Sludge Disposal Improvements capital project, to be used with existing appropriations for the potential purchase of property to be used for the Utility's Biosolids Program. Introduced, considered favorably on first reading, and ordered published this 21st day of February, A.D. 2006, and to be presented for final passage on the 7th day of March, A.D. 2006.
